AFFIDAVIT OF NON-SERVICE

I, STANLEY WILLIAM (NRIC NO. 890905-12-6685) a Malaysian Citizen of full age

and residing at TB 5839, Taman Kinabutan, Batu 4 1/2 , Jalan Apas, 91000 Tawau,
Sabah do affirm and say as follows:-

1. I am a process server instructed by Messrs Lind Willie Wong & Chin,

Advocates & Solicitors of Level 7, Wisma Great Eastern, 65, Gaya Street, Peti
Surat 11063, 88811 Kota Kinabalu, Sabah, Malaysia to serve the
abovenamed a copy of the Notice of Re-Auction [Rule 14(16)] Sale of Land
By Chargee dated 25th April 2022 by the abovenamed Chargee against the
abovenamed Chargor.

2. Upon the instruction of Messrs Lind Willie Wong & Chin, I did on Wednesday,
11th May 2022 at 11.00 a.m, at attend for the purpose of serving a sealed
copy of the Notice of Re-Auction [Rule 14(16)] Sale of Land By Chargee on
LUK KEONG WAH the above-named Chargor. Upon arrival at the said
address, I could not locate the Chargor at the said address.

3. I have made all reasonable efforts and used all due means in my power to
serve and inform the Judgment Debtor of the Notice of Re-Auction [Rule
14(16)] Sale of Land By Chargee but my effort have been unsuccessful. I
found that the shop was unoccupied.

4. In the circumstances, the said Notice of Re-Auction [Rule 14(16)] Sale of

Land By Chargee could not served promptly and personally on the Judgment
Debtor and I verily believe that substituted service by inserting an

 advertisement of the same in one of the local newspapers will be an effective
way in bringing the Notice of Re-Auction [Rule 14(16)] Sale of Land By
Chargee herein to the knowledge and notice of the Chargor.
