SCHEDULE ONE (OATHS)


CERTIFICATE OF AUTHENTIFICATION OF CONSTITUTION

DEFINITION OF TERMS
In the writing/construction of this Constitution unless the context requires otherwise:

(1) “Resolution” means a declaration passed by the Parliamentary Council.

(2) “Sitting” includes a period during which the SRC committees meet continually.

(3) “Oath” includes affirmation specified in schedule to this constitution

(4) “Interest of students” include any right or advantage which ensures or is


intended to ensure the general benefit of students in this university.

(5) The University” means Regional Maritime University;

(6) “Board” means SRC, Audit Board and Appeals board respectively depending on
the context in which it is used,

(7) “President” means the SRC President;

(8) “Speaker” means the Speaker of the Parliamentary Council;

(9) The masculine pronoun “he” refers equally to female persons.

(10) Words in the singular include the plural and the vice – versa;

(11) “Consultation” means advisory opinion.

(12) Student means any person who is granted admission into the Regional Maritime
University and shall study from one to eight semesters in the university.

SRC PROPERTY

All property, movable and immovable of every description now or hereafter belonging to the
SRC shall remain and be vested in the SRC, and all Trusts and Instruments of similar legal
effect, for or executed or to be executed by the SRC in accordance with the provisions of this
Constitution shall inure to the benefit of the SRC.

PREAMBLE
We are students of the Regional Maritime University Accra, Ghana;

EMERGING from diverse cultural, religious, political, and economic backgrounds, mindful
of our diversities;

COMMITTED to unite and build a non-racial, gender equal and democratic society;
recognizing our discipline as a cardinal instrument for the sustainability of the Maritime
Industry;

DETERMINED to instil and nurture a culture of learning, research, tolerance, understanding,


strategic and critical thinking, mindful of our status as students. Make the statement that: We
shall in one accord:

i. Promote principles that embrace the notions of democratic Practice,


representation on consensus building across all students Structures;
ii. Seek social redress and increased access within our university students’
communities;
iii. Embrace the vision, mission, and quality policy of the university;
iv. Affirm the principle of linguistic plurality; and at the same time, subscribe to the
language policy of the university;
v. Respect the difference that arise due to socio-economic status, race, nationality and
gender;
vi. Uphold the principles of transparency, accountability, responsiveness and broad
participation of the student community

CHAPTER ONE
THE CONSTITUTION

Article One (1)


NAME
The legitimate Students’ representative body shall be known and called "Students’ Representative
Council” of the Regional Maritime University (RMU), Ghana, hereinafter referred to as the "SRC".

Article Two (2)


PRIMACY
(1) This constitution shall be the constitution of all students of the Regional Maritime
University and any provision of any other student Association Constitution found to be
inconsistent with this constitution shall to the extent of its inconsistency, be null and void,
except for the Cadet Corps rules.
(2) Notwithstanding clause (1), this constitution shall be subject to the statues/charter
establishing this university.
(3) Applications of this constitution shall be limited to student governance.

Article Three (3)


ENFORCEMENT OF THE CONSTITUTION
Any student who alleges that
(1) An act or omission of any person or group of persons;
Or
(2) Constitution, decision and/or resolution of any body, organisation, club, union or
association is in contravention with a provision of this Constitution may apply to the
Judicial Council for a declaration to that effect.
(3) The Judicial Council shall for the purpose(s) of such declaration under clause (1) of this
article, make such orders and give such directions as it may consider appropriate for giving
effect, or enabling effect to the declarations so made.

(4) Failure to obey or carry out the terms of an order or direction made or given under clause
(2) of this article constitutes a violation of this constitution and contempt of the Judicial
Council, and shall, in this case of the any elected or appointed officer, constitute a ground
for removal from office.

Article four (4)


AIMS AND OBJECTIVES
(1) The aims and objectives of the SRC shall include
(a) Seeking the interest and welfare of the students in the University regardless of
race, nationality colour, creed, gender
(b) Serving as the mouthpiece of the entire student body of the University.
(c) Providing a conduit of communication between students and the University
authorities in all matters affecting the students as a whole or Part thereof.
(d) Ensuring participation of students in all spheres of University life.
(e) Fostering good relations between students of this University and the outside
world.

(2) For the purposes of achieving these general objectives, the SRC:
(a) Shall in consultation with management organise lectures, symposia, conferment of
awards, debates, publications and such other activities that are necessary to fulfil
these general aims and objectives.
(b) Shall assist in coordinating and organizing student activities both at institutional
and external level.
(c) Shall exploit its competence in full, in order to benefit those it represents
(d) Communicate and negotiate with all relevant stakeholders within the SRC's field
of operation.

(3) SRC Week Celebrations


(a) The SRC shall celebrate its week which shall fall within the second semester of
the academic year.
(b) Executive Officers, in consultation with the University Academic Registrar, and
Coordinator for Students’ Affairs shall fix the actual date for the celebration,
subject to the approval of the Parliamentary Council.

Article five (5)

COMPOSITION OF THE SRC


(1) The SRC shall be composed of:
(a) The Parliamentary Council
(b) The Executive Council
(c) The Judicial Council

COMPOSITION OF PARLIAMENTARY COUNCIL
(1) The parliamentary council shall be composed of

(a) The Speaker


(b) Deputy Speaker
(c) Elected Members
(d) Clerk
(e) Sergeant- At- Arms

Article seven (7)


FUNCTIONS
(1) The parliamentary council shall;

(a) be a decision-making body of the SRC


(b) on its own initiative consider and make recommendations on any matter provided
for in this Constitution or affecting the welfare and interest of students.
(c) for the avoidance of doubt, it is here by declared that proceedings of the
Parliamentary Council shall not be inconsistent with the letter and spirit of this
constitution.
(d) vet and approve all offices under the SRC exempt the executive council
(e) receive, discuss and approve budgets of bodies under the SRC
(f) debate issues concerning the interest of students and may pass resolutions on them
and such resolutions shall be binding on the commission related to such an issue.
(g) receive, discuss and approve the work documents of all committees and
commissions under the SRC except that of the Judicial Council.
(h) have the authority to inquire into the activities and administration of executive
officers as Parliament may determine by summoning such officers before
Parliamentary Council or any parliamentary committee.

