Republic of the Philippines Department of Transportation LAND TRANSPORTATION FRANCHISING & REGULATORY BOARD East Avenue, Quezon City MEMORANDUM CIRCULAR NO. _ 2022-070 SUBJECT: MAXIMUM NUMBER OF STANDING PASSENGERS INSIDE PUBLIC UTILITY BUSES (PUBS) AND MODERN PUBLIC UTILITY JEEPNEYS (MPUJS) IN AREAS PLACED UNDER ALERT LEVEL 1 WHEREAS, the Board issued Memorandum Circular No. 2022-028 prescribing the applicable passenger capacity in the National Capital Region (NCR) and other areas placed under Alert level 1 at One Hundred Percent (100%)/Full Seating Capacity; WHEREAS, after reopening the economy and the opening of face-to-face classes, monitoring reports show a significant increase in passenger demand for public utility vehicles; WHEREAS, the increase in the number of commuters and the surge of passengers during peak/rush hours have prompted the Board to consider ways to address existing passenger demand; WHEREAS, in a Memorandum (Re: Maximizing the PUV Capacity Through Allowing Standing Passengers in to Ensure Sufficiency of Public Transport Supply), the Department of Transportation (DOT?) directed the LTFRB to issue a policy allowing standing passengers in the PUBs, mini-buses, and modem public utility jeepneys (MPUJs-Class 2); NOW, THEREFORE, for and in consideration of the foregoing, the Board hereby allows Standing Passengers inside Public Utility Buses and Modem Public Utility Jeepneys in areas placed under Alert Level 1, to wit: a. For Low Entry/Low Floor PUBs, only a maximum of Fifteen (15) Standing Passengers are allowed, at least one person apart; b. For Coach-type PUBs, only 2 maximum of Ten (10) Standing Passengers are allowed, at least one person apart; ¢. For MPUJs-Class 2, only a maximum of Five (8) Standing Passengers are allowed, at least one person apart. Imposed existing policies on minimum public health protocols inside PUVs shall be strictly observed at all times. Failure to comply with this MC shall be considered as a violation of the terms and conditions of their CPC, and appropriate penalties shall be imposed against the operator under the provisions of Joint Administrative Order No. 2014-01 All other issuances inconsistent herewith are deemed modified or superseded accordingly MC No. 2022, This Memorandum Circular shall take effect immediately following its publication in at least one (1) newspaper of general circulation.
