Facts

Sometime in May 1936, the respondent Director of Post announced that he would order the
issues and selling of postage stamps in the commemoration of the 33rd International Eucharistic
Congress of the Roman Catholic Church under Act No. 4052. — AN ACT APPROPRIATING THE SUM OF
SIXTY THOUSAND PESOS AND MAKING THE SAME AVAILABLE OUT OF ANY FUNDS IN THE INSULAR
TREASURY NOT OTHERWISE APPROPRIATED FOR THE COST OF PLATES AND PRINTING OF POSTAGE
STAMPS WITH NEW DESIGNS, AND FOR OTHER PURPOSES.

Subsequently, the petitioner Mons. Aglipay prayed before the Court to issue a writ of
prohibition against the Director of Posts from issuing and selling Eucharistic Stamps. The petitioner
averred that the said act is unconstitutional

The Solicitor General, on the other hand averred that the said writ of prohibition is not proper legal
remedy of the petitioner.