(2) The proceedings of the Parliamentary Council shall be communicated by the Speaker to
the general student body within seventy-two hours after the close of such proceedings.
Copies of the proceedings shall be pasted on all notice boards.

(3) Subject to the provisions of this constitution the Parliamentary Council shall regulate its
own procedure which shall be annexed to this constitution subsequently as Schedule 3

Article eight (8)


(1) SPEAKER
(a) The members of the Parliamentary Council shall meet within seven days after being
sworn in under the interim chairmanship of the Clerk to approve the Speaker of the
house appointed by the Executive Officers
(b) The Speaker shall be the leader and head of the Parliamentary Council in his
absence the Deputy Speaker shall act accordingly.
(c) The speaker shall preside over all meetings of the Parliamentary Council
(d) A student is qualified to be appointed Speaker if he/she is qualified to be elected as
an Executive Officer.
(e) The Speaker shall be appointed by the Executive Officers, acting in consultation
with the Executive Advisory Committee, subject to the approval of the
Parliamentary Council.

(2) The Speaker shall vacate his office

(a) if he becomes an Executive Officer.

(b) if he resigns from office by writing signed by him and addressed to the Clerk of
Parliamentary Council.

(c) if any circumstances arise that if he were not a Speaker, would disqualify him for
election as a member of the Parliamentary Council.

(d) if he is removed from office by a resolution bill of Parliamentary Council supported


by the votes of not less than three-quarters of all the members.

(3) No business shall be conducted in Parliamentary Council other than an election to the
office of Speaker, at any time when the office of Speaker is vacant.

(4) The Speaker shall be sworn in by the outgoing Judicial Council Chairperson on the first
day of Parliamentary Council sitting after dissolution of Parliament before any business of
Parliament is conducted.

Article nine (9)


DEPUTY SPEAKER
(1) There shall be a Deputy Speaker of Parliamentary Council who shall be nominated and
elected by the members of Parliamentary Council from among the members. A student is
qualified to be appointed Deputy Speaker if he/she is qualified to be elected as an Executive
Officer.

(2) The members of Parliamentary Council shall elect a person to the office of Deputy Speaker
when Parliamentary Council first meets after dissolution of Parliament and if the office
becomes vacant.

(3) Otherwise than by reason of dissolution of Parliamentary Council, at the first sitting of
Parliamentary Council after the office becomes vacant.

(4) The Deputy Speaker shall assume the position of Speaker in the absence of the Speaker
and shall on such circumstances waive his voting rights.

(5) The Deputy Speaker shall be the Chairman of the Vetting Committee of Parliamentary
Council.

(6) The Deputy Speaker shall be sworn in by the outgoing Judicial Council Chairperson on the
first day of Parliamentary Council sitting after dissolution of Parliament.

Article ten (10)


CLERK
(1) There shall be a Clerk of Parliamentary Council who shall be appointed by the Speaker of
Parliamentary Council and approved by a simple majority of the members of parliamentary
Council

(2) The Clerk shall not be elected from among the members of Parliamentary Council.

(3) The Clerk shall be the Secretary of the Parliamentary Council and shall perform such other
administrative functions as the Speaker may request.

(4) The Clerk shall receive all motion papers for the passing of resolution bills.

(5) The Clerk shall hold office when the tenure of the Parliamentary council ends until a new
Clerk is approved and sworn in.

Article eleven (11)


MEMBERSHIP
(1). The Members of the Parliamentary Council shall be drawn;
(a) One (1) from each undergraduate class
(b) One (1) from each postgraduate class
(c) One (1) from each department
(d) One (1) from the Students’ Christian Council
(e) One (1) from the Islamic Council
(f) One (1) from the Cadet Corps

Article twelve (12)


COMMITTEES OF PARLIAMENT
(1) Parliamentary Council shall appoint standing committees and other committees as may be
necessary for the effective discharge of its functions.

(2) The standing committees shall be appointed at the first meeting of Parliamentary Council
after the election of the Speaker and the Deputy Speaker.

(3) Without prejudice to clause (1) of this article the standing committees of Parliamentary
Council shall include:

(a) The Disciplinary Committee

(b) Budget and Finance Committee

(c) Public Account Committee

(d) Academic Committee

(e) Judicial Committee

(f) Welfare and Privileges Committee

(g) Business Committee

(4) Committees of Parliamentary Council shall be charged with such functions, including the
inquiry into the activities and administration of Executive Officers and Commissions as
Parliamentary Council may determine and such inquiries may extend to proposals for
resolution bills.

(5) Every member of Parliamentary Council shall be a member of at least one of the standing
committees.

(6) The Chairperson shall be appointed by the Speaker who shall coordinate the committee
meetings and report activities directly to the Speaker.

Article thirteen (13)

PROCEDURE IN PARLIAMENT
(1) A member of Parliamentary Council shall, before taking his seat in Parliamentary Council
take and subscribe before the Speaker the oath of allegiance and the oath of a Member of
Parliamentary Council set out in the schedule one of this Constitution.
(2) A Member of Parliamentary Council may, before taking the oath referred to in clause (1)
of this article, take part in the election of the Speaker.

