2. Through the instant appeal, the appellant has
assailed an order dated 18.05.2018 issued by Registrar, Punjab Emergency Services Academy, whereby she was relieved from her duties from Medical Wing, Emergency Services Academy and was directed to report at the respective district with immediate effect.
3. At the very outset, it has been found that the
Punjab Government Rules of Business-2011 categorize the Punjab Emergency Service (Rescue 1122) as an autonomous body and Section 4(2) of Punjab Emergency Service Act, 2006 prescribes this service as a corporate body. Hon'ble Supreme Court of Pakistan in its judgment reported as 2010 SCMR 1484 has laid down that the jurisdiction of Service Tribunal is barred in respect of appeals of the employees of the autonomous bodies. Therefore, the appellant being an employee of Punjab Emergency Service i.e. an Autonomous Body, does not fall within the category of Civil Servant and hence is not entitled to invoke the jurisdiction of this Tribunal. Therefore, the instant appeal not being maintainable is hereby dismissed in limine.
