Problem statement

There is breakdown in wage negotiations between the company and a

trade union that resulted in violent industrial action that caused major
damage to company property
Case summary
a company in the fruit industry in South Africa in 2015 a violent strike
erupted after failed wage negotiations. It laid bare deep divisions between
African and non-African employees and between permanent employees
and those appointed as temporary employees only. It also revealed the
mindsets of people on both sides of the conflict, as well as several errors
made by management in the manner in which they viewed the role of the
union and failed to build strong relations with employees on the shop
floor.
Analysis:
The "no-work/no-pay" policy had cost the workers over two months'
worth of wages.Trade unions in South Africa often do not have
significant strike funding for this purpose, however the union may have
been able to offer some support to them throughout the strike. Support is
thus restricted to providing for the needs exclusively. Several employees
also were hurt as they ran into the cops. Several persons were detained for
acts of public violence and property destruction, and several of them were
fired as a result.

Later through the events, the firm sent the union its final electronic letter
in which it suggested trying again at mediation. It then decided to send
the case to the Commission for Conciliation, Mediation and Arbitration
(CCMA), the nation's main statutory dispute resolution authority for
employment-related disputes, for mediation.
Jones contacted the union's headquarters and asked that it send skilled
negotiators to the mediation given the company's expertise negotiating
with the new union official. To his relief, the union agreed to the request
and delegated two of its top representatives from the headquarters to take
part in the proceedings. The CCMA granted the company's request for
one of its most seasoned mediators to be made accessible.

Financial setbacks, such as the cost of increased security, missed orders,
and productivity losses still needed to be determined.

Decision:
To reach a collective agreement that governs the terms and conditions of
employment is the goal of these discussions. The rights and obligations of
the parties may also be covered by collective agreements, promoting
harmonious and effective workplaces and industries. A crucial strategy
for lowering inequality and boosting labour protection is to make
collective bargaining and agreements more inclusive.