(3) The Speaker of Parliament shall preside in Parliamentary Council at all sittings and in his
absence the Deputy Speaker shall preside.

(4) A quorum of Parliamentary Council, apart from the person presiding, shall be one third of
all the members of Parliamentary Council.

Article fourteen (14)


VOTING IN PARLIAMENT
(1) Except as otherwise provided in this Constitution, matters in Parliamentary Council shall
be determined by the votes of the majority of members present and voting, with at least
half of all the members of Parliament present.

(2) The Speaker shall have neither an original nor casting vote.

(3) Where the votes on any motion are equal it shall be taken to be lost.

(4) Where the voting is in relation to the election or removal of any person under this
Constitution voting shall be by secret ballot.

(5) Any person who sits or votes in Parliamentary Council knowing or having reasonable
grounds for knowing that he is not entitled to do so commits an offence and shall be liable
on conviction by the Judicial Committee, to such penalty which may range from suspension
or disqualification from contesting elections under the SRC.

Article fifteen (15)


MODE OF EXERCISING LEGISLATIVE POWER
(1) The power of Parliamentary Council to make resolutions shall be exercised by resolution
bills passed by Parliament and assented to by the President.

(2) Every motion for a resolution shall be submitted by a member to the Clerk seven (7) days
before a Parliamentary Council sitting who shall in consultation with the Speaker and the
Deputy Speaker and acting on their advice, move such a motion on the floor of
Parliamentary Council

(3) Members shall debate the motion paper and vote on the issue on the floor of Parliamentary
Council.

(4) Notwithstanding clauses (2) and (3) the Speaker shall notify the President and the
Executive Officer to be affected by such a motion paper five (5) days before Parliamentary
Council sitting and the Executive officer shall have the right to appear before Parliamentary
Council to give further clarification on the issues discussed on the motion paper.

(5) The Clerk shall submit to the President for assent any resolution agreed upon by
Parliamentary Council and such a paper shall be known as a resolution bill.
(6) Every resolution bill shall be accompanied by a memorandum setting out in detail the
policy and principles of the bill, the defects of the existing practice, the remedies proposed
to deal with those defects and the necessity for its introduction.

(7) Where a resolution bill passed by Parliamentary Council is presented to the President for
assent he shall signify within five (5) days after the presentation, to the Speaker that he
assents to the resolution bill or that he refuses to assent to the bill.

(8) Where the President refuses to assent to a resolution bill, he shall within five (5) days after
the refusal state in a memorandum to the Speaker any specific provisions of the bill which
in his opinion should be reconsidered by Parliamentary Council including his
recommendations for amendments if any

(9) Parliamentary Council shall reconsider a resolution bill taking into account the comments
made by the President as the case may be under clause (8) of this article.

(10) Where a resolution bill reconsidered under clause (9) of this article is passed by
Parliamentary Council supported by the votes of not less than two-thirds of all members
the President shall assent to it within seven (7) days after the passing of the resolution.

(11) Parliamentary Council shall have no power to pass a resolution bill.

(a) To alter the decision of the Judicial Committee as between the parties to that decision
or judgment.

(b) Which operates retrospectively to impose any limitations on or to adversely affect


the personal rights and liberties of any person or to impose a burden, obligation or
liability on any person.

Article sixteen (16)


STANDING ORDERS OF PARLIAMENT

(1) Subject to the Provisions of this Constitution, Parliament may, by standing orders,
regulate its own procedure.

(2) Parliament may act notwithstanding a vacancy in its membership, including a vacancy not
filled when Parliamentary Council first meets after dissolution of Parliament; and the
presence or participation of a person not entitled to be present shall not invalidate these
proceedings.

Article seventeen (17)


ATTENDANCE IN PARLIAMENT OF VICE PRESIDENT AND OTHER
EXECUTIVE OFFICERS

The Vice President or any Executive Officer shall be entitled to participate in the proceedings
of Parliament and shall be accorded all the privileges of a member of Parliamentary council
except that he is not entitled to vote or to hold an office in Parliamentary Council.

Article eighteen (18)


CONTEMPT OF PARLIAMENT

(1) An act or omission which obstructs or impedes Parliamentary Council in the performance
of its functions or which obstructs or impedes an officer of Parliamentary Council in the
discharge of his duties or affronts the dignity of Parliamentary Council or which tends
either directly or indirectly to produce that result, is contempt of Parliamentary Council.

(2) A person found guilty by the Judicial Council of contempt of Parliamentary Council shall
in the case of an executive officer constitute a ground for suspension from office and in the
case of any other person constitute disqualification from contesting elections under the
SRC.

Article nineteen (19)


RIGHT TO OBSERVE

All students shall have the right to attend and only observe Parliamentary Council sittings.

Article twenty (20)


MEETINGS
The Parliamentary Council shall meet at least once each month
(not within Lecture hours)

Article twenty-one (21)


EMERGENCY MEETING.
(1) Notwithstanding any article in this constitution, the Executive officers through the General
Secretary may request in writing for an emergency meeting.
(2) Any twenty-four (24) members of the Legislative Assembly may request for an emergency
meeting provided that notice of such request shall be given in writing and that the agenda
or agendum which ever may be appropriate shall be attached and delivered to the speaker
or in his absence the deputy speaker.
(3) In the case of 8 (1), (2), the Speaker or the Deputy Speaker shall summon such a meeting
within 3 days of such request.

Article twenty-two (22)

TENURE OF OFFICE OF MEMBER OF THE PARLIAMENTARY


COUNCIL
(1) A member of the Parliamentary Council shall vacate his seat;
(a) upon a dissolution of the Parliamentary Council
(b) if he is absent, without the permission in writing to the speaker and he is unable to
offer a reasonable explanation to the disciplinary committee, from two sitting in a
semester;
(c) if he is expelled from the Parliamentary Council after being found guilty of contempt
of the Parliamentary Council.
(d) if he is removed from office in accordance with article 61 of this constitution.

