ACTIVITY 5

1. If a worker has a working day that consist in 8 hours established in his


employment contract but, nevertheless, the collective agreement of application
establishes a maximum work day of 7 hours, how many hours should the worker
work? By virtue of what principle? Explain your answer.

2. A company proposes a salary increase to a worker in exchange for only taking one
day of rest instead of two that were originally designated to him. The worker agrees
to this change. Is this agreement legal? Explain your answer.

3. A worker signed his employment contract three years ago. In this contract, it was
established in this one that the company would pay him an extra payment for
transport. A new collective agreement applicable to this sector is currently being
negotiated, and rumor has it that the right to this transport bonus will no longer exist.
Indicate whether this worker would retain the right to receive this amount and
according to what principle.

4. A female employee with two children born in a multiple birth (twins), asked her
company to enjoy double lactation right. The company denied her petition. The
employee went to the Social Court. Taking into account that the law does not provide
anything about this situation (double lactation), will she be entitled to one or two
hours of breastfeeding? By virtue of what principle? Explain your answer.

5. Make a short outline of the bodies of application of labour norm and of the Labour
Inspectorate.
