The meeting was called to order at 10:00 AM by Honorable Board Member Ramon | Bausas, Sanggunian Panlalawigan Vice-Chairperson of Committee on Housing and Land Utilization and asked the Secretariat to recognize the attendees and to present the purpose of the Public Hearing. The Secretariat of the Sangguniang Panlalawigan stated that majority of the Committee Members are present and the subject of the Public / Committee Hearing is related to the letter of the Provincial Administrator to the Honorable Members of the Sangguniang Panlalawigan, dated August 29, 2017, thru Honorable Vice-Governor Sofronio Ona of the Committee on Housing and Land Utilization, endorsing the DRR/CCA Enhanced-Provincial Development and Physical Framework Plan (PDPFP) 2014-2022 of the Province of Batangas for re-adoption and approval of the new set of Board Members. Business of the Day A. Disaster Risk Reduction and Climate Change Adaptation (DRR/CCA) Enhanced Provincial Development and Physical Framework Plan (PDPFP) 2014-2022 of the Province of Batangas. Board Member Bausas requested Mr. Benjamin |. Bausas, PGDH-PPDC to give the rationale of the Public / Committee hearing as to why there is a proposal to re-adopt the Provincial Development and Physical Framework Plan of the Province of Batangas. Mr. Bausas was very thankful and appreciative of the SP Committee Members and other stakeholders who are present in the Public / Committee Hearing for PDPFP 2014-2022. He said that the previous PDPFP 2008-2013 has reached its planning period and a new one has to be formulated, the PDPFP 2014-2022. He said that the PDPFP is the combination of the Provincial Physical Framework Plan (PPFP) and Provincial Development Plan (PDP) of the Province. It contains the long term vision of the Province and identifies development goals, strategies and targets with corresponding programs, projects and activities to be implemented within the planning period He cited the chronological events of the preparation of the Plan. He mentioned that since 2011, the Technical Working Group has been updating the PDPFP. The PPDO personnel underwent various trainings and seminars regarding the preparation of DRRICCA Assessment Report and how to mainstream it to the Framework Plan. The output was the DRR/CCA Enhanced PDPFP 2014-2022. Mr. Bausas also emphasized that PPDO also went through a series of consultations with different stakeholders; specifically the National Economic and Development Authority (NEDA) Region IV-A. After the final draft has been completed in June 22, 2014, it was presented to the Regional Land Use Committee (RLUC) for their comments and approval. RLUC Resolution No. IV-A-01-2015 was issued on February 18, 2015 endorsing the PDPFP 2014-2022 of the Province of Batangas to the Sangguniang Panlalawigan (SP). On June 22, 2016, SP Resolution No. 215 was signed approving and adopting DRR/CCA Enhanced-PDPFP 2014-2022 of the Province of Batangas. New development thrusts / priority projects of Governor Hermilando |, Mandanas were also incorporated in this Plan. When the PDPFP 2014-2022 was submitted to Housing and Land Use Regulatory Board (HLURB) for approval of the Board of ‘Commissioners, requirements such as conduct of public hearing was needed prior to its approval. Thus, Mr. Bausas emphasized that the Public Hearing was set to complete the requirements and it will be an opportunity to present the Plan to the new members of the Committee on Housing and Land Utilization. Honorable Board Member Bausas, said that he was informed that an Audio-Visual Presentation for the PDPFP 2014-2022 of the Province would be presented. After the presentation, he asked the members of the Committee and other stakeholders for comments, questions and additional inputs to the Plan. Honorable Board Member Rowena Sombrano-Africa requested some points / inputs from Regional Line Agency (RLA) representatives present in the meeting and she said that comments must be integrated to the plan considering that the new administration of President Rodrigo R. Duterte has some remedies and that the enabling of the current PDPFP was initiated during the time of former President Benigno S. Aquino. She emphasized that before the Sanggunian would come up Leen nn nn aatIIIIEEInEnInI Ene Page 3 10 a R 3 “4 15 16 wv 18 19 20 21 2 2B 24 25 26 a 28 29 30 31 32 33, 34 35 36 37 38 39 a a2 43 45 46 a7 43, with the summation and an action for re-adoption of the plan, it would be ideal that the same inputs will be gathered from the Provincial Departments and Offices, as well. For instance, she said, is the expansion of Hospitals under Provincial Health Office; and some other future plans that still need to be incorporated. She also asked the Planning Office, if there is a need to update the database considering that the data covers 2010-2012. On the other hand, she added that if there is no problem with the National and Regional alignment; and with PPDO, then it will be fine, But if there is