(2) The Parliamentary Council shall be dissolved by the outgoing Executives Officers on the
eve of handing over to the new Executive Officers.

EXECUTIVE COUNCIL

Article twenty-three (23)


COMPOSITION OF THE EXECUTIVE COUNCIL
(1) The Executive Council shall be composed of;
(a) Executive Committee
(b) Women’s Commissioner
(c) Welfare Committee Chairperson
(d) Information and Publication Officer
(e) Sports Committee Chairperson
(f) Finance and Appropriation Committee Chairperson
(g) Audit Board Chairperson
(h) Entertainment and Organizing Committee Chairperson
(i) Student Affairs Committee Chairperson
(j) Intelligence Committee Chairperson

Article twenty-four (24)


FUNCTIONS OF THE EXECUTIVE COUNCIL
(1) Shall formulate and initiate policies, and policies formulated shall be subject to the
approval of the Parliamentary Council.
(2) Shall ensure that the provisions of the functions of the SRC are ensured therein.
(3) Shall defend the interest of students at all gatherings.

Article twenty-five (25)


MEETINGS OF THE EXECUTIVE COUNCIL
(1) The Executive Council shall meet at least once a month.
(2) The General Secretary shall disseminate summoning letters to various Council Members
as directed by the president in accordance to and by the provision of this Constitution.
(3) The President, Secretary General and Five (5) other members of the council shall form a
quorum.

Article twenty-six (26)


EMERGENCY MEETING OF THE EXECUTIVE COUNCIL
(1) An emergency meeting of the Executive Council shall be convened within forty-eight (48)
hours by the Executive Committee, or on the written request of six members of the Executive
Council who shall subscribe their names and signatures to the request stating the business to
be considered.

(2) An emergency meeting of the Executive Committee shall be convened within twenty- four
(24) hours by the President, or on the written request of three members of the Executive
Committee who shall subscribe their names and signatures to the request stating the business
to be considered.

(3) Aside from the business for which an emergency meeting is convened, no other business
shall be considered.

Article twenty-seven (27)


EXECUTIVE COMMITTEE
(1) The Executive Committee shall meet at least four (4) times in a trimester.

(2) The SRC General Secretary shall, in writing notify members of such meetings, specifying
the venue and agenda not less than two (2) days before the meeting.

(3) Without prejudice to any provision of this Constitution, the First sitting of the Executive
Committee shall be within five (5) days after the assumption of office.

(4) The Executive Officers shall consist of


(a) The President
(b) The Vice President
(c) The General Secretary
(d) The Treasurer

Article twenty-eight (28)


THE PRESIDENT
(1) The duties and functions:
(a) There shall be a president who shall be the Chief Spokesperson and head of all
delegations to conferences both local and international
(b) Notwithstanding clause(1)(a), the President shall have the power to appoint an
officer to head the delegation to a conference in the name of the SRC.
(c) The authority of the President shall extend to the execution and maintenance of
Article 4 of this constitution.
(d) The President shall represent the student body at the Board of Governors meeting.
(e) The President shall preside over all Executive meetings.
(f) The President shall be a signatory to the SRC bank account

(2) Before assuming office, the President shall take and subscribe before the general student
body, at a student gathering, the Presidential oath set out in schedule one of this
constitution.

Article twenty-nine (29)


PRESIDENTIAL MESSAGES.
The president shall, acting in consultation with the Executive Advisory Committee, at the
beginning of each semester and before dissolution of the Parliamentary Council, deliver to the
Parliamentary Council an address on the state of affairs of the SRC.

Article thirty (30)

THE VICE PRESIDENT


(1) The duties and functions of the Vice President shall include;
(a) Assisting the president in performance of his duties
(b) Acting in the absence of the president and when so acting shall perform specific
functions designated by the president
(c) Acting as ex-officio member of all committees of the SRC and shall coordinate the
activities of such committee provided for in this constitution.
(d) Notwithstanding any provision in this constitution, whenever the president dies,
resigns or is removed from office, the vice president shall assume office as president
for the unexpired term of office of the president with effect from the day of death,
resignation or removal of the president.

(e) Performing any other duties assigned by the President.


(f) The vice president shall be directly accountable to the president.

(2) The vice president upon assuming office as president under Article 30(1)(d) nominate a
person to the office of the vice president subject to approval by the Parliamentary Council

(3) The Vice President shall, on assumption of office, subscribe before the general student
body, at a public gathering Presidential oath set out in schedule one to this constitution.

Article thirty-one (31)


THE GENERAL SECRETARY
(1) The duties and functions of the General Secretary shall include
(a) Is responsible for the minutes of all Executive meeting and other official meetings
of the SRC,
(b) Carries out correspondence of the SRC and keeps copies thereof,
(c) Circulates notices and agenda of all SRC Executive meetings,
(d) Shall within 72 hours publish on all notice boards proceedings from all Executive
Council meeting.
(e) Prepare reports on the overall work of the SRC,
(f) Performs any other duties assigned by the President.
(g) Shall supervise all activities of the Public Relations Committee

(2) Before assuming office, shall take before the student body at a public gathering, the
Executive Officers oath set out in Schedule Two to this constitution

Article thirty-two (32)


THE TREASURER
(1) There shall be a treasurer who shall perform duties and functions which shall include;
(a) The receipt of all the monies and revenues accruing to the SRC and the
disbursement of such monies directly in consonance with annual budget approved
by the Parliamentary Council
(b) Taking charges of all financial transaction of the SRC in accordance with the
provision of this constitution.
(c) Publishing semester reports in respect to the financial status of the SRC.
(d) Keeping proper records of all financial transactions of the SRC.
(e) Being one of the signatories to the bank account of the SRC.
(f) Supervising the activities of the Finance and Appropriation Committee.
(g) Performing any other function assigned by the President

(2) Before assuming office, shall take before the student body, at a public gathering, the
Executive Officers oath set out in Schedule two to this constitution.

