1. 1) The is issue is whether there is a contract between the two companies.
The answer is yes
there was a contract simply because, section 10 of the law of contract Act, [CAP. 345 R.E 2019]. "Provide that, nothing herein contained shall affect any law in force, and not hereby expressly repealed or disapplied, by which any contract is required to be made in writing or in electronic form or in the presence of witnesses, or any law relating to the registration of documents". 2. 2) The isssue is whether there was breach of contract. The answer is yes and this occur where the Airtel Tanzania PLC decided to block all the three numbers from accessing their services at all due to the resistance made by Arusha Art Limited when mobile phone number with unknown product at the rate of Tshs 198,200/= per month hence the charges where billed for two consecutive years but the law says under section 73(1) of the law of contract Act, [CAP.345, R.E.2019]. Which is provide that " Where a contract has been broken, the party who suffers by such breach is entitled to receive, from the party who broken the contract, compensation for any loss or damage caused to him thereby, which naturally arose in the usual course of things from such breach, or which the parties knew, when they made the contract, to be likely to result from the breach of it." 3. 3) The proper course to be taken in the circumstances is that the aggrived part may claim in the court of law for the compensation for breach of contract where penalty stipulated. Under section 74(1) Of the law of contract Act, [CAP. 345, R.E 2019].Provide that "Where a contract has been broken, if a sum is named in the contract as the amount to be paid in case of such breach, or if the contract contract contains any other stipulation by way of penalty, the party complaining of the breach is entitled, whether or not actual damage or loss is proved to have been caused thereby, to receive from the party who has broken the contract reasonable compensation not exceeding the amount so named or, as the case may be, the penalty stipulated."
