JOINT AFFIDAVIT OF DESISTANCE

We, BENJAMIN BRYAN L. PASCUAL and ROGELIO B. YANGA, of legal ages, married, Filipinos,
and with office address at Clark Development Corporation, Building 2122, E. Quirino St., Clark
Freeport Zone, Philippines, subscribing under oath, depose and state:

1. We are among Private Complainants in Criminal Case No. 14-072, entitled, People of the
Philippines vs. Roldan Serrano y Gepule and Ruvielane Margarito y Serrano, for violation of
Article 329 of the Revised Penal Code, pending with the 6th Municipal Circuit Trial Court,
Mabalacat – Magalang Pampanga;

2. After several conferences between said Accused and Clark Development Corporation,
for whose behalf this case was filed, we hereby declare that the filing of the said case arose out
of pure misunderstanding and misapprehension of facts, which have recently been cleared;
 
3. Based on the clarification of the said misunderstanding and misapprehension of facts,
we hereby manifest that we are now withdrawing our complaint against both Accused, and that
we are no longer interested in the prosecution of the case against them;

4. We are executing this Affidavit of Desistance with the approval of the Clark
Development Corporation (CDC), its Board of Directors having approved the dismissal of the
case against both Accused during their Special Board Meeting on 09 September 2019, as shown
in the attached Secretary’s Certificate;

5. We hereby inform the City Prosecutor of Pampanga that we are withdrawing our
complaint for violation of Article 329 of the Revised Penal Code, in Criminal Case No. No. 14-
072 entitled " People of the Philippines vs. Roldan Serrano y Gepule and Ruvielane Margarito y
Serrano”, before 6th Municipal Circuit Trial Court, Mabalacat – Magalang Pampanga; and
 
        5. We likewise request the 6th Municipal Circuit Trial Court, Mabalacat – Magalang
Pampanga to dismiss the said criminal case.
