(1) These Rules may be called “West Bengal State Electricity Distribution Company Limited (Revision of pay and Allowances) Rules, 2009” (2) They shall deem to have come into force on 1" day of January. 2006. unless otherwise Specifically provided under these Rules 2. Seale of pay ‘he present scale in relation to any Post/grade and its corresponding revised Pay band and Brade pay has been specified in colutin 2.3 and 5 Tespectively of the Schedule-1 3. Special pay There shall be no Special Pay along sith ay in the revised Scales, 4. Applicability 4) Every employee of the Company ‘ncluding those on deputation to other organisations shall be entitled to fixation of pay in the “OusSponding tevised scale of pay as per Schedule-1 we.f 01.91.2006 oy ier b) If he/she enters the Company’s service on or after 01.01.06 from the date of his/her joining the Company NOTE: Re- appointment of an employee after break in service on or after 01.01.2006 shall for all purposes be treated as first appointment under the company. 5. Definition: In these Rules, unless the context otherwise requires - i) ii) iii) iv) vy) vi) vii) Existing Basic Pay means Pay drawn in the prescribed existing scale of pay, cluding stagnation inerement(s) but does not include any other type of pay like Special Pay Existing Scale in relation to an employee means the present scale applicable to the post held by the employee as on 1* day of January 2006, whether in a substantive or officiating capacity, . Basic pay in the Revised Pay Structure means Pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay ete. The term Company shall mean WBSEDCL, which includes erstwhile West Bengal State Electricity Board (WBSEB). Employee means regular employees of WBSEDCL including those on deputation to other organizations. “Grade Pay” is the fixed amount corresponding to the pre-revised Pay Scales/Posts. “Pay in the Pay Band” means pay drawn in the running Pay Band specified in column-3 of Schedule-I. 6. Fixation of initial pay in the revised pay structure The initial pay of an employee to be governed by the revised pay structure shall be fixed on and from 1° January 2006 or from the date of their joining, whichever is later in the following manner: i). The Pay in the Pay band will be determined by multiplying the existing Basic Pay as on 01.01.06 or as on the date of their joining whichever is later by 4 factor of 1.86 and rounded off the resultant figure to the next multiple of 10. ii) if the minimum of the revised pay seale is more than the amount arrived at as per (i) above, the pay shall be fixed at the minjmum of the revised pay band. Grade Pay: ‘An existing employee shall also drav Grade Pay at the rate as applicable, of every scale Specified in column S ofthe Schedule-t thereof 9. House Rent Allowance: House Rent Allowance will be allowed @ 20% of the sum of pay in the pay Band and Grade Pay without any ceiling. However, in case both husband and wife are working, House Rent will be paid to any one of them as per their option, 11. Medical Allowance Medical allowance @ Rs 200/- per month will be paid uniformly to all categories of employees 13, Rate of increment in the Revised Pay Structure: ‘The rate of increment in the revised pay structure will be 3% of the sum of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10.The amount of increment to be added to existing pay in the pay band. 14. Date of next increment in the Revised Pay Structure: ‘i Existing system of granting Annual Increment as well as respective date of effect thereof will continue. 15, Stagnation Increment: ‘An employee, whose pay has been fixed in the revised scale in terms of these rules and who reaches the maximum of scale shall draw annual increment for stagnation beyond the maximum of the scale at the same rate at which it was last drawn subject to maximum of six such increments provided that the normal conditions for earning increment is fulfilled: LEED. : js} 16, Mode of payment of arrears of pay, i) The revised pay of an employee will be fixed notionally from 01.01.06. The pay so fixed shall be notional from 1% January 2006 to 31 March 2007 and no arrears shall be paid for this Period. The arrears of pay to which an employee may be entitled in respect of the period from st April. 2007 to 31 March. 2009 shall be paid i Year 2009-2010, This will be restricted to an amount equivalent to the difference of pay in two equal installments in the financial the revised Band pay + Grade Pay with Dearess Allowance and NPA, where applicable and the amount originally paid for the period (Basic+DP+Ad-hoc Allowances+DA+NPA) i) The Ad-hoc Allowances granted w.e.f, 1" July, 2008 vide Office Order No P/73 dated 12.08.08 will be subsumed while computing arrear of pay. iui) An employee, who separated from the company for whatsoever reason after 31" March 2007 but before the date of this order shall receive the arrears of pay, to which he may be entitled to 8) There will be no arrear payment on account of House Rent Allowance and any other allowances. *) Salary Payment on the basis of revised pay structure will be made effective from April, 2009. 