For the Structural (GFC) drawings for raft foundation of office building work remained held up from 11.10.2019 to 31.12.2019. ‘Comments of Division office: The hindrance register describes that though the physical possession of the site was made available to the contractor on the date of commencement i.e. 11.10.2019 but the GFC drawings were transmitted to contractor on 31.12.2019. However, during the intervening period contractor has been allowed to take up excavation of raft foundation up to a depth of 2.00 meter, accordingly a part activity of excavation has been carried out at site for which 4 partial hindrance @95% has been allowed. Therefore the net hindrance for non availability of structural drawing works out from 11.10.2019 to 31.12.2019 = 81*0.95= 77 days and same is recommended to allow, Hindrance no. 2. For the Structural (GFC) drawings for raft foundation of residential quarters work remained held up from 31.12.2019 to 15.01.2020. ‘Comments of Division office: The structural drawing of residential quarters was made available to the contractor on 15.01.2020. Therefore, the net hindrance for non availability of structural drawing works out from 31.12.2019 to 15.01.2020 = 15 days and same is recommended to allow. Hindrance no. 3. Work to be stopped as a safety measure during COVID-19 epidemic. (From 25.03.2020 to 26.06.2020) ‘Comments of Division office: ‘The hindrance register describes that during start of first lockdown the work has to be stopped from 25.3.2020 to 14.4.2020 and 15.4.2020 to 3.5.2020( second lockdown) and 4.5.2020 to 17.5.2020 ( third lockdown) and finally 18.5.2020 to 31.5.2020 ( fourth lockdown ). During this period contractor has not able to work at site due to COVID 19 epidemic from 25.03.2020 to 30.05.2020 fully = 68 days. Partial hindrance from 01.06.2020 to 26.06.2020, when local labours were engaged at site therefore a weightage of 95% is allowed in this period, as such the net hindrance worksout to 0.95X26= 25 days. The total hindrance works out to 68 + 25 days = 93 days. No 18/4/2020-PPD dated 19" February, 2020 on the invocation of Force Majeure Clause (FMC). Vide the O. M., it was clarified that disruption of supply chains due to sprdad of Coronavirus will be covered under FMC Which could be invoked, wherever considered appropriate, following the due procedure as stated in para 9.77. of the Manual on Procurement of Goods z Subsequent to issuance of the above referred OM. further disruptions have affected transportation, manufacturing and distribution of goods and services in the country. Limitations placed on the movement of men and material as per the guidelines issued by the Ministry of Home ‘Affairs (MHA) under the Disaster Management Act, 2005 (DM Act 2005) and the respective State and UT governments from time to time have severely impaired the fulflméht of contractual obligations for supply of goods, works and consultancy services (including other services) and affected the volume of vehicular traffic. 3. Attention in this regard is invited to para 9.7.7 of the “Manual for Procurement of Goods 2017", Para 6.4.2 of the “Manual for Procurement of Works 2019" and para 8.14.1 ‘of the “Manual for Procurement of Consultancy and other Services 2017" issued by the Department of Expenditure The above referred three Manuals recognize extraordinary events or circumstances beyond human control leading to delays in or nomfulfilment of contractual obligations. In a situation of such events happening, and after following due procedure, parties to the contract are allowed flexibility to invoke FMC following prescribed due procedure 4 It is recognised that in view of the restrictions placed on the movement of goods, services and manpower on account of the lockdown situation prevailing overseas and in the country in terms of the guidelines issued by the MHA under the DM Act 2005 and the respective State and UT Governments, it may not be possible for the parties to the contract to fulfil contractual obligations . In respect of Public-private Partnership (PPP) concession contracts, a period of the contract may have become unremunerative.