a need, then it would be much appreciated by the Sanggunian to make some amendments to the submitted plan. Board Member Bausas asked if there are other comments from the attendees and guests Mr. Rodrigo dela Roca, from Batangas City Disaster Risk Reduction and Management Office and representative of Mayor Beverly Dimacuha, observed that the presentation was very informative. He commended the Provincial Government for having plans and development study in the locality, with consideration of climate change especially the Risk Reduction Project and the Rehabilitation of Calumpang River. He stated that “Batangas City, just like any other municipality in the Province is being flooded when there is a typhoon". He mentioned that the City has also plans for Calumpang River like the proposed construction of dike along the river and putting up of early warning devices which will be useful when the river rises. He mentioned about Typhoon Glenda that caused the rise of water level in Calumpang River, and of Typhoon Maring that destructed the early warning devices in the river. He then cited the problems brought about by widening of roads in the City such as water inlets that were substandard and could not sustain the intake of the volume of water during heavy rains / typhoon. According to Mr. de la Roca, it made the three barangays of the City become flooded which did not happen before the widening of roads. He said that, somehow, the Department of Public Works and Highways (DPWH) diverted the canals differently from its path which caused the flooding. He added that DPWH should have proper specifications of inlets suitable to the project. He suggested a dialog with DPWH regarding the problems. According to him lack of coordination and improper specifications of water inlet could cause continuous flooding in the future, considering the drainage and tributaries of the City. He also mentioned MERALCO posts along the widened road that should be removed as these could cause accident to the riding public. Ms. Lilia Lumbera of HLURB referred to the updating of the plan and the process of submission of PDPFP of the Province. She said that they have received the copy of the Plan last August 22, 2017; but they have to retum the documents because there was an instruction from NEDA during the last Regional Land Use Committee meeting last August 25, 2017 that the documents should be aligned with the Regional Development Plan (RDP) and in the Philippine Development Plan (PDP) She said that the Planning Office has already been informed about these matters and has aligned the plan to the national thrusts. Board Member Africa asked Ms. Lumbera if the allowable timeframe of study was acceptable to them and if there is no need for a change in the variables. Ms. Lumbera answered that there is no need to change the timeframe because it was anchored to the PDP which is up to year 2022. She added that NEDA 4A has instructed to include the Vision for 2040 and the presentation that was made during Provincial Road Show. A Page 4 10 a 2 2B 4 15 16 wv 18 19 20 2 2 2B 24 25 26 7 28 29 30 31 32 33 34 35 36 37 38 39 a 42 43 44 45, 46 a7 Mr. Joselito Castro of the PDRRMO shared that the preparation of draft of the Contingency Plan for Taal Volcano is on-going. He said that they have already finished the scenario setting and the next step will be taking an aerial shot of Taal Volcano vicinity to observe the communities that will be mostly affected. He added that they have conducted several drills in the barangays that will be directly affected. He said that formerly, the population that would be affected was around 6,000; but at present there would be around 11,000 residents around the volcano. He added that residents around the volcano, particularly those from the Municipality of Balete, have existing shelters in the mainland. He emphasized that these are not evacuation centers but is already a Housing Project. He was also talking with the MORRMOs of Municipalities of San Nicolas and Talisay for them to have the same approach like the Municipality of Balete - buy a lot / area for the same purpose; and development could be in partnership with the Provincial Goverment or the National Housing Authority. Ms. Ana Dagfialan of HLURB stated that, for the information of all the attendees, the ‘conduct of Public Hearing is a requirement just like how it is done in preparing CLUP of Cities and Municipalities. According to her, it is required that the Physical Framework Plan should also have a public hearing and minutes of the meeting. She then assured the Mayors of Municipalities that they could provide needed technical assistance in the formulation of CLUP. She added that all plans should have a public consultation - a well informed community, comments and recommendation — as these are the requirements for approval Board Member Bausas agreed that the purpose of the Public Hearing is to conform with the requirements, before the approval of the