1. Briefly Discuss the FFG. (10 points each)
A. Criminal Investigator and Special Crime Investigator
 A criminal investigator is a person who is educated and trained to investigate crimes,
crime scenes and criminal activity. They often work for state and federal law enforcement
agencies. There are some professional criminal investigators who engage in private
investigation. Some criminal investigators are specialists in forensic science. Special
Crime Investigation is a special study of modern techniques in the investigation of
serious and specific crimes including murder, homicide, rape, abortion, robbery, arson
kidnapping, blackmail, car napping and criminal negligence. The emphasis is on physical
evidence rather than an extra judicial confession. Special crime investigation focuses on
specific crimes which by their nature are difficult and complex to investigate. Special
Crime Investigation (defined) is a process of applying special equipment and special
expertise; it needs once expertise and a particular special instrument. It is also deals
with the study of major crimes based on the application of special investigative
technique.

B. Primary responsibilities of an Investigator


 Crime scene investigator is a complex and multi. Faceted one, as a number of
subspecialties exist within this profession. However, in general, a crime scene
investigator is a professional who is trained to collect, preserve and process evidence at
the scene of a crime. Process crime scenes by performing scene recognition, scene
documentation and evidence collection.

C. Qualities of an Investigator
 These are the qualities of investigator. Like proven working experience as criminal
investigator. Being passionate about following the facts to discover the truth, with a goal
of contributing to the process of justice. Being detail-oriented and observant of the facts
and the timelines of events

D. Basic rules to be observed in conducting Investigation


 Be fair and objective everyone involved in an investigation deserves to be treated with
respect and dignity. Do not pre-judge. Wait until all witnesses have been interviewed and
evidence examined before reaching factual determinations and ultimate conclusions.

E. As an Investigator, what are the things you should do upon arrival at the crime
scene?
 As an investigator, what i should do upon the arrival at the crime scene is secure the
are cordon the area and recognizing the scene and the physical evidence at the scene is
crucial as to ensure that the evidence is not compromised in any way and that it can be
identified, processed, and packaged in an organized fashion. This phase of the
investigation also involves identifying the resources and equipment that may be needed
and identifying and addressing any safety concerns or hazards. The next phase involves
documenting and processing the physical evidence. This is done through written notes,
diagrams, reports, photographs, and sketches. This information must be comprehensive,
accurate, and factual, as it may be used by forensic scientists in the laboratory, by law
enforcement officials, and in a court of law.

2. Define the FFG and give its element to qualify such crime (10 points each)
a. Murder
 Murder is the unlawful killing of another human without justification or valid
excuse, especially the unlawful killing of another human with malice
aforethought. This state of mind may, depending upon the jurisdiction, distinguish
murder from other forms of unlawful homicide, such as manslaughter
 Elements of murder:
1. That a person was killed.
2. That the accused killed him.
3. That the killing was attended by any of the qualifying circumstances mentioned in
Art 248 RPC.
4. That the killing is not parricide or infanticide

b. Homicide
 Ito ay the unlawful killing of any person, which is neither parricide, murder nor infanticide.
Intent to kill is conclusively presumed when death resulted; evidence of intent to kill is
important only in attempted or frustrated homicide.
 Elements of Homicide:
1. That the person was killed;
2. That the accused killed him without any justifying circumstance;
3. That the accused had the intention to kill, which is presumed;
4. That the killing was not attended by any of the qualifying circumstances of
murder, or by that parricide of infanticide.
c. Parricide
 Any person who shall kill his father, mother, or child, whether legitimate or illegitimate, or
any of his ascendants, or descendants, or his spouse, shall be guilty of parricide and
shall be punished by the penalty of reclusion Perpetua to death.
 Elements of parricide
 Person is killed;
 Deceased is killed by the accused;
 Deceased is the accused's
 legitimate/illegitimate father
 legitimate/illegitimate mother
 legitimate/illegitimate child (should not be less than 3 days old, otherwise crime is
infanticide)
 other legitimate ascendant
 other legitimate descendant
 6. legitimate spouse

d. Abortion
 It’s a willful killing of a fetus in the uterus or violent expulsion of the fetus from the
maternal womb which result to the death of the fetus. It is also the termination of
pregnancy by the removal or expulsion from the uterus of a fetus or embryo
before viability. Makasalanang pag papalaglag sa sinapupunan ng bata. The
aborton has two types which is the intentional and unintentional abortion here are
the element:
 Elements of Intentional Abortion
1. That there is a pregnant woman.
2. That the violence is exerted, or drugs or beverages administered, or that the
accused otherwise acts upon such pregnant woman.
3. That as a result of the use of violence or drugs or beverages upon her, or any
other act of the accused, fetus dies, either in the womb or after having been
expelled therefrom.
4. That the abortion is intended.

 Element of unintentional abortion.


1. That there is a pregnant woman;
2. That the violence is used upon such pregnant woman without intending an
abortion.
3. That the violence is intentionally exerted;
4. That as a result of the violence the fetus dies, either in the womb after having
been expelled therefrom.

e. Physical Injury
 Harm done to a child's psychological or intellectual functioning which may be
exhibited by severe anxiety, depression, withdrawal or outward aggressive
behavior, or a combination of said behaviors which may be demonstrated by a
change in behavior, emotional response or cognition.
 Physical injuries include those caused by mechanical trauma, heat and cold,
electrical discharges, changes in pressure, and radiation. Mechanical trauma is
an injury to any portion of the body from a blow, crush, cut, or penetrating wound.
