Defendant. : CONSENT ORDER
THIS MATTER having been opened to the Court by the defendant Paul C. Williams,
appearing pro se, and Danny Ljungberg, Esq., Special Deputy Attorney General representing the
State of New Jersey; and the Court having considered the parties’ submissions; and for good
cause having been shown;
IT IS ORDERED for all the reasons stated on the record on December 3", 2018 that
Defendant’s motion for the return of his phone and camera is GRANTED IN PART AND
DENIED IN PART.
Specifically, the State will return Defendant’s Nikon Digital Camera Model D7100:
Serial Number 2808245 in accordance with the following conditions:
a, Defendant stipulates that the Nikon Digital Camera Model D7100: Serial Number
2808245 seized by the State belongs to him;
b. Defendant stipulates all photographs obtained from the above referenced camera as
well as photographs taken of the camera shall be admitted into evidence at the option
of the State;
c. The State agrees to take photographs documenting the current state of the camera;
and4. The State shall retain the memory cards from the above referenced camera and return
the camera to Defendant no later than 60 days from the entry of this order.
IT IS FURTHER ORDERED that the State’s motion to compel Defendant to provide
his phone's passcode is GRANTED. In accordance with this order, the State and Defendant
agree to the following process:
a, the State will produce the iPhone in open court on, YY, L014 (2 ico
1b. the State will connect the iPhone to a laptop belonifing to the Burlington County
Prosecutor's Office (“BCPO”);
c. once connected, Defendant shall enter his password and agree to “Trust” the
computer;
d._anagent of the BCPO will attempt to open the file system on the iPhone, navigate to
the photos and/or videos folder and transfer all photos and videos taken on or after
June 27%, 2018 at 5:00pm to the laptop;
e. the photos/videos will be placed on a disk for and provided to Defendant;
£, the State and Defendant stipulate that all videos and photos recovered in accordance
with this order from the iPhone shall be admitted into evidence at the option of the
State;
g. in the event the video(s) cannot be located, no further action will be taken pending
further action by this Court;
h. the State’s investigator shall be allowed to photograph the iPhone’s identifying
numbers while the phone is unlocked in this Court subject to Defendant agreeing to
an adjournment if the State’s investigator is unavailable to take the photographs; and
i, the iPhone shall be returned to Defendant immediately upon completion of the
transfer of any videos.
‘The parties have evinced their consent to this order and its terms by affixing their
