Shakti Vahini Major Hub for Anti Human trafficking Interventions in NCR Region

Shakti Vahini runs a Trafficking in Persons Response Centre (TIP RESPONSE


CENTER) in Delhi which is a specialized unit having experts in child protection and
victim support. The TIP Response Centre specializes in rescue operations and has
developed excellent partnerships with law enforcement agencies across the country.
The centre works closely with Nodal Anti Human Trafficking Unit of different states and
Anti Trafficking Cell of Ministry of Home Affairs, Government of India.

The strong advocacy of TIP RESPONSE CENTER with local police and police
agencies from different source states makes Shakti Vahini a hub for assistance in Anti
TIP Police Interventions. The training provided by Shakti Vahini to the police personnel
of various hierarchy starting from State level training of senior officials at Police
Academies to cutting edge level training of policemen has created a very strong
network of Law Enforcement Officers across the country who respond proactively in
cases of Missing Children and Trafficked cases.

TRAINING OF LAW ENFORCEMENT
Law enforcement officials are at the
frontline of efforts to combat organized
crime like human trafficking. A sensitive and
informed police force ensures better
delivery of justice and speedy assistance to
the victim. Shakti Vahini Anti Trafficking
Initiative has been taking steps in this
direction by training and sensitizing police
officers at various levels. The strengthening
of criminal investigation and other law
enforcement capacity is a core component
of Shakti Vahini TIP Response Centre.
Technical assistance includes institutional
and operational capacity building of law
enforcement to strengthen investigation and
prosecution of organized crimes. Training is
offered to police investigators, prosecutors,
criminal intelligence analysts, and security
officials at Border and travel routes including
airports.

Shakti Vahini delivers a range of


trainings to law enforcement officers on
topics of relevance to fighting organized
crime in their local contexts. It also employs
modern technical training such as
computer-based training as well as
assistance in improving information
exchange between law enforcement
agencies, travel and border authorities.

LEGAL SUPPORT TO VICTIMS OF HUMAN TRAFFICKING
VICTIM PROTECTION
Human trafficking is a high profit, low risk crime for traffickers. The crime of human
trafficking is a criminal offence although it is often the case that criminal investigations do not
result in a conviction or, if a conviction is reached, it is usually lenient and does not reflect the
severity of the crime. Successful prosecutions with maximum enforcement of the law can act to
prevent and deter human trafficking. In order to achieve successful prosecutions, evidence and
testimony from the trafficked victim/s is often necessary during the criminal justice proceedings.
However, victims of trafficking are exposed to intimidations and various other risks and are often
afraid of cooperating with criminal justice. Responding to human trafficking therefore requires a
balanced approach that is based on enforcing the law against the traffickers and protecting the
human rights of trafficked victims. Protection and support measures for trafficked victims are
not only necessary to respond to the violations of the victims' rights, but also to support the law
enforcement response to human trafficking. Providing trafficked victims with protection and
support acknowledges and responds to the human rights abuse that they have suffered as a
result of being trafficked and ensures that they will not be treated as criminals themselves. It
allows victims the chance to recover from their trafficking ordeal and reduces the risk of re-
trafficking. Through the provision of protection and support, trafficked victims can gain the
confidence and security to provide evidence against their traffickers during the criminal
investigation. Evidence has shown that trafficked victims are more likely to cooperate in the
criminal investigation if they have access to protection and support services. Valuable evidence
provided by trafficked victims is extremely valuable to any prosecution case and can result in
the maximum enforcement of the law against the traffickers. Without evidence given by the
victim, the elements of the trafficking crime are extremely hard to prove in human trafficking
cases and it is probable that traffickers will receive a relatively light punishment in relation to the
severity of the crime they have committed. Therefore, without evidence and testimony from
trafficked victims, it is difficult to successfully prosecute the traffickers and implement the full
force of the law against them. Thus it can be rightly said that victim protection, are key to
successful prosecution cases and therefore to human trafficking prevention.

For trafficking in persons investigations, victim-witnesses are generally the most
vulnerable witnesses in the case. Measures for the protection and support of trafficked victims
should therefore be enforced to support the criminal justice system. The safety and support of the
victim during the criminal investigation is the priority given their vulnerability and the trauma they
have suffered as a result of being trafficked. Protection and support for the trafficked victim should
be made accessible as soon as the victim has been identified and be extended to their involvement
as a witness in the criminal justice system.

Planning for the safety and security of the trafficked victim-witness in the criminal court
proceedings is necessary. Measures need to be taken to ensure that the security and safety of
the victim-witness is maintained. Investigating officers and prosecutors each have a role to play in
this respect. Investigating officers are in a position to consider a wide range of witness protection
and assistance measures in preparation for the court proceedings. The victim-witness should have
the opportunity to meet with the prosecutors so that the criminal court proceedings can be
explained. Interpreters may be needed at this point. The victim-witness should be shown the court
room and the entry and exit points by which they will enter and leave. If the victim would prefer, a
screen positioned to shield them from the court room to ensure their anonymity should be
arranged. If this cannot be arranged, other methods for providing testimony or evidence may be
considered, for example, using a video or audio link to the victim-witness who may not wish to be
present in court.

STRENGTHENING SPECIAL JUVENILE POLICE UNITS IN DELHI

PREVENTION INITIATIVES TO COMBAT HUMAN TRAFFICKING

panchayats, social welfare department,
adolescent youth and colleges to initiate
prevention programmes.