CHAPTER FOUR
COMMITTEES
Article thirty-three (33)
THE EXECUTIVE ADVISORY COMMITTEE
(1) There shall be an Executive Advisory Committee appointed by the Executive Officers
which shall comprise eight (8) members;

(a) Chairperson of the committee appointed by the Executive Officers


(b) Chief Cadet Captain
(c) One from each member state
(d) One from non-member state

(2) The role of the Advisory Committee shall be to advise the Executive Officers.
(3) The quorum of the Executive Advisory Committee shall be simple majority
(4) A member of the committee shall hold office until the end of term of office of the
president unless

(a) That member resigns by writing signed by him and addressed to the president; or
(b) Is removed from office or dies.

Article thirty-four (34)


DUTIES OF THE EXECUTIVE ADVISORY COMMITTEE
(1) Advising the executive officers in respect of any decision to be made, where specified in
this constitution.
(2) The Executive Advisory Committee shall perform any other function as may be assigned
by Executive Officers
(3) Subject to the provisions of this Constitution the Executive Advisory Committee may
regulate its own procedure which shall be consistent with the provisions of this constitution.
(4) The Executive Advisory Committee shall assess the Executive Officers on monthly basis
and make recommendations and advice accordingly.

Article thirty-five (35)


MEETING OF THE EXECUTIVE ADVISORY COMMITTEE
(1) The Executive Advisory Committee shall meet for the dispatch of its business at least once
every month for the dispatch of their duties
(2) The Committee shall also meet if requested by

(a) The Executive Officers


(b) The Parliamentary Council.

Article thirty-six (36)


COMMITTEES OF THE SRC
In pursuance of the objectives of the SRC, the Executives Officers of the SRC shall establish
student Committees and Commissions for the effective running of the SRC, which shall be
accountable to the Executive Officers and the Parliamentary Council provided the membership
shall not exceed 7 (seven). Except for the Publication and Information Committee and the
Intelligence and Student’s Affairs Committee.

Article thirty-seven (37)


APPOINTMENT OF CHAIRPERSONS OF COMMITTEES.
(1) The Executive Officers shall in consultation with the Executive Advisory Committee with
the approval of the Parliamentary Council appoint the chairpersons of-
(a) Electoral Commission
(b) Finance and Appropriation Committee
(c) Entertainment and Organising Committee
(d) Sponsorship and External Relations Committee
(e) Sports Committee
(f) Publication and Information Committee
(g) Intelligence and Students Affairs Committee
(h) Welfare Committee
(i) Mediation Committee
(j) The Women's Commission
(k) Any other Committee that may be established according to article 52.
(2) Notwithstanding clause (1) the Chairperson of the Audit Board shall be appointed by the
Parliamentary Council

Article thirty-eight (38)


FINANCE AND APPROPRIATION COMMITTEE
(1) There shall be a Finance and Appropriation Committee which shall pre-audit all financial
transactions of the Executive Officers or commission or committees involving amounts
in excess of five (5) United States Dollars or its equivalent as may be determined by the
Parliamentary Council
.
(2) The Finance and Appropriation committee shall comprise-

(a) The Finance and Appropriation Committee Chairperson;


(b) Any other person(s) nominated by the Executive Officers with advice from the
Executive Advisory Committee.

(3) The quorum of the finance committee shall be a simple majority.

Article thirty-nine (39)


DEFAULT BY FINANCE AND APPROPRIATION COMMITTEE
(1) Where there is a default on the part of the Finance Committee and such a default is found
by the Judicial Council to be due to willful neglect or refusal or incompetence or both of
the members of the Finance Committee or refusal to comply with this part of the
constitution every such member of the Committee shall cease forthwith to be a member
of the Finance Committee.
(2) Where the default is found to have been caused either wholly or in part by any Executive
Officer, such officer shall suffer the penalty as may be determined by the Audit Board.

Article forty (40)


NON-COMPLIANCE
Any person who whether intentionally or otherwise fails to abide by the provisions of this article
of this chapter shall, be liable to account for, or to any other punishment prescribed by the Judicial
Board.

Article forty-one (41)


DUTIES OF FINANCE AND APPROPRIATION COMMITTEE
(1) The Finance and Appropriation Committee shall;

(a) Encourage and promote the efficient utilisation of the resources of the SRC through
effective and efficient finance measures;
(b) Be responsible for monitoring the receipt and payments out of the students fund and
shall report to the Parliamentary Council every four weeks.
(c) Together with the Vice President of the SRC and the Coordinator of Student Affairs
form a tender board for the award of contracts on behalf of the SRC
(d) Shall review budget of all Commissions and Committees under the SRC and collate
same into a single budget to the Executive Officers for presentation to the
Parliamentary Council
(e) Shall perform any other duties assigned to it by the Treasurer
(2) The Finance and Appropriation Committee shall, not later than six weeks before the end of
each semester and three weeks after the beginning of each semester submit to the Audit
Board through the Executive Officers for audit, a statement of receipts and payments into
and from the Students fund.
(3) The Finance and Appropriation committee shall present bi-monthly reports to the
Parliamentary Council on all other contributions, their source, dates of receipt and all other
particulars of such contributions to the SRC or committees of the SRC.