17) Drawal of Pay and Allowances in the Revised Scales of Pav: ‘The detailed procedure relating to checking of Pay fixation in the Revised Scales of Pay will be notified by the General Manager (F&A), As it would take time to complete the checking, the Drawing and Disbursing Officer (DDO) at their own responsibility shall draw pay in the Revised Scales of Pay and Allowances for the employees under their jurisdiction for disbursement and Send the initial Pay Fixation Statement in triplicate in the format to be issued by GM(F&A). The DDO shall draw arrear Pay Bills and monthly Pay Bills of the employees in pursuance of Rule 16() and Rule 16(v) respectively under their jurisdiction on the basis of initial Pay Fixation Statements. but it should be made clear to the employees that such pay fixation in the revised scales is “provisional” and “overdrawal”. if any shall be recovered forthwith, 18. Career-Progréssion Scheme: (CPS) Jn erstwhile WBSEB. a scheme was introduced in the name and style of “ASsured Promotion Scheme” (APS) to take care of the Career Advancement of the employees, who were stagnating only for want of vacancies. The scheme was. however. not automatic but was based on suitability and other eligibility criteria on compl uf some fixed period of service irespective of Page 5 of | vacancies, As the promotion of the employees under that scheme was not assured in true sense, the scheme will WHGFehiaHEF be renamed as “Career Progression Scheme™without changing the contents and eligibility criteria of APS. AI the time of promotion from one post to another in the same running pay band, the grade pay attached to the posts at different leveis within the same running pay band will change. Additionally, increase in the form of one increment will also be given at the time of promotion. 19. Classification of Services: ‘The existing classification of services of the employees of the Company is hereby reclassified as below: Grade Pa: Pay Band No. Rs.5,400/- and above Rs.4,700/- 'Rs.2,600/- to Rs.4,400/- 1,700/- to Rs.2,100/- 20. Induetion a) To provide a culture of excellence. lateral entry in different technical as well as non-technical areas in Class-1 posts will be made. Initially, 10% of the existing cadre posts of Divisional Engineer/ Manager/S.F/Sr. Manager will be filled up from amongst directly recruited class 1 officers having minimum Educational Qualification required for their induction level post, who will be eligible to appear in test in the internal selection process after completion of 5 years of continuous service in their respective feeder post. Such test will be conducted once in a year. There will. however. be no restriction on number of attempts. b) Employees borne in the pay scale of Rs.12000-18000/-(unrevised) under CPS, after completion of total 25 years of continuous service will be allowed Grade Pay of Rs.8.100/- per month under same pay band (PB-4). There will be no change in his designation, ©) Existing seale of pay of Rs 13,150-385-18,155/- of Deputy Chief Engineer/Deputy General Manager (F&A)/ (P&A) or equivalent will be abolished w.e.f. 01.04.09. Their fitment to be made in the pay Band of Rs 37.400-67.000/- with Grade pay of Rs 8000/- from 01.01.06.Thereafter their grade pay will be enhanced to Rs 8,700/- in the pay band of Rs 37.400-67.000/- (PB-5) with effect from 01.04.09. d) In case sufficient number of adequately qualified and experienced person is not available from within the company in respect for the post of ACE/Additional General Manager or Ha rR Page 6 of 16 Sauivalent post and above. direct recruitment from outside will be made, Similarly, disect ‘eeruitment from oussie will also be made for other professional/specialised jobs of the Company. Under Career Progression scheme, 1 level of promotion of directly recruited Diploma Holders will be in the revised Pay Band of Rs. 9,300- 34,800/- with Grade Pay Rs.4,700/- and 2" level of promotion as Assistant Engineer in the revised pay Band of Rs.15,600- PALM with, Stade. Tay. Re SAO. Their 2° LevGl ot promotions, ith be: an Divisionet Engineer in the revised Pay Band of Rs.15,600-39,100/- with Grade Pay of R.6,600/: under CPS. Meritorious and competent DE*s having Diploma in Engineering will also be considered for promotion to the post of SE in the pay band of Rs 15,600-39,300/- with grade Pay of Rs 7,600/- per month after completion of 5 years of continuous and satisfactory service, Such promotion will not be automatic and the candidates suitable for promotion will be selected through test/ interview, Existing Erection Engineers (EE) will henceforth be re-designated as Divisional Engineer and their existing gradation list will be merged with sting DE. Their inter-se seniority in the combined gradation list will be fixed on the basis of the appoinument/joining as DE or BE as the case A 1D) Sr. Assistants promoted as Head Clerk/Head Storekeepet/Accountant/Head Cashier etc will be re-designated as Head Assistant and will have no wing identification. They will be assigned any job relating to stores/cash/aceounts/establishment ete in the interest of work of the company by the controlling officer. At the time of their proms ion from Head Assistant to Junior Manager, Standing Selection Committee (SSC) will allot the wing for Junior Mangers either in the Finance or Personnel or Stores and Materials disciplines based on their past experience and aptitude. Such allotment of Wing made by the SSC will be binding on the ineumbent