Physical Framework Plan by the Board of Commissioners. He added that this will also be the Framework Plan of all the municipalities and cities within the Province of Batangas. He asked again for other comments or inputs, and questions from other Board Members and other National ‘Government Agencies like DepEd, DPWH, DAR, DENR regarding PDPFP 2014-2022 In relation to what have been mentioned about MERALCO posts along the road, Engr. Jay Vifia of DPWH II said complementary / in relation that they have already removed some of it. However, he shared that they are having difficulty in resolving posts along the canal waterways which should be five (5) meters away from national road. Nevertheless, he further assured that they are doing their best to solve the problem, Relative to the issue, Board Member Bausas shared that the Sangguniang Panlalawigan has already enacted an ordinance mandating public and private Utilities to remove posts along the widened road and they prescribed penalties for it. He then asked Senior Board Member Africa to elaborate. Board Member Africa confirmed that they have already passed an ordinance mandating public and private utilities like BATELEC to remove all barriers and posts during implementation of road widening project. She mentioned that this is very rampant in First District. According to her, responsibility of removing the barriers will depend on the concession of two parties. She then discussed the thrust of the current administration which is to mandate both entities to step forward in resolving the issues / challenges and to look for alternatives in the most efficient and immediate way / means. She further requested for their commitment and a mandatory obligation regarding the matter: the soonest possible time to remove those posts / barrier. Engr. Vifla answered that it would be discussed with the District Engineers. Board Member Africa emphasized that they also have to talk with them; as they have already made their appeal regarding the issue, but they got the same answer. Engr. Vita replied that their Regional Director is prioritizing the Manila-Batangas portion which is Batangas City to Sto. Tomas. Board Member Africa then expressed that they saw the development and they have seen the widened roads but what they asked was the immediate action to resolve the issue and to maximize usage of widened road. She said that it will be unsafe to the public / motorist if the barriers will not be removed. She restated the appeal especially to DPWH. She pleaded that if DPWH focuses on the lanes of Sto. Tomas, she humbly asked to also find means / methods to remove the barriers on the road within the last quarter of the year, most especially in District |. In connection to this, Board Member Bausas stated that they also have a pending ordinance in Sanggunian prohibiting the parking vehicles along the national highways. It was sponsored by Board Member Arthur Blanco of the Fifth District According to him, a Provincial Task Force that will implement the ordinance upon deputizing the LTO together with the PPOSS; and will strictly enforce the ‘No Parking System’ along the widened road, was envisioned. He added that the portion of widened roads became parking areas and those posts should be removed. With regard to establishment owners along the road, he added that they should provide proper parking space for their clients. Ms. Dagfialan believed that consultation is essential for these matters. She has highly regarded Batangas Province as area of industrialization. But one thing that they noticed during their assistance to LGUs like the Municipality of Balayan is their river body which was highly polluted; maybe because of industries like Azucarera (Central Azucarera de Don Pedro, Inc.). She thought that the Province should not only focus their attention with industrialization, and improvement of economy and business in Batangas; but, at the same time, with the environment. She cited Cavite Province which imposed sanctions to LGUs with existing open dumpsites. She suggested that Batangas Province should also have similar regulations and address environmental issues. Board Member Bausas was thankful to the comment of Ms. Dagfialan. He then acknowledged the presence of Board Member Wilfredo Maliksi and recognized Board Member Arthur Blanco. Board Member Blanco shared that there is a road widening project for Batangas City amounting to Php 50 Million from Senator Ralph Recto; as requested by Govemor Mandanas. The amount will be downloaded to the Province from Department of Budget and Management (DBM). The project was for the construction / widening of road at Brgy. Sta Clara, Batangas City. He added that another Php 0 Million will be downloaded from NHA for a Housing Project for residents/squatters of Brgy. Cuta, Batangas City. He thought that the land or area belongs to the Levistes’ where the Housing Project would be located, According to the Board Member, the project should be