H-1B Sample Interview Questions 1.
What is your temporary and permanent address and any other means of contact (i.e. telephone, e-mail)? 2. Are you an H-1B worker? What is your occupation and educational background? 3. Do you have a copy of your LCA, I-129, I-797, your petition letter, and a copy of your employment agreement? Please provide copies if possible. 4. What firm petitioned to hire you? Is that the same firm you work for now? 5. Were you inside or outside of the U.S. when your petition was approved? 6. If you were outside the U.S., when did you arrive in the U.S. and when did you make yourself available for work (entered into employment)? 7. If you were inside the U.S., when did you become eligible to work for the new employer? 8. Was there any waiting time between your arrival into the U.S. and the first day of work? 9. If you were already in the U.S., was there any waiting time between your hire date and your first day of work/ 10. If there was any waiting time, how long was it? What did you do during that time, was that time paid? If so, how much? 11. How did you come to work for the firm? How did you hear of the firm and who hired you?
12. When did you first report to work for this firm? 13. When you first began to work for the firm did you start off working in your occupation or were you placed in other jobs (such as general office work, training, etc.)? 14. If you did other work, how was that time recorded and paid? 15. What was your rate of pay? Was that the same rate that you were told your rate would be? If not, explain. 16. Do you receive any other kind of pay (bonuses, travel expenses, per diem etc.)? If so, how much and why? 17. Have you ever received any deductions other than taxes from your pay? If so, what were they for and what were the amounts? 18. Did you voluntarily agree in writing to these deductions or were they a condition of your employment? 19. Were you charged any of the fees associated with obtaining your H1B visa (i.e. change of status fees, filing fees, and attorney expenses)? If so, when, how much and what was it 1
for? 20. Were you ever required to pay the INS $500/$1,000/$1500 filing fees? If yes, how much and when and to whom was the payment made? 21. 22. How many hours did you work per week? Was all of your vacations/time off taken voluntarily at your request?
23. If no, why not, what were the reasons and the time periods in which you were on involuntary vacations (i.e. layoff, client site closures, holidays, etc.)? 24. Please identify the dates which you were on voluntary vacation.
24. Please identify periods or days when you were not paid due to the client site shut down or holiday closures? 25. In between projects or during any nonproductive time due to the employers lack of work or ability to place you on a project, were you paid any salary? If yes, how much and for how long? 26. Were there any breaks (days, weeks or months) in your employment or pay? If so, what caused those breaks? Did you take leave for personal reasons (sick leave, vacation, etc.) or was there a lack of work or no available job assignment? 27. Did you work at any additional work sites for this firm? If yes, please identify (specific site, city, and time period). 28.Were you a full-time or part-time H-1B worker? If part-time, was there a record kept of hours worked? If there is no record of hours worked, what is your work schedule? 29. Were you offered the same fringe benefits as other workers? 30. Have you ever worked for the firm in another occupation/classification other than the one on the LCA? 31. If you did work in another occupation/classification, how was that time recorded and paid? 32. Did you ever work in an area different from the one specified on the LCA? If so, when and where? 33. If you work in an area outside the one on the LCA, how were you paid? Did you receive per diem or payment for travel to a temporary assignment? 34.Did the employer require you to pay an early termination fee or have a liquidate damages clause in your employment contract? 35. Do you have knowledge of the LCA or of a notice of hiring of an H-1B worker posted at the work site? 2

When did you stop working for the firm? 38. Did you resign or were you terminated? 39. How were you notified of your termination? 40. Did you go back to work for the firm? If so, when?
