AFFIDAVIT OF CONSENT AND WAIVER OF RIGHTS OVER

THE CUSTODY OF MIKHEILA NOREENE NAVAREZ
BENOLIRAO
 

I, EZRA PABRIGA NAVAREZ, of legal age, Filipino, and with

residence address at Sitio Caimito, Lower Dapdap Poblacion 3, Carcar City, Cebu,
after having been sworn to in accordance with the law, hereby depose and state:

          1.       I am the biological mother of MIKHEILA NOREENE

NAVAREZ BENOLIRAO(“Mikheila Noreene”) who was born on 7 October
2011 at Perpetual Succour Hospital, Cebu City;

           2.       Her father, Noel Delos Santos Benolirao (“Noel”), was my former

lover until we broke up in 2018 because I cheated and had a casual sexual
relationship with a married man and soon thereafter got involved with many other
different men;

           3.       We reconciled in DECEMBER 2019 and lived together with

Mikheila Noreene;

           4.       On JANUARY 17, 2020, I gave birth to ERIC YOSEF at

Perpetual Succor Hospital and Noel willfully gave his acknowledgment as a father
to ERIC YOSEF;

           5.       But on DECEMBER 25, 2020, Christmas Day, Noel caught me
AGAIN with another man so we separated and my ten (10) year old daughter
Mikheila Noreene chose to be with her father Noel;

           6.       It has been EIGHT months since Noel and I separated and I
have already abandoned my responsibility as a mother to Mikheila Noreene;

           7.       Noel and I first broke up in 2018 when he caught me cheating
and having sexual affair with PETER LEE BARGAYO of CARCAR CITY
LGU. I have custody over Mikheila Noreene until it was transferred later on to
Noel when Noel caught me again with another man on CHRISTMAS DAY
December 25th, 2020;

          8.       I believe that the sole custody over Mikheila Noreene to Noel is for
Mikheila Noreene’s best interest and well-being and, thus, so I agree and give my
consent for the same;
           9.       Further, I am waiving and relinquishing my rights over the
custody of Mikheila Noreene and leaving the same to Noel for the same reason as
Mikheila Noreene’s best interest and well-being;

           10.       Likewise, I will no longer oppose any proceedings already

instituted or about to be instituted by Noel regarding the custody over Mikheila
Noreene;

           11.     Further, I hereby declare under oath that I will no

longer harass Noel and Mikheila Noreene and I will let them live peacefully and
harmoniously with each other;  

           12.     Lastly, I am executing this Affidavit to attest to the truth and
veracity of the foregoing statements and for whatever legal purpose the same may
serve.