implemented by the Province; but the Province already has ample or lots of projects to be implemented. With these, he requested assistance from the ee Page 6 10 uu 2 B a4 45 16 v7 18 1s 20 2 22 2B 24 25 26 27 28 29 30 a1 32 33 34 35 36 37 38 39 40 a1 a2 43, 44 45 46 representative of the City Goverment of Batangas to inform Mayor Beverly Dimacuha about the projects and to have a meeting with the Provincial Government regarding these. He said that the projects are for implementation by the LGU and not by DPWH, in case of road widening and construction. For the Housing Project, he said that the NHA could provide assistance; and the budget has already been approved. He emphasized that there is a need to discuss the project with Mayor Dimacuha; to download the funds and to relocate the squatters in Brgy. Cuta for them to improve their lives. Board Member Bausas said that, with respect to the earlier comments regarding the environmental fee or sanctions, he called the attention of Provincial Government Environment and Natural Resources Office (PG-ENRO) to strictly implement the Batangas Province Environmental Code of 2012. It will greatly benefit the First District Area where most of industrial wastes are not properly disposed; which, in return, would destroy the water bodies. He stressed that the Code has already been existing since 2012. Mr. Joselito Javier, PGADH-Provincial Assessor's Office, wanted to clarify things with regard to geo-hazards present in the Province. He inquired, if the newly found fault in the Municipality of Mabini and elsewhere was incorporated in the PDPFP. Board Member Bausas asked if the clarification is incorporated in the Plan. Ms. Dagfalan explained that the CLUP of the Municipality of Mabini is still on the process of updating. She cited it was mandated by NEDA that the concerned LGU must incorporate new faults found in their locality. Those LGUs identified as calamity areas just like Mabini, must automatically update their CLUP. At this point in time, she shared that they are well coordinated with the MPDC of Mabini and they already started the data gathering. She said that they stil have to mainstream the newly identified fault line in Mabini in their proposed CLUP. She added that Mitigation Plan should also be incorporated and the verification and validation of the fault must be coordinated with the Mines and Geosciences Bureau (MGB). Board Member Bausas noted the comments of Ms. Dagfialan on the CLUP of Mabini, He asked for other comments, reaction or suggestions. Mr. Javier asked for the possibility of incorporating the current development in the new found fault in Mabini to PDPFP; since they are currently updating their CLUP. In his opinion, he said that it should be incorporated but updated geo-hazards maps may not yet be available at MGB. Board Member Bausas noted Mr. Javier's comment and said, “We cannot be a hostage of a municipality in passing the Provincial Physical Framework and Development Plan; we cannot await for that; so we will just note those concems for incorporation although the earthquake happened only recently or this year". He added that the geo-hazard maps on the Plan should be updated also by the MGB; then suggested that the PDPFP must be adopted and necessary updates must be coordinated properly Board Member Africa added that the PDPFP already speaks of the current status of the Province. With regard to how the situation of geo-hazards should be assessed, she explained that the Plan was able to provide estimated / average data, though not very specific. For instance, and with reference to earthquake incident in Mabini, the Framework Plan was able to show an average earthquake magnitude of 3.8 and a ee ee ee ee Page 7 10 a 2 B “4 15 16 uv 18 19 20 2 2 23 24 25 26 7 28 28 30 a1 32 33 34 35 36 37 38 39 total of 3,947 affected population. In her opinion, she thought that DSWD will also give almost similar data. She then recommended to the Technical Working Group (TWG) for the preparation of the Plan, to start updating and gathering data, especially on health and social sector, since planning is also about to end. Mr. Antonio De Lacy of PDRRMO made clarification that for flood and landslide hazards, NAMRIA could provide data / maps; but regarding earthquake hazards Philippine Volcanology and Seismology (PhiVolcs) is the one that has related data. Board Member Bausas responded that the PDPFP already has the PhiVoles data and could be the basis of geological studies of cities and municipalities. With all of the comments and suggestions from the participants, he recommended that the Technical Working Group should put it all in matrix form and it would be submitted together with the copy of the minutes of the public hearing for re-adoption of the Sangguniang Panlalawigan, after deliberation. He said that they will prepare the Committee Report regarding the Public Hearing He then thanked all the attendees and adjourned the meeting at 11:34 in the morning.
