AFFIDAVIT OF DESISTANCE

I, ALBERTO DATANG MATINGKAL, 60 years old, married, a farmer and a resident of

Barangay New La Union, Maitum, Sarangani Province, after having been duly sworn to in
accordance with law, hereby depose and say THAT:

1. I am the Father of the late GILBERT MONGKIL MATINGKAL who was killed during an
encounter with one of the personnel of the 4 th Platoon Alpha Company Task Force
Bangis, 61D, PA led by 1LT Michael P. Jordan against CTGs under the command of
Arnold Laugo Amad a.k.a. “Commander Bam-Bam/Kempi Maguan”;

2. The incident transpired on August 11, 2022 at around 10:15 in the morning within the
mountainous boundary of Barangay Zion and Barangay New La Union, Maitum
Sarangani Province, wherein AFP troops conducted focused military operations and
wherein Two (2) of my sons Gilbert and Ronel Matingkal were present at that moment;

3. After much thought and contemplation, I have accepted the fact that the incident which
happened to my son GILBERT MONGKIL MATINGKAL was a legitimate operation of the
AFP troops and that the said incident was based on lawful and legal actions of the AFP
troops;

4. In view of the foregoing facts, I am expressly manifesting that I now completely and
absolutely exonerate the Operating Team of the 4 th Platoon Alpha Company Task Force
Bangis, 61D, PA from any criminal, civil and administrative liability in relation to the
above-mentioned incident;

5. I am no longer interested in criminally, civilly, and administratively prosecuting the case

and from testifying against the above-mentioned party in any court and/or any other
government entity or agency in connection to the above-mentioned incident;

6. I am voluntarily executing this affidavit of my own free will and volition without being
forced, coerced, intimidated, nor promised of a reward whatsoever;

7. The foregoing statements have been fully read by me and/or translated to me in the
dialect which I speak and understand and are true and correct to the best of my
personal knowledge and ability.
