Abstract

This paper is structured in accordance with the Stakeholders training organized to


educate miners, developmental project proponent, Site managers, and
Operational managers on the importance and how to gain the stakeholder
permission to operate for a big and complicated project filled with details and
techniques that has been applied to ensure successful relationship between
stakeholders in Nigeria for several mines. The paper is based on the effective
principles and standards required by International Financial Cooperation (IFC)
and other lenders.

Engagement

The process of an ESMP especially the ESRIA, ESIA or EIA is to provide and
identify all risk and potential impact In the technical, environmental and social
aspect of the project that will prevent it's from attaining project goals, in
controlling the social risk and impacts communication, participation and
interaction is key to obtaining Social Stakeholders approval or permission to
Operate, this is as all project is going to have impacts and level of impact to which
stakeholders are willing to accept in their different area of Influence AOI vary for
individual stakeholders, which results in them to seeking the issuance of permits
delaying/ pausing or stopping work, observe sit-in or protest, destroy property or
become violent.
The stakeholders of a project will vary depending on the details of the project.
They may include local communities, national and local authorities, neighboring
projects, and nongovernmental organizations, “stakeholder” refers to individuals or
groups who are affected or likely to be affected by the project (project-affected
parties); and may have an interest in the project (other interested parties).
The process of stakeholder engagement should involve the following,
(i) stakeholder identification and analysis; (ii) planning how the engagement with
stakeholders will take place; (iii) disclosure of information; (iv) consultation with
stakeholders; (v) addressing and responding to grievances; and (vi) reporting to
stakeholders
This paper aims to explain how Stakeholders' approval can be gotten for big and
complicated projects, through in-depth provision and dissection into the concept/
positions of stakeholders and the importance of Stakeholders' permission to operate.

One of the key goals of the interaction during the EIA process is compiling the
views of different parties. The legislation, and often financiers, demands a social
impact assessment to be performed for projects with a focus on active, high-quality
interaction with stakeholders resulting in an agreement and approval of the project
by the surrounding society and concerned parties.
The concept of Stakeholders Permission to operate is raised both in the idea of the
official license to operate and an unofficial permission from community, NGOs,
community groups, landowners etc as opposed to only official permissions given
after the EIA process, which in many controversial cases may fail to win the hearts
of affected communities and parties and therefore generate resistance.
The social license to operate:
Permission/ acceptances of host, concerned or impacted persons and project
interested persons will guarantee the following benefits ; (i) Reduce potentiality of
Violence; (ii) Reduce the appeals in the permit processes; (iii)Speeds up approval
and production rate as it reduces any opposition to other permits required by the
project;
How to gain the stakeholder permission to operate for a big and complicated
project, such as a mine site or large industry? The core elements are
communication, participation, and interaction.
Communication of the project must be: (i) Begin early in the project planning
process to gather initial views on the project proposal and inform project design;
(ii)Encourages stakeholder feedback, particularly as a way of informing project
design and engagement by stakeholders in the identification and mitigation of
environmental and social risks and impacts- If people can participate and voice
their opinions only after the fundamental decisions have already been made, they
may end up feeling left ‘outside’ and uninformed. However, the possible number
of project alternatives and the right timing for starting the participation and
interaction depends on the nature of the project; (iii)Continues on an ongoing basis,
as risks and impacts arise; (iv) Is based on the prior disclosure and dissemination
of relevant, transparent, objective, meaningful and easily accessible information in
a timeframe that enables meaningful consultations with stakeholders in a culturally
appropriate format, in relevant local language(s) and is understandable to
stakeholders; (v) Considers and responds to feedback; (vi) Supports active and
inclusive engagement with project-affected parties; (vii) Is free of external
manipulation, interference, coercion, discrimination, and intimidation; and (viii) Is
documented and disclosed by the Borrower.

Participation of the stakeholders must include: (i)Project owners; (ii) project


contractors engineers and planners/designers; (iii) Host community leaders, groups,
(iv) Non- Governmental Organizations; (iv) government agencies ministry of
mines, ministry of environment, ministry of lands, etc. (v)
Interaction with stakeholders must include different channels for participation
and interaction. four major channels for successful stakeholders interaction are (i)
Informative websites; (ii) Open, informal monthly events as well as formal public
events related to the EIA/ESIA/ESRIA process; (iii) Web-based participation
applications and/or resident surveys and an opportunity to participate also without
a mobile device; (iv) Thematic workshops.

Conclusion
While all the processes are advised, the degree of use should vary per project type,
level of impact, Location/ host country, stakeholders interest, local legislation and
