ORDER: The Director of Agriculture has taken various steps for safe use of hazardous pesticides and organized the High Level Meeting with its members after detailed discussions and based on the reports, proposed to ban the following hazardous pesticides in the State temporarily for a period of 60 days., (1)Monocrotophos (2)Profenophos (3)Acephate (4)Profenophos+ Cypermethrin (5)Chlorpyriphos + Cypermethrin (6)Chlorpyriphos. 2. The Director of Agriculture has also proposed to prohibit the manufacturing, sale, stock, distribution/exhibit for sale or use of 3% yellow phosphorus permanently for Agriculture/ Insecticidal purpose is the whole of Tamil Nadu as per section 18(a) of the Insecticides Act, 1968 (Central Act 46 of 1968) and the Insecticides Rules, 1971. 3. The Director of Agriculture has further stated that in the year 2017-18, farmer deaths occurred in Tamil Nadu due to toxic nature of the pesticides namely, Carbofuran, Monocrotophos, Acephate, Profenophos, Profenophos + Cypermethrin and Chlorpyriphos + Cypermethrin and 3% yellow Phosphorous [Ratol] which is being used as Rodenticide, is the major cause of suicidal deaths across Tamil Nadu. Therefore, the Director of Agriculture has requested to ban the hazardous pesticides as per above para 1 and 2 from the date of publication of notification in the Tamil Nadu Government Gazette. [P.to..J -2- 4, The Government after careful consideration, accept the proposal of the Director of Agriculture and as per the provision under section 27 of the Insecticides Act, 1968 (Central Act 46 of 1968) have decided to issue Notification to ban the sale, distribution or use of the hazardous pesticides for a period of 60 days and 3% yellow phosphorous [Ratol] for Insecticidal purpose permanently as per the provision under section 18 (1) of the above said Act from the date of publication of Notification in the Tamil Nadu Government Gazette. 5. Stock files and Spare Copies. /FORWARDED BY ORDER/ i/o SECTION OFFICER [P.t0..J 3 PPENDIX NOTIFICATION-I Whereas, the Governor of the State is of the opinion that it is expedient and necessary for the reason that, (a) the insecticides specified in the Schedule are either extremely or highly toxic or moderately toxic but have highly toxic effect due to use for blending in an unauthorized manner; (b) use of the insecticides specified in the Schedule appended hereto, or any batches thereof or any combinations of such insecticides is likely to involve risk to human beings or animals; (©) the research report submitted by the Tamil Nadu Agricultural University, Coimbatore and the High Level Committee constituted to examine the possibility of banning of hazardous insecticides have recommended to prohibit the insecticides specified in the Schedule appended hereto for sixty days as per the provision contained in section 27 of the Insecticides Act, 1968(Central Act 46 of 1968). Now, therefore, in exercise of the powers conferred by sub-section(1) of section 27 of the Insecticides Act, 1968 (Central Act 46 of 1968), the Governor of Tamil Nadu hereby prohibits the sale, distribution or use of insecticides specified in the Schedule below or any combination thereof for a period of sixty days from the date of Publication of this notification in the Tamil Nadu Government Gazette, pending investigation into the matter. (b) Government of India have stated that as per the provisions of the Insecticides Act, 1968 (Central Act 46 of 1968) and the Insecticides Rules, 1971, if an insecticide is not registered for Insecticidal / Agricultural use, and is available and being used for the said purpose, then it contravenes the provisions of the said Act and Rules and therefore the State Government may initiate appropriate action in this regard. (©) this unregistered pesticide is being sold in the open market across the State viz., Petty shops, Super markets etc., which is highly poisonous and likely to involve high risk to Human beings and Animals. (d) National Health Mission, Chennai, in its study report also indicated that 3 % Yellow Phosphorus which is being used as Rodenticide is the major cause of suicidal death across the State. (e) The High Level Committee also recommended imposing immediate ban on sale of 3 % Yellow Phosphorus for Agricultural use; AND WHEREAS the 3% Yellow Phosphorus (Phosphorus paste) is an insecticide, which has not been registered under the Insecticides Act, 1968 (Central Act 46 of 1968); NOW, THEREFORE, in exercise of the powers conferred by sub-section(1) of section 18 of the Insecticides Act, 1968, (Central Act 46 of 1968), the Governor of Tamil Nadu hereby prohibits the sale, stocking, exhibition for sale, distribution, transportation or use of phosphorus paste or any preparation containing any such substance in the whole of the State.
