Abstract

The Digital Services Act regulation pursues to be the linchpin of platform regulation. Despite the
holistic nature of the regulation and its dominant international impact, the regulation raises numerous
questions and issues regarding freedom of expression. The key themes of the research are: (1) the
specifications regarding how the directive prescribes freedom of expression stipulations, (2) the
international freedom of expressions issues and polemics in connection with platform regulation, (3) the
problematic and questionable provisions outlined in the directive concerning platform regulation and
freedom of expression and (4) possible and feasible solution ideas to tackle the polemics introduced
under theme number (3). A new international regulation, the research aims to examine two critical
issues of uppermost relevance: how freedom of expression is regulated on online platforms and the
effectiveness of the regulation’s stipulations to serve as safeguards.
The hypothesis states that the Digital Services Act (henceforth: ’the DSA’) has fallen short of assessing
in-depth and in detail the online issues concerning freedom of expression (henceforth: ‘FoE’) on the
Internet. By online issues concerning FoE, I particularly imply the recurring digital polemics such as
fake news and disinformation, online hate speech and the lack of uniformity or harmonisation regarding
its regulation, cyberbullying, the usage as regards deepfake technology or filter bubbles. The DSA
attempted to create a safer and more transparent digital space where the fundamental rights of users are
protected. However, the stipulations, specifically those regarding VLOP/VLOSE, transparency of
recommendation systems, advertising and interface and risk assessment may result in vague
interpretation of the law and lack of norm clarity. Therefore, these stipulations can provide for
unharmonised, differentiating interpretations and supposedly contradictory FoE protection mechanisms
by platforms.

The specific aims of the research in accordance with the aforementioned key themes are to (a)
understand and interpret in depth the DSA stipulations in particular liaison with FoE and the objectives
and incentives of the DSA, (b) research the current mechanisms regarding FoE and its protection by
platforms, specifically very large online platforms (more specifically social media platforms), (c)
conduct thorough research and find the key issues with platforms’ conditions and propose amelioration
to the issues emerged from the above phenomenon and (d) research and propose possible solutions,
mechanisms and theories regarding the online issues concerning FoE mentioned above.
