Most Respectfully Showeth:
1. That Plaintiff and Defendant were partners in the Firm namely_____ and
were engaged in the business activity of import-export and trade of
pulses and grains. The Partnership Deed dated ___ is annexed hereto.
2. The said Partnership was duly registered with the Registrar of Firms and
Societies on date ____ bearing Registration no. ___. The copy of
Registration Certificate is annexed hereto.
3. That as per the Partnership Deed dated ___ the Plaintiff and Defendant
shared profit in the ratio ___. The accounts of the Firm were maintained
on financial year basis and kept at registered office of the Firm.
4. That the business of the Firm was going well but for last 2 years the firm
has incurred heavy losses for the reason that Defendant has taken huge
loans in the name of the Firm. The said act of the Defendant is contrary
to the terms of Partnership Deed dated ___, as the loan has no relation
with the business activity of the Firm. Thus, if the business activity if
continued would only incur more losses and increase the liability of the
Firm.
5. Thus the Plaintiff seeks intervention of the Hon’ble Court to dissolve the
said firm as per clause ___ of Partnership Deed dated ___. That all the
accounts of the partnership have been agreed and understood by the
parties and all trading results, profits and losses and personal debit and
credit entries and balances, have been checked and accepted by them
as per the account books.
6. That the Plaintiff shall be liable for any taxes or payments raise against
the dissolved partnership only in accordance with his ratio of profits and
losses in terms of the partnership deed. That the Plaintiff shall not be
liable for any liability raised by the other in the name of the erstwhile
partnership firm. Further the Plaintiff shall not be liable to any third party
qua the loan transaction entered by the Defendant.
7. The cause of action to file the present suit arose on ___ when the
Defendant took loans. It arose on all the dates when the Firm suffered
from losses. The cause of action is still subsisting and continuing in
favour of the Plaintiff and against the Defendant.
8. The suit has been filed within the Limitation period.
9. The Hon’ble Court has both territorial and pecuniary jurisdiction to try
and entertain the present matter. The parties work and reside for gain
within the jurisdiction of the Hon’ble Court.
10. The fixed Court Fee of Rs. ____ has been affixed on the plaint.
11. The Plaintiff has not filed any other petition before any other Court or
Forum seeking similar relief.

Prayer:
In view the aforesaid facts and circumstances, it is, therefore, most
respectfully prayed that this Hon’ble court may kindly be pleased to:

1. That the deponent is the plaintiff in the above noted suit and is well
conversant with the facts and circumstances of the present suit and hence
