ADMISSIBLE PETITION Pursuant to Section 149 of the Constitution, Standing Order 195 and Appendix E of the Standing Orders of the National Assembly, the Petition hereto annexed has been examined for compliance with the rules of procedure and has been found to be admissible. Petitioner (s) Details: Centre for Natural Resource Governance represented by Trust Maanda; Contact Details: 0715387417 or 0718365892 Petitioner's Grievane : The petitioners’ are aggrieved that;- a) a serious environmental crisis is unfolding in Penhalonga as a result of artisanal mining; b) environmental impact assessment was never done for the on the new model of mining introduced by Better Brands Mining Company in Penhalonga; ©) the artisanal mining is not being supervised by experienced mining engineers and other technical experts thereby leading to increased mining shaft accidents and at least five people are dying in these shafts every month; ) the surge in the number of artisanal miners has led to an increase in violence and is threatening the general peace of the Penhalonga residents. Petitioner(s) prayers : The petitioners beseech Parliament to exercise it oversight function by:- a) making an inquiry as to whether EMA is properly executing its mandate of monitoring environmental management and compliance with regulations by the Redwing Mine, ) inquire into the agreement between Redwing Mine and Better Brands in order to establish NS Rouge -AC Mesecu * oR Mi ean Lames Sleclunt releelez \ if the produced is being declared to Fidelity Gold Refiners; ©) inquire into and determine the sustainability of the mining model and operations at the Redwing Mine in view of the impact it is having on the environmental and the community; 4) ensuring that environmental damage caused by mining activities at Redwing Mine is mitigated; ©) ensuring that the gold produced at Redwing Mine contributes to socio-economic development of Zimbabwe? Farai Maguwu (Executive Director) Respectfully show that your Petitioners: Work to promote transparency in the extraction of minerals and other natural resources and revenue collection so that minerals and natural resources are not used to fuel armed or other conflict Work to advocate for minerals to be used to benefit and develop communities and the country. RECOGNISING that the Constitution of Zimbabwe mandates Parliament of Zimbabwe to make laws, carry out executive oversight and discharge a representative role, as well as protect the Constitution and democratic governance in Zimbabwe. COGNISANT that Section 59 of the Constitution of Zimbabwe grants every person the right to present petitions. CONSCIOUS that section 149(1) gives every citizen and permanent resident of Zimbabwe the right to pet n Parliament to consider any matter within its authority. NOW, THEREFORE, your petitioners wish to bring it to the attention of the August House that: Section 3(1)(a) of the Administrative Justice Act entrusts administrative authorities with the “responsibility or power to take any administrative action which may affect the rights, interests or legitimate expectations of any person.” The Ministry of Mines and Mining Development; Ministry of Environment, Tourism and Hospitality and the Environmental Management Agency are in their various capacities, administrative authorities charged with monitoring and evaluating the implementation of mining development policies; regulating the management of the environment and promoting, coordinating and monitoring the protection of the environment and the vi vii vill xii, xii, xiv. Xvi. control of pollution and to regulate the activities of all government agencies and other agencies in terms of their impact on the environment respectively. Redwing Mine is a legal entity which is licensed by the Ministry of Mines and Mining Development to extract gold in Penhalonga, Manicaland Province. The mine has between 1966 and 2004 produced 1.1 million ounces of gold. ‘As at December 2016, according to Mineral Reserve Statement, Redwing Mine had a mineral resource of 2.5 million ounces of gold and mine life of 20 years. In July 2020, Redwing Mine was placed under Corporate Care and Maintenance with Dr Cecil Madondo appointed as Corporate Rescue Manager. In December 2020, Dr Madondo signed a Tribute Agreement with Better Brands (Pvt) Limited, ceding mining rights to the company. Following the Tribute Agreement, Better Brands moved into Redwing Mine as the new miner and is supposed to remit 20% of gold production share to Redwing Mine. Better Brands set up a milling plant at Redwing Mine and subcontracted several sponsors ‘to engage artisanal miners. Over 1000 tributary claims have been distributed to sponsors for artisanal mining, thus turning Redwing Mine into an artisanal gold mining field. ‘An Environmental Impact Assessment was never done for the new model of mining introduced by Better Brands and subsequently no environmental management plan place to mitigate environmental damage. Better Brands entered into an unwritten production sharing agreement with sponsors and artisanal miners. Better Brands offers gold milling and buying services to the sponsors and artisanal miners. Inturn, the sponsors and artisanal miners get paid an amount equivalent 0.40% of the gold they produce. Unprocessed sands accumulated from milling are transported to Chegutu for leaching and the gold recovered is not declared to Redwing Mine. The model of mining employed by Better Brands is against responsible mi the whole gold mining supply chain. A serious environmental crisis is unfolding in Penhalonga as a result of artisanal mining. Artisanal mining is not supervised by experienced mining engineers and other technical experts. This has led to increased mine shaft accidents, and at least 5 people are dying in these shafts every month. Most of the fatalities go unreported The surge in the number of artisanal miners has led to an increase in violence and is threatening the general peace of residents in Penhalonga. In October 2021 there were violent clashes between BetterBrands miners and the Penhalonga residents. tenets in WHEREFORE your petitioners beseech the Parliament of Zimbabwe to exercise its constitutional role and address the following issues of public concern: 1. Exercise oversight role, as enunciated in Section 119 of the Constitution of Zimbabwe and hold the Ministry of Mines and Mining Development; Ministry of Environment Tourism and Hospitality; and the Environmental Management Agency accountable and ensure the operations at Redwing Mine comply with Mining and Environmental Management statutes. 2. To determine whether EMA is properly executing its mandate of monitoring environmental management and compliance with regulations at Redwing Mine. Inquire into the agreement between Redwing Mine and Better Brands and establish if all the gold produced, including from leaching, is being declared to Redwing Mine and Fidelity Gold Refiners; and 4, Generally to inquire into, and determine the sustainability of the mining model and operations at the mine in view of the impact it is having on the environment and the community. PETITIONER'S PLEA AND PRAYER: ‘The petitioners beseech the Parliament of Zimbabwe to protect the constitution and the rights of the people of Zimbabwe by ensuring gold produced at Redwing Mine contributes to socio- economic development of Zimbabwe and also that environmental damage caused by mining activities at Redwing Mine is mitigated. WHEREFORE, we pray that your Honourable House will be pleased to take their case into favourable consideration, and grant any other such relief as it may deem fit.
