Special provisions:- Mumbai, Kerala and Goa
Mumbai Specific Regulation :
(i) Slum redevelopment Schemes and redevelopment of dilapidate
/unsafe buildings : dynamic town and country planning regulations
but stringent norms- C&AG, RTI, 51% State Government stake,
monitoring by High level Oversight Committee and public
consultation of individual projects.
The list of dilapidated buildings frozen on 6th January 2011.
(ii) Koliwadas (fishermen villages) and Goathans
• Declared as CRZ –III in CRZ-II. Thus, NDZ of 200 m applies.
• Restriction on construction and reconstruction of buildings of
fishermen houses
(iii) The islands within the backwaters shall have 50mts NDZ in Kerala
(iv) The mangroves along such as khazan land shall be protected and a
management plan for the khazan land prepared and no developmental
activities shall be permitted in the khazan land in Goa

Developmental Activities

Project approval process
• Project attracting CRZ Notification - recommended by the
concerned State/UT Coastal Zone Management Authority as per
CZMPs.
• SCZMA to recommend to MOEF / SEIAA and local planning
authority.
• MoEF - category –A projects as defined under EIA Notification
2006.
• Projects of DAE, MoD, Light houses, pipelines, conveying system, Oil
and Natural gas, cooling water intake, rare minerals , non
conventional energy , desalination, weather radar, reconstruction
demolition of public buildings and heritage building by MoEF after
CZMA recommendation.
• Category- B, under EIA Notification - SEIAA.
• Construction projects more that 20000 sq. mt and < 1.5 lakh by
SEIAA
• Housing projects < 20000 sq.mt approved by Local Planning
Authority
• Projects attracting both EIA Notification 2006 and CRZ
Notification 2011 required clearance under EIA Notification
after SCZMA recommendation
IPZ Notification
• For the islands of Andaman & Nicobar (324 islands) and Lakshadweep (32
islands of coral atoll )

• Integrated Island Management Plan to be prepared for each islands

• In view of the large geographical area South Andaman, Middle Andaman, North
Andaman, Havelock, Neil, Baratang, Little Andaman, Greater Nicobar Car
Nicobar, and Long islands as per the ICRZ (similar to CRZ) and for small islands
IIMP are to be prepared.

• IIMP /ICRZ plan prepared for 8 islands in A&N Smith, Flat bay, Aves, and Rut
land, Havelock, Neil, Long island and Little Andaman approval of UT
Administration awaited.

• IIMP for ten islands namely Agatti, Amini, Andrott, Bitra, Chetlat, Kadmat,
Kalpeni, Kavaratti, Kiltan and Minicoy of Lakshadweep prepared and approved
in compliance with Hon’ble SC Orders . For other islands IIMP being prepared.

Issues in CRZ

i. Housing construction in accordance with local town and


country planning
ii. Tourism to be permitted along beaches with minimum
setback or no setback.
iii. Fishermen houses to be constructed in NDZ
iv. Coastal road and infrastructure to be permitted
v. Eco friendly development in ESAs
vi. Reclamation to be permitted for construction
vii. No CRZ regulation in Port areas
viii. Thermal power and certain industrial activities, mining to be
permitted.
ix. Pollution, erosion, Stalinization and destruction of habitats
Review of CRZ

Dr. Shailesh Nayak Committee constituted in 2014 submitted its


report in 19.1.2015. Major recommendation include;

• Eco-friendly construction and tourism in CRZ –I area,


• Construction of houses as per local laws with strict
environmental measures
• Declaring highly populated stretches as CRZ –II
• Construction of fishermen / local communities houses within
NDZ
• Tourism to be promoted in identified stretches with minimum
setback and stringent environment conditions
• Hazard line to be part of management system
• Simplification of the procedures
Adani Port and SEZ Limited (APSEZL)

Business Standard– Govt. cancels Rs.200 crore green fine on Adani

• Sunita Narain Committee, April 2013- (ERF) @ 1% of the


project cost or Rs.200 crore >
• For Protection of marine ecology, mangroves, restoration &
conservation of creeks, studies & monitoring of the entire
project areas.
• Social infrastructure and livelihood support for fisher
communities.
• Show cause notice to M/s in August, 2013 as to why the ERF
should not be constituted.
APSEZL Contd…

• April, 2014 – Creation of ERF was not backed by any law under
E(P) Act, 1986.
• September, 2015 – Ordered for restoration of degraded
environmental components and conservation as recommended
by Sunita Narain Committee.
• More stringent conditions with open ended financial
commitment by APSEZL –
Financing the study; restoration and integrated conservation for
protection of creeks, mangrove areas, conservation of Bocha
island
ICZM project and Coastal Mission

• Phase-II of the ICZM Project to be extended to remaining


ten States and UTs.
• Four based documents sent to DEA and have been
processed

• Remaining States have been requested to submit


• National Workshop is being organized to set up

National Coastal Mission

• PMCCC approved Coastal Mission as one of the


components of the Climate Change.
• Sea Level Rise due to climate change is serious issue
• The ICZM Project mainly focuses on adaptation
measures
• Draft coastal mission document prepared and
comments obtained from CC Division and to be
circulated to all 32 Ministries and ten Coastal States
by next week. Salient features of the report:-
Objectives

1. Scientifically map the cumulative vulnerability of coastal


environment to climate change and consequent threats to ecology,
lives and livelihoods
2. Develop vulnerability- based environment & adaptive
management plans for key sectors
o Mainstream climate sensitivity and readiness into all coastal
developmental projects
o Promote development taking into account the threats due to
natural hazards in the coastal areas and SLR
3. Build resilience of coastal communities (e.g. fishers, agriculture etc.),
infrastructure and settlements (urban and rural)
4. Conserve and protect coastal stretches, its unique environment and
its marine area by enhancing mitigation (e.g. Blue carbon)
5. Build institutional capacity (sector-wise & community)

Challenges and Opportunities
The coastal areas, Islands, the marine waters have huge untapped potentials for
economic growth, job opportunities, and livelihood security for coastal
communities .
The main challenge to be addressed :-
(i) Pollution
(ii) Shoreline change & saline intrusion
(iii) Conservation protection of ESAs
(iv) natural disasters including Sea Level Rise
Potentials:
(i) Fisheries :- blue revolutions initiated by GOI in June 2016
(ii) Tourism:- India as a destination for Islands and Coastal tourism
(iii) Economic activities: Ports, SEZs, Industrial activities, Oil & Gas
(iv) Non conventional energy: Offshore wind, Solar, tidal (450 GW)
(v) Drinking water: desalinization plants
(vi) Food and Pharmaceuticals

The above can achieved by appropriate planning based on scientific


principles and its implementation .
