CONTRACT FOR CREW SERVICES

KNOW ALL MEN BY THESE PRESENTS;

This CONTRACT made and executed this 1st day of June 2021, at Murcia by and between:

JU-AI EMPLOYMENT AGENCY, a corporation duly organized and existing under and by virtue of
the laws of the Republic of the Philippines with principal address at Lavaro Street, Barangay
Zone 2, Murcia Negros Occidental and duly represented herein by its Manager, Ms. Irene C.
Gravino, hereinafter referred to as the (“SECOND PARTY”)

AND

HIGHWAY 16 CAFÉ is a restaurant and resort with business address at Spur 16, Brgy. Bunga
Don Salvador Benedicto Negros Occidental and duly represented herein by Manager, Ms. Llyca
Marie Geraldoy , herein called as the " FIRST PARTY";

WITNESSETH THAT:

WHEREAS, the FIRST PARTY desires to engage the Second Party's services to serve and
accommodate customers in HIGHWAY 16 CAFE located at Spur 16, Brgy. Bunga Don Salvador
Benedicto Negros Occidental.

NOW, THEREFORE, in consideration, of the foregoing premises and of mutual covenants


and provisions hereinafter set forth and parties hereto have agreed, and do hereby mutually
agree as follows;

1. Place and Location: The SECOND PARTY shall provide a service crew to the FIRST PARTY at its
building and premises located at Spur 16, Brgy. Bunga Don Salvador Benedicto.

2. Function and Duties of Service Crew: The Service


Crew is responsible for presenting menus to patrons. Takes orders and answers questions on
meal items, makes recommendations and serves food/beverages to customers, prepares the
bill that itemizes total meal costs and sales taxes, performs cashiering duties and may also be
required to prepare the food.

3. Number of service crew: The Second Party shall initially provide the First Party with Fifteen
(15) service crew effective June 01, 2021. The crew shall provide services for a full period of
eight (8) hours of duty

The number of service crew may be increased at any time on the written request of the
First Party.
4. Qualifications of Crew: Each of the service crew assigned by the Second Party to the First
Party must be:

a) At least High School graduates;


b) Must be at least 16 years old and fluent in English
c) work nights, weekends, and holidays
d) Ability to stand for long hours at a time and work in a fast-paced environment
e) Positive attitude and commitment to customer satisfaction

5. Mode of Payment: For and in consideration of the foregoing services and during the
affectivity of this contract, the First Party shall pay the Second Party the amount of Nineteen
Thousand Two Hundred Eighty-Six Pesos and thirty-six centavos (P19,286.36) only inclusive of
12% VAT per service crew per month on the basis of eight (8) working hours a day.

The above consideration is payable every 30th of the month.

6. Supervision and Control: The Second Party shall exercise discipline supervision, control
administration over its service crew in accordance with law ordinances and pertinent
government rules and policies laid down by the First Party on the matter.

7. Equipment and Uniform: The Second Party shall provide all its service crew with the
necessary proper uniforms.

8. Liability to Service crew and Third Party: The Second Party is not an employee of the First
Party, and the service crew and their supervisor assigned by the Second Party to the First Party
are in no sense employees of the latter as they are for all intents and purposes the employees
of the Second Party. First Party be held to answer for wages, salaries, overtime, separation pay,
sick and vacation leave, social security payments, allowances and all other benefits required by
law to be paid and/or extended by employers in favor of their employees.

9. Liability for Loss, Damage, Injury, Etc.: the Second Party shall be responsible for any loss,
damage, injury to the property of the First Party except those which can be easily transported
or dispose of which cannot considered bulky as such but not limited to pocket calculators,
jewelries, and cash and/or to persons mentioned in paragraph.

10. Replacement of any service crew: The First Party changed and replaced service crew at any
time whose work performance it finds or believe to be below standard, or whose conduct is
unsatisfactory or is prejudicial to its interest, as determined by the First Party. The judgment of
the First Party on such matter shall be final and bonding.

11. Terms of Contract: This contract shall take effect on June 01, 2020 and shall be for a period
of THREE ( 3 ) YEARS, RENEWABLE depends to the decisions of the FIRST PARTY and maybe
terminated upon giving of sixty (60) days written notice by one party to another. All rights and
claims which have accrued as of the date and time of termination shall be respected.

In case of litigation arising from in connection with this contract, venue of action shall be in
Province of Murcia Negros Occidental and the amount equivalent to 25% of the amount
claimed shall be due and demandable as attorney’s fees.
IN WITNESS WHEREOF, the parties have hereunto set their hands at the place and on the date
first stated above.