getting promotion. During the entire period of journey from Assistant to Head Assistant the incumbent will have to appear and pass in the computer proficiency test failing which they will not be considered for promotion to the next higher posts. Company will arrange for such training at Company’s cost. 8) There will be common gradation list for Assistant Engineer (Electrical)/ (E&T)/Computer Science/Engineering & IT 21. Changes in the organization structure The proposed changes in the organization structure, Enterprise Resource Planning(ERP) implementation, Corporate performance monitoring. system ,institutionalizi ig Key performance indicators and assessment system across the organization, re-designations at various levels, when developed and finalized will be suitably fitted in the revised pay and allowances with necessary improvement. Alll these changes will be an integral part of the compensation package now sanctioned. 22. Provident fund ; Existing system of maintaining pension fund for those who opted for pension scheme under Death cum Retirement Benefit (DCRB) Regulation, 1985 will continue. Reimbursement of Children education expenses, Tw support children education. expenses in the form of hostel subsidy will be reimbursed to an employee for a sunt not exceeding Rs 12000/-per annum per ward per employee subject to a ‘maximum of two children, The claim for reimbursement of hostel subsidy of one financial year ‘o be lodged once in a year in the month of April of the subsequent year supported with the certificate from the Head of the concemed school/ college/Institutions/University as to the actual stay of the student in their hostels/approved student homes. The children (of those employees, who die or suffer permanent total disablement arising out of and in course of employment) who were availing such hostel subsidy will continue to avail the same benefit till their stay in the hostel or date of superannuation of the employee whichever is cartier. The reimbursement is to be claimed in the same manner as above either by the surviving parent or by the incumbent himself. 24, Reimbursement of Professional fees etc, Professional fees/Professional journal will be reimbursed in the month of March every year to an.employee in the manner keeping specified relevance to the area of responsibilities in the Company. In case the relevant professional qualification is acquired on a subsequent date to this office order, such reimbursement will be admissible from the date of application by the employee informing acquisition of such qualification in writing. Director (HR) will be the Competent authority to grant such reimbursement to the employees of Class-I only. Allowances in respect of operating Bradma will be discontinued after retirement of existing incumbent 27. Funeral Expenses: Funeral Expenses of Rs.2,000/- will be paid on application of the family member of the deceased employee. 28. Leave Encashment: Existing Rules for granting Leave Encashment facilities of 15 days beyond 180 days of Eamed’ Leave will continue. There will be no arrear payment in respect of encashment already made for the Calendar year 2008. Leave encashment on the basis of revised pay will be effective from 1°" April, 2009. 29. Re-designations i) Shramik will be re-designated as Technical Support Hand ii) Peon will be re-designated as Office Support Hand. iii) Erection Engineer to be re-designated as Divisional Engineer. iv) Work Supervisor to be re-designated as SAB, v) Special Operating Assistant Grade A and Grade B to be re-designated as Special Operating Assistant vi) Special Technical Assistant Grade A and Grade B to be re-designated as Special Operating Assistant 4 x 30. Chi care | Childcare leave(CCL) will be granted to women employees having minor children below the age of 18 years, for a maximum period of 2 years( i.e. 730 days) during the entire service, for taking care of up-to two children whether for rearing or to look after any of their needs like examination, sickness ete subject to the following conditions: i} Childcare leave shall be admissible for 2 eldest surviving children only ii) The leave account for Childcare leave shall be maintained separately and it shall be kept along with the Service Book of the employee concemed. Under no circumstances, can any employee proceed on CCL, without prior proper approval of the leave by the leave sahctio jing authority, iv} The leave is to be treated like the eamed leave and sanctioned as such. ©) Consequently. Saturdays, Sundays, Gazetted Holidays falling during the period of leave would also count for CCL, as in the case of Earned Leave. vi) ce can be availed only if employee concemed has no eared leave at her credit, 31. Maternity Leave Maternity leave will be allowed up to a maximum period of 180 days for two children oml ly. The terms and conditions of sanctioning of leave witl remain unaltered. 