JUDICIAL AFFIDAVIT

I, Michaelo L. Florentino, Filipino, of legal age, single, and a

resident of #45 First Crumb, Digos City, after having been duly sworn in
accordance with law, do hereby depose and states that:

1. This Judicial Affidavit is executed to serve as my direct testimony in

the instant case;

2. This Judicial Affidavit is offered to prove:

(A) All the ANNEXES appended hereto, which are respectfully
requested to be correspondingly marked as EXHIBITS in this case;
and
(B) All matters related thereto, with reservation to present additional
exhibits in the course of the proceedings of the instant case.

3. I had given my answers on the questions below asked in the language

which I fully understand, stated with full consciousness and I did so
under oath, and that, I may face criminal liability for any false
testimony or perjury;

4. The Questions and Answers are detailed below.

A10 A taxi driver parked by near EMCOR Digos.

A11 The taxi driver disembarked from the taxicab and proceeded to my
location.

A12 He informed me that his male passenger is strangling his female
companion.

He further added that his passenger, who were with him since the
A13 early morning of that day refused to get off his vehicle and that
they haven’t paid.

I suggested that it is better for him to bring his passengers to the

A15 I moved towards the vehicle and peeped thru the window.

A16 I saw Pabalan and Abil at the passenger’s seat of the taxi.

What were Pabalan and Abil doing at the passenger’s seat Mr.

A17 I saw Pabalan’s left arm wrapped around the Abil’s shoulders.

You said earlier that when you peeped thru the taxi’s window,

A18 I saw Abil crying.

Abil told me that Pabalan was armed with a gun and that the latter

I never got the chance to react to her complaint because to our

surprise, Pabalan pulled out his gun.

A21 The taxi driver and I immediately ran and took cover.

A22 When I look back at the taxi’s location, I saw Pabalan transferred
to the driver’s seat and drove the cab away.

A23 After a few seconds or so, I saw Abil opened the left back door
and jumped out.

A24 I saw that her blouse got caught by the back door.

Q26 While the victim was being dragged by the taxicab, what
transpired next?
A26 Pabalan halted the car and I saw Abil fell to the ground.

A27 As Abil tried to get up, Pabalan aimed his gun at the back of Abil.

Q28 After Pabalan pointed the gun towards the back of Abil, what did
he do next?
A28 Pabalan fired at Abil twice.

Q29 After shooting the victim, what else happened?

A29 Pabalan fled on foot maam.

Q30 What course of action did you make after the incident, if any?

A30 I called for police assistance using my cell phone.