Article forty-two (42)


THE AUDIT BOARD
(1) There shall be an Audit Board which shall consist of the Chairperson, Deputy Chief Cadet
Captain and three other members appointed by the Parliamentary Council provided that two
(2) of its members shall have adequate degree of knowledge in auditing and accounting.
(2) The account of the SRC and all other committees or institutions established under this
constitution or by a resolution of the Parliamentary Council shall be audited and reported
on by the Chairperson of the Audit Board to the Executive through the Parliamentary
Council.
(3) For the purpose of clause two (2) of this article, the Chairperson of the Audit Board or
any other person authorised or appointed for such purposes by the Chairperson of the
Audit Board shall have access to all books, records, returns and any other documents
relating or relevant to those accounts.
(4) For the purposes of its work, it shall be lawful for the Board to subpoena any person to
appear before it.

(5) Any person who knowingly or recklessly makes any statement either orally or in writing
to the Audit Board conveying the information or explanation required by the Board or to
which the Board is entitled and which is misleading, false or deceptive shall be liable to
any sanctions approved by the Judicial Board and/or the Parliamentary Council upon the
recommendation of the Board whichever may be appropriate.
(6) The findings of the Audit Board shall be communicated to the Executive Officers through
the Parliamentary Council together with its opinion as to the advisability or otherwise of
the transactions undertaken by the SRC committees and published on all notice boards
within seven working days after presentation to the Parliamentary Council.
(7) The SRC account(s) and all other committees or institutions established under this
constitution or by a resolution of the Parliamentary Council shall be audited at the end of
every first semester and in the case of the second semester a month before handing over.

Article forty-three (43)


INDEPENDENCE AND POWERS OF THE AUDIT BOARD.
(1) In the performance of its duty under the constitution or any other resolution by the
Parliamentary Council not inconsistent to this constitution, the Audit Board;

(a) Shall not be under control of or subject to the direction of any other person or
authority;
(b) Shall disallow any item of expenditure which is contrary to the provisions of this
constitution or any resolution of the Parliamentary Council and surcharge, the
amount of expenditure disallowed upon a person responsible for incurring or
authorising expenditure or any amount of any loss or deficiency, upon any person by
whose negligence or misconduct the loss or deficiency has been incurred.
(2) A person aggrieved by a disallowance or surcharge made by the Audit Board may appeal
to the Judicial Board.
(3) The Parliamentary Council may by resolution through the Coordinator of students Affairs,
request the Academic Registrar to withhold the results or awards of any such students who
refuses to conform to the provisions of this article.

Article forty-four (44)


ADMINISTRATIVE EXPENSES OF THE BOARD
(1) The administrative expenses of the Board shall be charged on the students’ fund.
(2) The account of the audit board shall be audited and reported upon by an external auditor
appointed by the Parliamentary Council.

Article forty-five (45)


THE ENTERTAINMENT AND ORGANISING COMMITTEE
(1) There shall be an Entertainment and Organising Committee which shall oversee the
organisation of all SRC entertainment activities on campus and shall plan and organise the
SRC Week Celebration whenever the SRC week is about to be celebrated.
(2) The Entertainment and Organising Committee shall at the beginning of each semester,
draw up and present a programme of activities to the Executive Officers with prior approval
of the Parliamentary Council which shall be published on students notice boards.
(3) A person shall be appointed to be a member of the Entertainment and Organising
Committee by the Entertainment and Organising Committee Chairperson in consultation
with the members of the Executive Committee.
(4) The Entertainment and Organising Committee shall, in compliance with the provisions of
this constitution, present accounts of all proceeds accruing to it to the Finance Committee,
and pay into the Students’ Fund through the Treasurer, any monies received or had or
accruing to the Entertainment Committee in accordance with the provisions of this
Constitution.
(5) The Entertainment and Organising Committee shall form the SRC Week Planning
committee.

Article forty-six (46)


SPONSORSHIP AND EXTERNAL RELATIONS COMMITTEE
(1) There shall be a Sponsorship and External Relations Committee which shall liaise on behalf
of the SRC with players in the maritime industry.
(2) The Committee shall be responsible for seeking sponsorships for the SRC.
(3) The Chairperson in the absence of the Presidency shall represent the SRC in any gathering
related to sponsorship or fostering good relationship with players in the maritime industry.
(4) The Sponsorship and External Relations committee shall facilitate the invitation of
resource personnel for all SRC activities.
(5) A person shall be appointed to be a member of the Sponsorship and External Relations
Committee by the Sponsorship and External Relations Committee in consultation with the
members of the Executive Committee.

Article forty-seven (47)


PUBLICATION AND INFORMATION COMMITTEE
(1) There shall be a Publication and Information Committee which shall be charged with the
responsibility of;

(a) Ensuring the effective and efficient running of all SRC public relations, media
station, e-mail, website and any other as may deem necessary.
(b) Publishing of the SRC Magazine at least once every academic year;
(c) Making effective publicity and advertisement of all SRC activities;
(d) Liaising with the SRC Week Planning Committee in advertising and publicizing
the SRC week celebration.
(2) A person shall be appointed to be a member of the Publication and Information Committee
by the Publication and Information committee chairperson in consultation with the
members of the Executive Committee.
(3) There shall be an Editorial Board, formed from the members of the Publication and
Information Committee. The members shall be:

(a) The Editor-In Chief


(b) Two Editors
(c) Production Manager
(d) Cartoonist
(e) Treasurer of the Editorial Board who shall be the Deputy Chairperson of the
Finance and Appropriation committee.
(f) Any other member appointed by the Publication and Information Committee
Chairman, upon consultation of the Executive Committee.
(g) Performance of any other duties assigned to it by the Executive Officers or the
Parliamentary Council.