32. Incentive Scheme: The formulation of KPls across the Company’s organization and the design of an objective assessment system based on the KPIs, are being framed. Till its finalization, the group-based performance-linked incentives scheme will continue Once the KPis-based assessment system is in place, the incentive schemes with such refinements as assessed necessary will be further drilled down in the medium-term to ‘neentivise individual performance, In due course, the incentive structure will be converted into 4 variable pay component in consultation with all stakeholders based on three ‘components: - * X portion of the overall financial gain eamed by the Company due to process and efficiency improvements, to be apportioned among all operations and support staff; > The group incentives admi ible for different aspects of the distribution, hydel generation businesses: cn > An in lual incentive to high-performers designed around the new KPl-based and objective performance assessment system. ‘The Incentive Scheme will comprise a pecuniary component over and above salary, for higher performance that would be judged by improved delivery to the end user. This system will also work as a substitute for Bonus (Whether linked to produetivity or ad-hoc), Honorarium etc 33. Contractual appointments for fixed tenure u Contractual appointments for selected posts, pat larly those requiring high professional skills will be made by inducting suitable person from outside. The existing employees, after retiremey can also negotiate 2 consolidated amount for a specific tenuye in a particular post Page 14 of provided they leave the service. Such employees will not be entitled to any other benefit. After the expiry of the tenure, the concemed employee may negotiate the contract or leave. The concemed department ,will not be allowed any extra budget on this account and will ensure commensurate savings elsewhere to absorb the extra expenditure incurred, The scheme will be applicable for various technical and non-technical categories that can opt for higher remuneration under a contractual appointment on tenure basis in the company. 34. Terminal Benefits: The existing terms & conditions regarding pension benefit as per DCRB, 1985 to continue with the following modifications: Pensioners who retired/died in harness before1.1.2006. 1. The existing basic Pension in respect of all past pensioners (pre 01/01/2006 retirees) shall be multiplied by 1.86 and the product shall be enhanced by 40% of basic pension. which shall be the revised basic pension on 01/01/2006, 2. The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty percent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired Pensioners who retired/died in harness on or after 1.1.2006. For post 01/01/2006 retirees, the benefit shall automatically be re- calculated on the basis of the revised pay taking effect from 01/01/2006. Dearness relief: Dearness relief as on 01/01/2006 will be nil. Cost of operation and treatment of donor of Kidney (not being employee or his/her dependant) Cost of operation arid treatment of the donor of Kidney (not being employee or his/her dependant) will also be reimbursed on assessment as per norms treating the said operation as part and parcel of the operation / treatment of the employee / dependant in case of Kidney Transplantation irrespective of determining dependency of the donor on the employee subject to receipt of formal declaration of the employee that the entire cost for operation and treatment of such donor of Kidney was incurred by him. Donation of Kidney is, however, subject to compliance with legal provisions. M, Mechanism for checks, controls and rationalization : 0 Xerox copies of Bills of AMRI Hospitals and other super / multi- specialty hospitals of Kolkata and adjoining areas particularly relating to in-door treatment of critical diseases each beyond seven days duration shall be sent to CMO for checking whether abnormality in rates and charges exists. a Medical Officers of the Company shall pay periodic visits to hospitals for interacting with patients, verifying necessity of continuation of treatment, checking of requirement of different tests suggested and counscling of patients. They will be assisted in this regard by existing three Jr. Manager (P&A)s. who are now being utilized by Corporate Personnel Department for arranging admission of patients in hospitals. They shall evolve mechanism for extending the benefit of treatment in cash-less manner; which may conveniently be kick-started with AMRI Hospitals, Dhakuria through Corporate tie-up. Gradually, this method need further be extended in respect of other hospitals in and around Kolkata. 2 The Medical Officers shall henceforth maintain liaison with different hospitals and co-ordinate with site offices for shifting / transportation of injured / critical patien’ = admission inappropriate hospitals for proper treatment. 7% CSP ae ery One of the relatives / escorts of the injured patients (arising out of on-duty accident) will be allowed incidental expenditure at the rate of daily allowance admissible to the employee concerned so long the patient stays in hospital beyond 20 Kms. from his residence for ensuring daily visit / contact. Reimbursement of bed / accommodation charges, though shall be made as per entitlement as indicated hereinbefore, admissibility for reimbursement of other charges ie. tests, investigation, operation etc. shall however be determined without restricting / limiting such charges corresponding to bed / cabin or entitled class of accommodation in the event of treatment made by an employee / his dependant / her dependant otherwise than in his/her class of accommodation.
