The requirement of approved completion plan

This Undertaking-cum-indemnity is executed on 30-05-2022 day of (Monday) at Karachi by

Mr.Junaid Aftab holding CNIC No. 42301-8276586-1 & Mr. Arsalan Aftab Holding CNIC No. 42301-
9738289-5 R/O 68-B/1 Q STREET DEFENCE PHASE VII KARACHI.
Whereas, K-Electric Limited (hereinafter referred to as “K-Electric”) is a vertically integrated
company which generates, transmits and distributes electricity in Karachi and its adjoining areas
including Dhabeji and Gharo in Sindh and HUB, Uthal, Winder and Bela In Baluchistan and has an
exclusive distribution license for the said territories.
And, Whereas I have applied to K-Electric for electricity connection in relation to Survey No 732
Situated Mauza PathraTehsil Hub district Lasbela, Baluchistan. (hereinafter to referred to as the
“Premises”) Karachi vide my application no __________ dated __________.
In consideration of my request to K-Electric for issuance of electricity connection based on the
information and documents provided by me which I confirm to be true and correct and correct in
all material respect, I hereby irrevocably, unconditionally and solemnly agree, affirm and undertake
as follows:
1. I say that I am an absolute owner /tenant/occupant of the Premises, for which I have applied
for Load Extention of electricity connection at the office of K-Electric situated at New
Connections Department Civic Center, Karachi.
I represent that I am entitled to use the Premises for Industrial purposes in accordance with
applicable law and as reflected in my application.

2. The Contents of the accompanying application for the grant of electricity connection, and
further documentation and/or information provided by me in connection therewith, are true
and accurate to the best of my knowledge and belief and nothing has been concealed thereto.
3. I further undertake and solemnly affirm that the premises has been purchased and occupied
after fulfillment of all legal requirements under application law and that in future, if any type of
objection is raised or made by way of notice or otherwise by the competent court of law or any
other relevant authority including but not limited to the Control Authority (TEHSIL OFFICE
Baluchistan, AC OFFICE) in relation to the unauthorized ownership, Construction or
encroachment from any approved building plan or otherwise. Then K-Electric without further
reference or notice shall be authorized to disconnect the electricity connection provided at the
premises irrespective of any payment received without any prior notice or intimation to me at
my sole risk and cost.

4. I represent and warrant that no objection, restriction, imposition or any other concern has been
raised by any governmental department including and in particular, the (TEHSIL) in respect of
grant of the completion plan for the premises.
5. I further undertake to carry out all legal procedures and obtain relevant approvals and
permissions prescribed under the pertinent laws including but not limited to the TEHSIL
OFFICE Baluchistan.

6. I further undertake that in case the actual construction carried out on the Premises if found by
K-Electric t be inconsistent with the approved completion plan, K-Electric shall be entitled to
require me to provide approved completion in respect of the actual construction grant by the
TEHSIL office Hub within a period of Fifteen (15) Days or disconnect the electricity connection
provided to the premises at once without any prior notice or intimation.

7. I undertake to obtain relevant approvals required with respect to regularization of the

premises from the relevant authorities including but not limited to the TEHSIL Office/ AC
office Hub. Katchi Abadi authority within a period of thirty (30) days from the date of
submission of my application to K-Electric for electricity connection, and provide all approvals
and permissions with respect to regularization of the premises to K-Electric within a period of
(15) Days from the date of receipt the same.

8. I further undertake to submit the factory registration certificate as soon as it is issued to me

by the Directorate of Labor under the BaluchistanFactories Act, to KE.

9. I further undertake to provide all other valid approvals, permissions certificates licenses,
correspondences, receipts, challans grant instruments or any other documents pertaining to
matter including but not limited to ownership, building construction occupation or trade, as
and when required by K-Electric.

10. I further undertake that in case of change of ownership of the premises I shall require the
subsequent owner of the premises to issue an undertaking similar to this
undertaking-cum-indemnity (as a pre-condition to sale/transfer of the premises) which shall
contain all undertakings, representations, warranties, and indemnities necessary for KE to
remain protected against any losses or liabilities that may arise necessary for KE remain
protected against any losses or liabilities that may arise in future in respect of provision of
electricity to the premises following the change of ownership,

11. I undertake to comply with all existing and future laws, rules, regulations, notifications,
decision of any court of law of Pakistan, or any executive decision of the pertinent government
and in case of any violation or breach, K-Electric shall be entitled to disconnect the
electricityconnection of the premises or take any other appropriate measure which it deems fit
at my own risk and cost.

12. I hereby indemnify, defend and hold harmless K-Electric and its directors, officers, employee,
independent contractors, agents, representatives and advisers in respect of any damage,
losses , diminution in value, changes, liabilities, claims demands,sotions,suits,petitions,legal or
quasi legal proceedings, payments, judgments, settlements, awards, assessments, deviancies,
interest, penalties and cost and expenses (including reasonable lawyers’ and consultants’
fees and expenses) imposed on, sustained, incurred or suffered by, or asserted against,
K-Electric or any of its directors, officers, employees, independent contractors, agents,
representatives and advisers (whether in respect of third party claims, claims between the
parties hereto, or otherwise) directly or indirectly relating to or arising out of :

(i) Failure to submit approved completion plan in respect of the premises to K-Electric along
with the application for electricity connection and/or within the reasonable period of
time after such application;
(ii) Any breach by me of any undertaking, covenant, representation or warranty made by me
hereunder or in my application or any supporting documentation.
(iii) Any and all losses suffered or incurred by K-Electric by reason of or in connection with any
claim or cause of action of any third party (including government body or authority) to
the extent arising out of any action, inaction,event,condition, liability or obligation of
me or K-Electric under applicable law to obtain approved completion plan as a
pre-requisite to the grant of the electricity connection to the application.
(16) I hereby agree to abide by all the terms mentioned herein as well as any policies
framed or issued by K-Electric from time to time which are applicable to consumers in
my relevant category.

(17) In the event of my failure to comply with applicable laws or breach of any
representation, covenant or undertaking in accordance with the terms hereunder,
K-Electric would be entitled to disconnect the electricity connection of the premises or
take any other appropriate measure which is deems fit solely at my own risk and cost.