(4) The magazine shall be sold to all students and the general public at a price to be
recommended by the committee.
(5) The Chairperson of the committee shall submit the account of the committee to the Finance
Committee according to the provisions of this constitution.
(6) The Chairperson of the Publication and Information Committee shall be the Press Secretary
to the SRC and shall oversee to all public relation issues of the SRC including preparation
of press conference and release of relevant information required by the Parliamentary
Council as the Executive Committee may direct.

(7) The chairperson of the Publication and Information committee shall be called the Public
Relations Officer (P.R.O) and shall act in the absence of the General Secretary.

Article forty- eight (48)


WELFARE COMMITTEE
(1) There shall be a welfare Committee that shall be responsible for;

(a) Ensuring the welfare of the students.


(b) The determination of honorarium to be given to executive members,
parliamentarians, as well as the SRC committee members who may during the
vacation be required to stay on campus to execute the programs and projects of the
SRC.
(c) Develop strategies and solutions to address the overall health and sanitary matters
affecting students in the accommodations, sickbay, all eating places on campus and
all other areas on campus.
(d) Investigate cases relating to students boarding and lodging, health and sanitation
services and report its findings to the Parliamentary Council for necessary actions to
be taken
(e) Liaise with the University Sick bay on matters affecting student’s health.
(f) Assist in academic related matters affecting students.
(g) Formulate and implement policies aimed at improving the welfare conditions of
physically challenged students.
(h) The determination and payment of honoraria of Executive officers,
Parliamentarians as well as committees of the SRC, at the end of the semester after
performance of their duties and roles upon approval by the Parliamentary Council.
(i) Be responsible for the allocation of SRC rooms, upon consultation with the
Executive Officers.
(j) Performance of any other duties assigned to it by the Executive Officers or the
Parliamentary Council.
(k) A person shall be appointed to be a member of the Welfare Committee by the
Welfare Committee Chairperson in consultation with the members of the Executive
Committee.

Article forty-nine (49)


INTELLIGENCE AND STUDENT AFFAIRS COMMITTEE
(1) There shall be an Intelligence and Students Affairs Committee which shall be the think-
tank of the SRC.
(2) Membership of this committee shall include;

(a) The Legal Advisor who shall be the Chairperson


(b) The General Secretary, who shall be the Secretary
(c) One representative from each department.

(d) Three (3) other persons appointed by the Executive Officers.


(3) The Treasurer of this committee shall be appointed by the Executive Officers.
(4) The Intelligence and Students’ Affair Committee shall subject to provision of this
constitution have the responsibility to

(a) Conduct surveys on the nature of teaching, research and content of courses,
conduct of examination and the availability of books and equipment to students.
(b) Be responsible for organizing an inter-faculty debate and/or quiz competition
every academic year in consultation with the Executive Committee.
(c) Perform any other function that may be assigned to it by the executive officers or
Parliamentary Council.
(5) Pursuant to the provision of this article the Intelligence and Students Affairs Committee
shall have no restrictions to documents available at any student structure and shall exercise
the right to information as enshrined in the institutional documents of this university which
affects either directly, the welfare or interest of students in this university.

(6) Notwithstanding any provision of this constitution, the performance of the duties of the
Intelligence and Students Affairs Committee shall be subject to the provisions of this
constitution and shall report directly to the Executive Committee through the President.

Article fifty (50)


MEDIATION COMMITTEE
(1) There shall be a mediation committee that shall be composed of members appointed by
the Executive Officers provided that such persons shall be heads of religious
denominations.
(2) The Mediation Committee shall be a facilitator in the prevention of conflicts and
resolution of conflicts between and among students, the SRC and administration of this
university.
(3) In performance of its functions, the Mediation Committee shall be accorded all the
recognition, respect and audience by all student structures or the administration of this
university.
(4) Any person or body of persons wishing to appear before the Mediation Committee shall
submit a petition addressed to the Chairperson of the Committee who shall convene a
meeting of such parties within seventy-two hours after receipt of petition provided that
where the Mediation Committee is seized of a matter, no other person or group of persons
shall take up the matter.
(5) The award of this committee shall be binding on parties appearing before it unless appeal
is made before it to the Judicial Board on grounds of bias or error.

Article fifty-one (51)


THE WOMEN’S COMMISSION
(1) There shall be a Women’s Commission which shall consist of the following core
members:
(a) The Women’s Commissioner;
(b) A female representative from each year group;
(c) A female departmental association executive representative;
(d) A female representative of the cadet corps.
(2) The commission shall be charged with:
(a) Aiding female students in realizing themselves as an important resource so as to
contribute to the advancement of society;
(b) Assisting in finding solutions to women’s related problems;
(c) Helping to prepare the female student for more responsible and responsive role in
life after school;
(d) Serving as a link between female students and other groups with the view of
sharing ideas and strategies on issues concerning women;
(e) Inculcating in female students a sense of inclusion, solidarity and active
participation in campus activities;
(f) Helping to raise self-esteem and self-confidence of female students;
(g) Improving and strengthening communication and co-operation between the sexes;
(h) Creating a platform for re-kindling the potentials of female students.
(3) Every female in the University shall be a member of the women’s Commission.
(4) Without prejudice to clause (3) of this article, any male student desiring to be an affiliate
member of the women’s Commission may apply to the office of the Women’s Commission
for consideration.
(5) The Women’s Commissioner shall be a member of the Executive Body of all female
Associations.

Article fifty-two (52)


AD-HOC COMMITTEE
(1) Notwithstanding the provisions of this constitution the Executive Committee shall have the
power to create sub or Ad-hoc committees to deal with any matter in pursuit of its aim.
(2) Without prejudice to any provision of this constitution, the Executive Committee shall have
the power to co-opt students from outside the SRC to serve on any such committee.

