Williams, United States District Judge, * pursuant to the provisions of 28 U.S.C. §636(b)(2) and me General Order 104-D of the United States District Court for * the Central District of California. = On January 3, 1975, plaintiff filed this Complaint % | an propria persona, alleging a cause of action based on 7 42 U.S.C, §1983 and §1985. 5 On March 28, 1975, Motions to Dismiss were taken al under submission. - Plaintiff seeks general and punitive damages from - state employees for the violation and deprivation of rights » |, guaranteed by the Constitution of the United States. 20 He alleges that he was arrested while driving and at told to get a driver's license and a vehicle license which a he claims are titles of nobility, and to pay for them with 00 ae at ReSaings prcnives 10 1 2 3 4 16 " 8 1» a 30 a1 32 Federal Reserve Notes, which are not backed by gold or silver coin, in violation of the Constitution of the United States. He further alleges that he was threatened with a deprivation of his liberty and that all took place under color, custom and usage of the California Vehicle Code once in court, defendant Soares, a Municipal Court Judge, refused to allow plaintiff to appear with counsel of his own choice, a non-lawyer. Plaintiff seeks damages. ‘The Complaint is frivolous. The acts complained of were in the course of the enforcement of state statutes whose constitutionality has long been established. | ‘The claim that the issuance of Federal Reserve Notes violates the Constitution of the United States was recently, once again, laid to rest in this circuit. United (9th Cir., Sept. 9, States v. Schmitz, No. 75-2056, _F.2d__ 1975); Milam v. United States, No. 72-1666, _F.24_, (th cir., Jan 29, 1974). Tt is equally clear that restricting comsel to | members of an integrated bar is constitutionally permissible. | Guajardo v. Luna, 432 F.2d 1324 (Sth Cir. 1970); United States v. Stockheimer, 385 F.Supp. 979 (W.D. Wis., 1974). The Magistrate finds that no claim upon which relief, may be granted is stated. Tt does not appear that the Complaint can be amended to overcome this deficiency. TT 1S THEREFORE RECOMMENDED that plaintiff's Motion to Dismiss be granted as to the moving parties and as to all other parties, sua sponte. Fed. R. Civ. P. | 12(0) (6).
