Step 1. OWNER’S AFFIDAVIT OF LOSS

Lily Cruz, the registered owner of the property, shall


validly execute an affidavit of loss stating the facts and
attending circumstances of the loss of the certificate of title.
The amount for the preparation and notarization of the
instrument is Php1,000.00.

Ms. Cruz shall comply with the requirements of PD 1529


and the requirements provided in the case of Republic of the
Philippines vs. Rogelio B. Circuelas, G.R No. 239505, February
17, 2021. Thus:

 The owner’s duplicate has indeed been lost.


 The petitioner seeking the issuance of a new owner’s
duplicate title is the registered owner.

Step 2. FILING OF THE AFFIDAVIT WITH THE LOCAL


REGISTRY OF DEEDS

The Proper Registration Decree provides that in case of


loss or theft of an owner’s duplicate certificate of title, due
notice under oath shall be sent by the owner to his/her
representative to the Register of Deeds of the province or city
where the land lies as soon as the loss of theft is discovered.

Step 3. REQUEST A COPY OF RECENT TAX DECLARATION AND


STATEMENT OF REAL PROPERTY TAX FROM THE LOCAL
ASSESSOR AND TREASURER

The office and function which is to serve as additional basis to


establish the ownership of Ms. Cruz as reflected in the Tax
Declaration and Tax Clearance of the subject property.

Ms. Cruz shall obtain a copy of the recent and/or


updated tax declaration for the property covered by the
missing title and a statement of account of the real property
tax therefor to establish the fact of the ownership thereof. The
corresponding charge therefor may range from Php500 to
Php1,000.00.

Step 4. FILING OF THE AFFIDAVIT OF LOSS WITH THE


REGISTRY OF DEEDS

Petition for Reissuance of Title

Step 5. FILING FOR PETITION FOR REISSUANCE OF TITLE


WITH THE REGIONAL TRIAL COURT OF PALAWAN AND

Step 6. COURT APPEARANCE

Lily Cruz shall appear and testify on the Petition as may be


ordered by the Court where the Verified Petition for Reissuance of
Title is raffled.

Step 7. FILING OF THE COURT’S DECISION WITH THE


REGISTRY OF DEEDS

The Registry of Deeds where the property covered by the Title


is situated shall be formally furnished of the Court’s Decision.
