We have caused necessary searches to be taken with the revenue and sub registry records. We have taken root of title commencing from about 1980, prior to more than thirty five years from now. Our Updated Report on Title is as stated hereafter. For detailed facts and particulars, references may be taken from the documents, papers, writings and records referred to hereinbelow. A. REORGANISATION OF VILLAGE BOUNDARIES, 1. The said lands were formerly within the village boundary of Vejalpur (sim). However, on reorganisation of village boundaries the same are included and forms part of revenue village Jodhpur as per details given above. DEVOLUTION OF TITLE: Originally the lands of Survey No. 546/2, Survey No. 92/1 and Survey No, 92/2 were registered in the name of one Chhagantal alias Chhaganbhai Bhikhabhai, (Reference : Revenue Entry No. 136, dated 8" February, 1956). It was ancestral land. The name of his brother Ishwarbhai Bhikhabhai was joined with him. (Ref. Revenue Entry No. 1343, dated 24" May, 1966). An oral partition Was effected between they two for the said lands and their other jeint lands. On such partition the said lands came to the share of (a) Survey No. 5462 and Survey No. 92/1 to Chhaganbhai Bhikhabhai, and (b) Survey No. 92/2 to Ishwarhai Bhikhabhai, (Reference : Revenue Entry No. 2055, dated 11" January, 1971), SURVEY NO. 546/2 and Survey No, 92/I Said Chhaganbhai Bhikhabhai died on 13" December, 1976 and the names of Surajben Chhaganbhai Patel (wife), Ratibhai Chhaganbhai Patel, Manilal Chhaganbhai Patel, Parshottam Chhaganbhai Patel, Surendrakumar Chhaganbhai Patel (all sons), Kashiben Chhaganbhai Patel, Kantaben Chhaganbhai Patel, Shantaben Chhaganbhai Patel, Somiben Chhaganbhai Patel, 4@) ) © DESAI & CO ADVOCATES & SOLICITORS sea Savitaben Chhaganbhai Patel, Ms. (then minor) Bhagwatiben Patel (all daughters) were entered in the revenue records. (Reference : Revenue Entry No. 4265, dated 29" November, 1980), OBSERVATION, @ The said entry and event of release recorded therein is of prior to about more than thirty five years. We have not received any claim in response to public notice from them or any of them, or any person to claim under them, Remaining following co-owners continued to be the joint holder, Ratibhai Chhaganbhai Patel, Manilal Chhaganbhai Patel, Parshottam Chhaganbhai Patel and Surendrakumar Chhaganbhai Patel RATIBHAI CHHAGANBHAI PATEL. He died on 2" February, 2009 and the names of: Kailashben Ratibhai Patel, Rakeshbhai Ratibhai Patel, Alkaben Ratibhai Patel and Gunvant Ratibhai Patel were entered in the revenue record. Alkaben Ratibhai Patel released her share on the basis of affidavit of release made by her dated 24" November, 2011 and her name was deleted from the record of rights. (Reference : Revenue Entry No. 2031, dated 3" March, 201 1). Such release is confirmed by her by a Deed of Release dated 27" October, 2020 registered under No. 9819. Accordingly, branch of Late Ratibhai Chhaganbhai Patel is represented by Kailashben Ratilal Patel, Rakeshbhai Ratilal Patel and - Gunvantbhai Ratilal Patel. (Reference : Revenue Entry No. 5848, dated 3" April, 1989), PARS lOTTAM CHHAGANBHAI PATEL, Alongwith the name of Parshottam Chhaganbhai Patel, name of his son Patel Sanjay Parshottambhai Patel is joined. (Reference : Revenue Entry No. 760, dated 4" May, 2007), SURENDRAKUMAR CHHAGANBHAI PATEL, Alongwith the name of Surendrakumar Chhaganbhai Patel, name of his two sons Himanshu Surendrakumar and Jay Surendrakumar were joined. (Reference : Revenue Entry No. 759, dated 4" May, 2007), Said Surendrakumar Chhaganbhai Patel died on 27" October, 2019 and the names of Gitaben (wife), Snehaben (daughter) were entered in the revenue record. (Reference : Revenue Entry No. 4503, dated 6" July, 2020). Accordingly, the said lands were held by Kailashben Ratilal Patel, Rakeshbhai Ratilal Patel and Gunvantbhai Ratilal Patel. Ishwarbhai Bhikhabhai died on 11" April, 1990 and the names of His wife Joitiben Ishwarbhai and Gautambhai Ishwarbhai were entered in the revenue records, (Reference : Revenue Entry No. 6153, dated 12" October, 1990). Alongwith their names, the names of other family members of Gautambhai Ishwarbhai were entered namely Mrs. Kailashben Gautambhai, ‘Master (then minor) Swapnil Gautambhai and ‘Master (then minor) Sachin Gautambhai, (Reference : Revenue Entry No. 199, dated 13" February, 2004). However, Gautambhai Ishwarbhai died on 30" July, 2004 and his name was deleted from the record of rights. (Reference : Revenue Entry No. 302, dated 25" August, 2004), Said Joitiben Ishwarbhai also died on 24" July, 2015 and her name was deleted from the record of rights, (Reference : Revenue