This Authorization will be operative as per the provisions of the Foreign Trade Policy 2015-20 and the Handbook of Procedures 2015-20 or as per any other law/provisions for the time being in force. 2. The issuance of the Authorization shall be subject to the conditions/parameters as laid down in Chapter 5 of the Foreign Trade Policy 2015-20 and the Handbook of Procedures 2015-20. (@) Capital Goods as defined in Para 9.08 (read with Para 5.01) of the Foreign Trade Policy 2015-20 only shall be allowed for imports/domestic procurement against this Authorization. (b)Import/procurement of second hand Capital Goods are not allowed under EPCG Authorization 4, (a) This Authorization shal be utilized in accordance withthe provisions ofthe Foreign Trade Policy 2015-20 and the concerned Customs Notification No 16/2015 -Customs dated: 01/04/2015 .(b) ‘Authorization Holder shall execute BG/LUT with Customs Authority, as per the procedure prescribed by them before effecting imports. However, for domestic procurement of capital goods, BG/LUT shall be executed with the concemed Regional Authority in the manner specified in Paragraph 2.35 of the Foreign Trade Policy 2015-2020 ‘5. Imporv/Procurement of Capital Goods under this Authorization shall be subject to Actual User Condition till Export Obligation is completed and Export Obligation Discharge Certificate (EODC) granted by the Regional Authority 6. This Authorization hes been issued under Chapter 5 ofthe Foreign Trade Policy 2015-20 and carries an Export Obligation to make physical exports to GCA countries or to render services (as defined in Para 9.51 of FTP), as the case may be, and realize the export proceeds in freely convertible currency. Deemed exports as specified under Para-7.02 (a), (b), (¢), (f) and (h) of Foreign Trade Policy is also allowed. 7. Authorization Holder shall have to fulfil Export Obligation as per Para 5.04 of the Foreign Trade Policy 2015-2020 read with Para 5.10 of the Handbook of Procedures 2015-20 8. Authorization Holder shall be under obligation to expor items as per details mentioned in this ‘Authorization, The Export Obligation shal be 6 times of the duty saved on import of Capital Goods on FOB basis within a period of 6 years (Block Years: Ist to 4th year (Ist Block) - 50% and Sth to 6th year (2nd Block)- 50%) and shall be reckoned from the date of issue of this Authorization 9, Authorization Holder shall also be required to maintain the past average level of exports [echieved by the EPCG applicant in the preceding three licensing years] for the same and similar products, as endorsed on this Authorization for the entire export obligation period, including extended period, if any. This annual average Export Obligation is in addition to the FOB value of exports mentioned in Para 8 above. 10. BO shall be fulfilled by the authorization holder through export of goods which are manufactured by him or his supporting manufacturer / services rendered by him, for which the EPCG authorization has been granted, 11. Authorization Holder may discharge the export obligation by way of direct exports as well as through third party exports. Exports to SEZ units‘Supplies to developers/co-developers imespective of currency of realisation would also be counted for discharge of Export Obligation, Deemed exports as specified under Para 7.02 (a), (b) (),(f) and (h) of the Foreign Trade Policy 2015-2020 shall also be counted towards, fulfilment of Export Obligation 12, Authorization Holder shall mention this EPCG Authorization number and date on all export documents of shipments for consideration of exports towards EO fulfilment of the EPCG Authorization. In case, the ‘Authorization Holder has supporting manufacturer(s), the name ofthe supporting manufacturer(s) shall also be indicated in Shipping Bills 13. In the event of third party exports, name of the third party exporter, name of EPCG Authorization holder and supporting manufscturer, if any, number and date of EPCG Authorization shall also be indicated in the Shipping Bills. In such cases, the Authorization Holder shall also submit the additional documents prescribed in Para 5.10(d) of the Handbook of Procedures 2015-2020 atthe time of final redemption to the Regional Authority |. Export proceeds to be realized agsinst exports made against this Authorization shall be in freely convertible currency except for deemed exports supplies made under Chapter 7 of the Foreign Trade Policy 2015-2020. Realization in case of supplies to SBZ units shall be from foreign currency account of the SEZ unit (@)The Capital Goods are to be installed atthe factory/premises of the Authorization Holder or his, supporting manufacturer(s) as endorsed on this EPCG Authorization. (b) Authorization Holder shall be permitted to shift Capital Goods during the entire export obligation period to other units mentioned in the TEC and RCMC of the Authorization Holder subject to production of afresh Installation Certificate to the Regional Authority concemed within six months of the shifting. (c) In case of any change in supporting manufacturer (3), the name of supporting manufecturer(s) shall be endorsed on the EPCG Authorization before instalation of the capital goods in the factory /premises of the supporting manufacturers). Authorization Holder shall submit an Installation Certificate either from the jurisdictional Customs authority or an independent Chartered Engineer, to the Regional Authority, within 6 months from the date ‘of completion of imports/domestic procurement. Where the Authorization Holder opts for independent Chartered Engineera€™s certificate, it shall send a copy ofthe certificate to the jurisdictional Customs Authority for intimation/record In case of import of Spares, the Installation Certificate shall be submitted by the Authorization holder within a period of 3 years fromthe date of import/domestic procurement (Para 5.04 (b) of the Handbook of Procedures 2015-20). At the time of final redemption of Export Obligation, the Authorization Holder shall submit a certificate from independent Chartered Engineer confirming the use of capital goods covered under subparagraphs (a) (ii) & (iv) of Para 5.01 of FTP on the basis of stock and consumption register maintained by the Authorization holder [Para 5.0.6 (c) of the Handbook of Procedures 2015-2020]. ‘The Authorization holder would also intimate the Regional Authority concemed on the fulfilment of the ‘export obligation, as well as average exports, within three months of completion of each block as per Para 5.14 of the Handbook of Procedures 2015-2020. Where EO of the frst block is not fulfilled as per Para 5.14 of the Handbook of Procedures 2015-2020, the Authorization holder shall, within 3 months from the expiry of the block, pay duties of customs (along with applicable interest as notified by DOR) proportionate to duty saved amount on total unfulfilled EO of the first block Authorization Holder shall deliver or cause to deliver to the Authorization issuing Office, within 2 months from the date of expiry of the Export Obligation period stated above, documents as prescribed under Paragraph 5.22 of the Handbook of Procedures 2015-2020, as amended, from time to time, as evidence of fulfilment of Export Obligation imposed on this Authorization. Incase of bonafide default, provisions of | Paragraph 5.23 of the Handbook of Procedurs 2015-2020 as amended, from time to time, shall apply. Failure to fulfil the Export Obligation in the manner as prescribed or any other condition of the Authorization shall be subject for action under Foreign Trade (Development & Regulation) Act, 1992 as amended, Orders and Rules made thereunder, provisions of Foreign Trade Policy/ Handbook of Procedures, Customs Act, 1962, as amended from time to time or any other law in force Every EPCG Authorization Holder shall maintain, for a period of 2 years from date of redemption, a true and proper account of exports! supplies made and services rendered towards fulfilment of export obligation.
