REPUBLIQUE DU CAMEROUN PAIX-TRAVAIL-PATRIE ARR 08 FEY 2023 fixant les prix et tarifs de référence des équipements, des fournitures, des travaux et services divers destinés aux administrations publiques et parapubliques au titre de l'exercice budgétaire 2023.- LE MINISTRE DU COMMERCE, Vu la Constitution ; Vu la loi n°2015/018 du 21 décembre 2015 régissant l'activité commerciale au Cameroun Vu — [a loi n°2022/ 020 du 27 décembre 2022 portant loi de finances de la Republique du Cameroun pour I'exercice 2023 ; Vu le décret n° 2011/408 du 09 décembre 2011 portant organisation du Gouvernement Vu le décret n° 2011/410 du 09 décembre 2011 portant formation du Gouvernement, modifié et complété par le décret n°2018/190 du 02 mars 2018 ; Vu le décret n° 2012/513 du 12 novembre 2012 portant organisation du Ministére du Commerce ; Vu le décret n°2018/366 du 20 juin 2018 portant Code des Marchés Publics Vu la circulaire N°00000006/C/MINFI du 30 décembre 2022 portant instructions relatives a 'exécution, au suivi et au contréle de I'exécution du budget de I'Etat et des autres entités publiques pour l'exercice 2023 ARRETE : ARTICLE 4°.- Sont fixés, a compter de la date de signature du présent arrété au titre de l'exercice 2023, les prix et tarifs de référence hors TVA des équipements, des fournitures, travaux et services divers destinés aux administrations publiques et parapubliques, conformément aux tableaux joints en annexe, sous réserve des dispositions de article 5 alinéa 1° ci-dessous ARTICLE 2.- Les prix et tarifs des articles et services contenus dans les sous. (2) Dans I'hypothése d'une contradiction entre les prix et tarifs contenus dans les supports informatique et papier, les prix et tarifs a considérer sont ceux du support papier paraphé par la Direction de la Meétrologie, de la Qualité et des Prix. (3) Sous réserve des contraintes techniques diment justifies et motivées, les gestionnaires de crédits doivent obligatoirement choisir les articles, objets de leurs commandes ou leurs equivalents, parmi ceux contenus dans les annexes du présent arréte. (4) Les prix et tarifs des articles et services ne figurant pas dans Ss annexes du présent arrété sont soumis a la validation préalable de la Direction de la Metrologie, de la Qualité et des Prix pour la zone des bons d’engagement, et des Brigades Régionales et Départementales des Contrdies et de la Répression des Fraudes territorialement compétentes pour les zones de bons de commande. ARTICLE 2. - The prices and tariffs for the items and services contained in the Subheadings peculiar to a specific supplier shall be taken into account only on the basis of the original invoices submitted by the person concerned ARTICLE 3. - The tolerance margin allowed on the prices and tariffs referred to in article 1 above shall be at 3% for all towns. (2) If there is a discrepancy between the prices and tariffs contained in the electronic and print platforms, the prices and tariffs to be considered shall be those on the pint platform initialed by the Department of Metrology, Quality and Prices. (3) Subject to duly justified and motivated technical constraints. the vote holders must choose the items, objects of their orders or their equivalents, from those contained in the annexes to this Order. (4) The prices and tariffs for items and services not listed in the annexes to this Order shall be subject to prior approval by the Department of Metrology, Quality and Prices for the areas covered by commitment orders and by the Regional and Divisional Control and Anti-Fraud Brigades with territorial competence for the areas covered by purchase orders.ARTICLE 6. - (1) Invoices that do not comply with the provisions of this Order shall be rejected outright. (2) Any violation of the provisions of this Order shall be punished in accordance with the relevant laws and regulations in force. ARTICLE 7. - The Directors-General of Budget and Treasury, Financial and Monetary Cooperation of the Ministry of Finance and the Director of Metrology, Quality and Prices of the Ministry of Trade shall be responsible, each in their own administration, for the application of this order which shall be registered, published according to the procedure of urgency, and inserted in the Official Gazette in English and French. /-
