You are hereby accused as follows: -
That it has been revealed that on January 27, 2023, at around 10:00 am while you were in the
own office, smashed laptop, which is the property of company, on the table and broke it into
pieces.
An initial investigation was conducted to gather information where an eye witness Assistant
Manager Account Mr. Khurram produced a statement against you and also the Chief Security
Officer Mr. Habib provided the CCTV potage where you had seen doing the said act.
Due to the aforementioned, you are prima facie in breach of Standing Order 15's clause 3(c) of the
West Pakistan Commercial Employment (Standing Orders) Ordinance, 1968, and subject to
disciplinary proceedings. As a result, you are required to give justification within three days of
receiving this notice as to why disciplinary proceedings should not be taken against you. Please be
aware that if you do not respond within the time given, it will be deemed that you do not contest the
allegations and have no defense to make. If this is the case, legal action will be pursued moving
forward.

Declaring that I am an Assistant Manager in the Account Department, I was on duty on January 27,
2023. Mr. Rawal (accused) also was working on his laptop in his office which is besides my office.
He received a phone call, after a minute he was in harsh conversation with person on phone. He cut
off the phone call and smashed the laptop with the table in front of him. The laptop, which is
property of company, broke into pieces.
As an employee of this company, I was asked to witnesses against the accused if he was involved in
said allegation. I hereby witness the event took place.

Declaring that I am Chief Security Officer, I was on duty on January 27, 2023, when my assistant,
Mr Adrish, informed me of said event and said that the higher authorities requiring the CCTV potage
of January 27,2023 around 9:30 am to 10:00 pm. I checked the potage of said date and duration
wherein the Mr. Rawal (accused) received a phone call, after a minute he was in harsh conversation
with person on phone. He cut off the phone call and smashed the laptop with the table in front of
him. The laptop, which is property of company, broke into pieces.
As Chief Security Officer of this company, I hereby witness the event took place.

Declaring that I am Assistant Engineer in Maintenance Department. I was on duty on January 27,
2023, when I (accused) was working on an assignment of company on the laptop, which is under
ownership of company, received a personal call phone. I got in harsh conversion on phone call and
forgot that I was in office, and smashed the laptop with table present in front of me and that got
break into pieces.
Being an employee of this company, I am liable to rules and regulations regarding assets of
company. I surrender to company punishment and also request to higher authorities to accept my
apologizes and free me of allegation.

ENQUIRY REPORT
1. I believe it will be reasonable if the factors leading to this inquiry may be briefly stated here in
order to grasp the backdrop.
2. Considering the prosecution's case, it so ensued that Mr. Rawal, Assistant Engineer (hereinafter
to be referred as accused) was seen damaging the company’s asset.
3. An initial inquiry was conducted to ascertain the facts, and as a consequence, a charge sheet
(Case No. 87/B (2)/657 (Exh: DW 1/1)) was issued to the defendant
a) That accused while working in his office on an assignment of company, using a laptop
which was under possession of company, received a personal phone call wherein he was
found having harsh conversation and smashed the laptop on table and in the result of
which the company asset was broken into pieces.
b) That the accused submitted a false statement to reply of charge sheet Case No. 87/B
(2)/657.
4. That the accused provided a statement (Reply to charge sheet) on dated January 29, 2023 to the
charge sheet Case No. 87/B (2)/657 and that was deemed inadequate. In the meantime, the
undersigned was chosen to serve as the inquiry officer.
5. The accused appeared extensively in all of the proceedings in which the investigation was
conducted. Despite having the chance, he failed to provide any prospects as his assistance in the
investigation.
6. Two witnesses were used in the entire prosecution process to back up the accusations. However,
the accused presented no defence witnesses and instead chose to defend himself by cross-
examining himself.
7. The charges in the Charge Sheet have been thoroughly substantiated by Mr. Khurram, who is
classified as PW-1, and Mr. Habib, who is classified as PW-2, who have provided minute details
and the circumstances surrounding the incident that prompted this investigation. The accused
failed to elicit any evidence during cross-examination that could have aided in his defence.
8. Addressing first part of charge No. 3 (a). It might be argued that there is undeniable evidence to
support the claim that Mr. Rawal was observed damage company property, specifically a laptop
and a table, and that he lacks any proof and failed to offer any witnesses to back him up, making
him innocent.
9. Addressing last part of charge No. 3 (b) as making false statement in ‘reply to charge sheet’ has
also been established. He in the initial investigation denied the charges he is accused of and later
on, he, on knowing about witnesses accepted the charges in Defence Witness-1.
10. From whatever angle looked at, I was unable to uncover any mitigating circumstances that would
help the accused's case. I have consequently come to the unavoidable conclusion that the
evidence supporting each and every charge listed in the Charge Sheet is beyond a reasonable
doubt, and I hold the accused accountable as a result.
11. Under the cover of a separate letter properly signed by me, the inquiry report and the inquiry
proceedings are forwarded to the competent authorities for further necessary action.

SUBJECT: DEMOTION/WARNING
This relates to the Charge Sheet dated 28.01.2023, Case No: 87/B (2)/657, and your answer in
connection thereto, which was deemed inadequate and led to an investigation that you legally
participated in. According to the investigation report, you were found guilty of violating West
Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance, 1968, Section 15 of
Clause 3(c).
The Management may have exclusive power to punish you severely, but out of respect for your
situation, this time's penalty has been extra-special. Therefore, in accordance with Section 15 of
Clause 2 (iii) of the West Pakistan Industrial and Commercial Employment (Standing Orders)
Ordinance, 1968, it has been determined to demote you to a preceding lower grade in service as a
penalty with immediate effect.
However, you are also therefore cautioned that any future occurrences will subject you to stringent
disciplinary action, which may be more cautious because any such would result in your termination
from the service.
Your suspension period from service i.e., 02-02-2023 to 12-02-2023 stands confirmed.