Entry No. 3190, dated 4" March, 2016). Thereafter, said Swapnil Gautambhai released his share in favour of his brother Sachin Gautambhai as per Deed of Release dated 4" October, 2017, registered under Sr. No. 8755. ‘Accordingly, said land belonged to Kailashben Gautambhai and Sachin Gautambhai, self and HUP. Said Kailashben and Sachin agreed for sale of their said land of Survey No. 92/2 and another Survey No. 566/2 to one Yogeshbhai Manilal Patel and Surendrabhai Manilal Patel as per Agreement for Sale dated 4" October, 2017, registered under Serial No. 8771 However, the same is cancelled as per cancellation dated 8 December, 2020, registered under No. 11980. Ba i DESAI & CO ADVOCATES & SOLICITORS vst Said Kailashben Ratilal Patel and others (Survey No. 546/2 and 92/1), and said Kailashben Gautambhai and another (Survey No. 92/2) sold and conveyed the said lands to the Present Title Holders as stated in Para “D” above, The name of Title Holder is entered in the Revenue Records as per Revenue Entry No. 4806 and 4807, both dated 23" July, 2021. The said entries are pending for certification, TOWN PLANNING SCHEME, ‘The said lands are included in Town Planning Scheme Vejalpur No. 4 (Final) and are given Final Plot as per details below. Said Land of Final Plot No. 140 has been granted for Non Agricultural Commercial Use by an order of District Collector, Ahmedabad, dated 16" August, 2016, bearing No. CB/Land- 2INAVS.R.608/16. Revised non-agricultural residential use has been granted by an order of District Collector, Ahmedabad dated 3° July, 2021, bearing No. 1591/07/19/046/2021 Said Land of Final Plot No, 66 has been granted for Non Agricultural Commercial Use by an order of District Collector, Ahmedabad, dated 8" August, 2016, bearing No. CB/Land- 2/NA/S.R.609/16. Revised non-agricultural residential use has been granted by an order of District Collector, Ahmedabad dated 15" April, 2021, bearing No. 951/07/19/046/2021. J DESAI & CO ADVOCATES & SOLICITORS, From the record of the Sub-Registrar, we find Lis-Pendence Notice registered by one Bhadreshbhai Arjanbhai Desai dated 12" December, 2017 registered under Serial No. 11269 with respect to Special Civil Suit No. 503 of 2017 filed by him in the Court of Ahmedabad Rural, Hon’ble Principal Senior Civil Judge, against said Swapnil Gautambhai Patel claiming specific performance of Agreement for Sale dated 27" November, 2015 with respect to his (Swapnil’s) share in the land of Survey No. 92/2 and another lands of Survey No. 39/2 and $66/2. However, the matter is settled, suit is withdrawn and order is passed by the Hon'ble Court on 17" March, 2018. Cancellation of Lis-pendence dated 17" April, 2018 is also registered under Serial No. 4840, also declaring therein that he has not been left with any share, right or interest in the said lands. PUBLIC NOTICE, As a part of verification of title, before sale we gave public notice appeared in the daily newspaper “Sandesh” of 9" April, 2019, inviting claims, if any, in, upon or to the land above referred to. We have not received any claim in response thereto. DISCLAIMER. The aforesaid Report is reference of available revenue and sub registry records, only relevant for the purposes to study the devolution of title, and to ascertain any charge ot encumbrance, and does not contain entire revenue or sub registry records. We have relied upon the same without going into the details or further legal validation / scrutiny of records and proceedings referred to therein and implication thereof. As reported by our Search Clerk / Search Advocate, who has taken search of the revenue and sub registry records, it is found that some of the record is not maintained properly or damaged / torn, or not otherwise available. Also, in case of Sub-Registry records. Search may lack or miss some particulars, in these circumstances, The land is non-agricultural land, Therefore, we have not examined agricultural land laws implications, We have not made or carried out visit, verification, inspection or measurements at the site of the said land under due diligence of title. We have relied on the representations and warranties on title Contained in the Title Declaration dated 30" July, 2021 made by Shri Upendra Chinubhai Shah, Designated Partner of NCPL INFRASPACE LLP. OPINION. Accordingly, we hereby certify that the title of NCPL INFRASPACE LLP to the land above referred to is clear, marketable, free fiom all encumbrances and reasonable doubt, subject to :- a) Laws applicable and in force, at the relevant time, to effect legally and properly sale, transfer or other transaction with respect to the said lands DATED ON THIS 315™ DAY OF JULY, 2021, MeBeaat a co.
