Republic Act No. 7438 “An Act Defining Certain Rights of Person Arrested, Detained or Under Custodial Investigation As Well As The Duties Of The Arresting, Detaining and Investigating Officers, and Providing Penalties for Violations Thereof” dated April 27, 1992. b. BIMP Comprehensive Operations Manual 2015 Edition. c. BJMP Memorandum with subject Revised Policy on Visitation in BIMP- manned Jails dated March 2, 2010. d. BJMP Memorandum with subject Supplemental Guidelines to the Revised Policy on Visitation in BIMP-manned Jails dated March 2, 2010 dated May 30, 2011. €. BUMP COVID-19 Advisory #63 with subject Nationwide Lifting of Jail Lockdown dated November 7, 2022. 2. It is provided in BIMP COVID-19 Advisory #63 that upon the lifting of jail lockdown, “No Contact Visitation” shall still be strictly observed. This is because COVID-19 is a lingering threat and the pandemic is not over yet. It remains a public health emergency of international concern according to the World Health Organization. 3. Nevertheless, there is a need to consider the welfare and mental health of our PDL. Since March 20, 2020, when the absolute lockdown of BJMP-manned jails nationwide was implemented, in-person/contact visitation by the immediate family of POL was suspended. During the easing of jail lockdown, jail visit was allowed but was limited to “no contact visitation” wherein the visitor and PDL meet face-to-face or in- Person but are separated by a physical barrier. However, sentiments amongst PDL convey that joy and happiness of being able to hold and touch their visitors are irreplaceable. 4, In this connection, whenever the community risk level classification is low in the locality where the jail facility is situated, considering further the welfare and mental health of PDL, in-person/contact visits by the PDL’s immediate family may be Page 1of 5 “Changing Lives, Building a Safer Nation” allowed as part of the Strategies for Everyday Operations. Provided, however, the following guidelines and requirements be complied with and observed: a. Schedule of Visitation: Tuesday, 1:00 PM — 5:00 PM VISITATION DAYS | Wednesday, and ‘Thursday | ‘Saturday and Sunday | 08:00 AM — 1200 NN 1:00 PM - 5:00 PM Reserved for) POLS washday and for the NON-VISITATION | Monday and Friday | sanitation/cleanliness DAYS of the entire jail facility. | Immediate Family Member -refers to a spouse, fiancé ot flancée, parent or child, brother or sister, grandparent or grandchild, uncle or aunt, nephew or niece, and guardian or ward. | | b. Visitation Area: 1. The jail warden should designate a well-ventilated visitation area. Only jail facilities, with at least 85% of its personnel and PDL are fully-vaccinated against COVID-19, shall implement in- person/contact visitation; 2. The jail warden shall designate a team of jail personne! to monitor and ensure that minimum public health standards including, but not limited to, the wearing of physical distancing, frequent disinfection of hands and regularly touched sonics, ed rca un onl arent oe a property the visitation area; 2. All visitors shall wear a well-fitted face mask upon entry and the whole time spent in the visitation area. No face mask, No entry shall be implemented. Mask shall only be removed when eating while in the visitation area. 5. Visitors must be fully vaccinated, preferably with a booster shot against COVID-19, and proof of this must be prior to jail entry. In the event that visitors are not vaccinated, may enter the jail facility as long as they can show proof that they tested negative for COVID-19 through RT-PCR and/or Antigen taken within seventy-two (72) hours or twenty-four (24) lis respectively, upon entry. If they prefer not to be COVID-19 test or if they have no proof of vaccit oe modes of visitation may be availed; 6. Infection Prevention and Control measures shall be implemented in the visitation area; 7. The jail facility through the warden shall provide I-based hand sanitizer with at least 70% alcohol in visitor sy exits, and waiting areas in addition to a functioning well Maintained handwashing area; and 8. If the violation is committed by PDL, they| shall be subjected to appropriate disciplinary proceedings; 5. There shall be designated personnel assigned in the visiting area to monitor the situation and supervise the activities thereat. Every visitor shall the following procedures: 1, PDL’s immediate famity members shall be allowed to visit and avail of the Contact Visitation provided their names have been Included in the Approved Visitor's List and they have scheduled their visit per para 4 d(1). Approved Visitor's List- a list found in the Inmate Monitoring System (NIMS) and PDL Single system containing the names of persons allowed to visit a PDL in jail. 2. All visitors must present thelr valid Identification card and vaccination card, if needed, upon entry. The personne! in charge at the gate shall then inspect and verify the visitor's identification and vaccination card (e.g. Approved Visitor's List, the validity of D., and proof of relationship with PDL to be visited); | ‘After the personne! in charge is satisfied with the of the visitors’ Identification and vaccination cards, the shall then be informed that they must abide by the jall rules and regulations during their stay inside the jail facility. The visitors w shall further be informed that they must submit fori of their person and belongings as a condition for entry inside the jail facility; > If the visitors agree to the above conditions, they shal} then be made to register In the Visitor's Logbook or submit to visitors’ biometrics. Otherwise, they shall not be allowed entry Inside the fall facility; After registering in the Visitor’s Logbook, the visitors shall then be requested to submit their belongings for inspection. The visitors shall, likewise, be requested to undergo pat and frisk or strip search, as may be appropriate pursuant to policy; 6. Yellow or dominant yellow-colored upper garment, (sando etc.), see-through, or other revealing clothes, as well as upper garments with lewd or lascivious print/mark, both for men and women, shall be considered as improper attire for visitors and shall not be allowed entry in the jail; y covered by valid Mission Order/Letter Order shall be deposited with the Gate Security Personnel; 8. After successfully undergoing inspection and being | stamped marked, all visitors must then be made to proceed to the visitation area; 9. Further, be reminded that the counsel on record of the PDL, physician, priest or religious minister chosen by him/her or by any member of his/her immediate family or by his/her counsel, any national non-governmental organization duly accredited by the Commission on Human Rights (CHR) or any international non-governmental ‘organization duly accredited by the Office of the President is allowed to have an in- erson/contact visitation with the PDL at any day, per RA 7438. 6. Other modes of visitation may be implemented at the same time to maximize visitation, when possible, or when contact or face-to-face visitation can not be implemented due to heightened community risk level, security, or other analogous circumstances. 7. Dry run shall be conducted for a week prior to the implementation of these supplemental guidelines. Moreover, you are hereby reminded to update the PDL's Visitors List in the NIMS and PDL Single Carpeta System. 9.