Article fifty-three (53)


REPORTS TO THE PARLIAMENTARY COUNCIL.
Any person nominated by the Executive Committee and approved by the Parliamentary Council
to serve on any committee in this university of which the SRC has representation or any committee
or commission of the SRC shall report to the Executive Committee through the Parliamentary
Council.

Article fifty-four (54)


PRESENTATION OF REPORTS
(1) Every committee shall present a written report to the Parliamentary Council at the
beginning and ending of each semester.
(2) Reports shall be presented by the Chairperson of the committee or commission.
(3) In the absence of the Chairperson, any member who has been empowered by the
Chairperson of such a committee or commission shall present the report.

Article fifty-five (55)


MODUS OPERANDI OF COMMITTEES
(1) In the absence of the Chairperson of the committee or commission, the Deputy Chairperson
shall assume full responsibility for the committee or commission.
(2) Every committee, shall, subject to the provisions of this constitution or a resolution of the
Parliamentary Council operate its own procedures to perform its functions.

Article fifty-six (56)


RESPONSIBILITY OF COMMITTEE MEMBERS
Any person appointed to any committee, commission or office who misappropriates any funds; or
conducts himself in such a manner, as to cause depreciation, whether in respect of loss or otherwise
in any cash or property entrusted to him; shall be liable to any punishment to be prescribed by the
Parliamentary Council.

CHAPTER FIVE
REMOVAL FROM OFFICE
Article fifty-seven (57)
GROUNDS FOR REMOVAL
(1) Any elected or appointed officer of the SRC shall be removed from office if found, in
accordance with the provision of this article-

(a) To have acted in violation of the oath of office set out in schedule one to this
constitution, or in violation of this constitution;
(b) To have conducted him/ her self in a manner-
i. Which brings the office into disrepute, ridicule or contempt,
ii. Prejudicial or inimical to the interest of students.
(c) To be incapable of performing the functions of his/her office by reason of infirmity
of body or mind confirmed by a certified Medical officer of the university’s
hospital.
(d) To have embezzled funds or mishandled the finance of the SRC.
(e) To be inefficient or negligent in the discharge of his/her duties.
(f) To be non-regular attendant of SRC meetings.
(g) To have deferred his course of study in the university.
(h) To be suspended or dismissed from the university

Article fifty-eight (58)


IMPEACHMENT
(1) 10% of the student of the SRC shall by notice in writing addressed to the speaker,
commence impeachment proceedings against an Executive Officer provided that the officer
shall be served with a copy of the notice, five (5) working days before start of such
proceedings.
(2) The Speaker shall within five (5) working days of receiving notice of impeachment,
convene a sitting of the Parliamentary Council for a determination of the grounds for
impeachment.
(3) Where the prime facie case has been established by the Parliamentary Council, the Speaker
can commence impeachment proceedings.
(4) Any Executive Officer so impeached shall forthwith cease to be a member of Executive.

(5) Any vacancies created by the virtue of any provision of this constitution shall be filled
within twenty-one days after such vacancies are created.

Article fifty-nine (59)


VOTE OF NO CONFIDENCE
(1) Without prejudice to (article 57 and 58) of this Constitution, Executive Officers and
Leaders of the Parliamentary Council shall be removed from office on passing a vote of no
confidence by at least three (3) year groups in the University at a special meeting called for
such purposes under the supervision of the Electoral Commission provided that, within
seven (7) days of a year group passing the vote of no confidence, two other year groups
shall pass a resolution on the same.
(2) For the purposes of clause (1) of this article, twenty percent (20%) of students drawn evenly
from all year groups shall submit a request duly signed to that effect to the Judicial Board
and copied to the Officer
(3) The Judicial Board upon receiving the request, shall examine, cross check and verify the
names and signatories of the said group of students.
(4) Such request shall contain the grounds for the Vote of No Confidence and accompanied
with evidence.
(5) The Judicial Board after seven (7) days of verification shall, if satisfied with the names,
signatories and evidence provided, authorize the Electoral Commission to organise the
Vote of No Confidence.
(6) The Executive Officer or Leader of the Parliamentary Council referred to in clause (1) of
this article shall have the right of reply within twenty- four (24) hours before the meeting
is conducted and shall attend any meeting convened for the purpose of passing such a Vote
of No Confidence.
(7) The Electoral Commissioner shall within twenty-four (24) hours notify the Coordinator of
Students Affairs, Executive Officers, Parliamentary Council and the Judicial Council of
the outcome of the vote.

Article sixty (60)


REMOVAL OF LEADERSHIP OF THE PARLIAMENTARY COUNCIL
The Speaker, Deputy Speaker or Clerk of the Parliamentary Council shall, if found to have been
inefficient in the performance of their duties, be removed from office by a two-thirds majority of
the Parliamentary Council.

Article sixty-one (61)


REMOVAL OF MEMBERS OF THE PARLIAMENTARY COUNCIL
(1) A constituency shall have power to withdraw or remove it representative in the
Parliamentary Council provided that such exercise shall be conducted through a resolution
properly passed by the constituency.
(2) Where such resolution shall be a signatory of 50% +1 of members of the constituency with
reasons addressed to Judicial Council.

(3) The Parliamentary Council shall expel its member after he/ she is found guilty of contempt
of the Parliamentary Council.

Article sixty-two (62)


REMOVAL OF COMMITTEE HEADS
(1) The right to terminate the appointment of a committee head shall be the sole right of the
President.

(2) Notwithstanding clause (1), the Electoral Commissioner shall be removed from office by
an order to that effect by the Judicial Council which shall consider a case brought against
the said officer.

CHAPTER SIX
ELECTIONS
Article sixty-three (63)
ELECTION OF THE EXECUTIVE OFFICERS
(1) A Student shall be a candidate in any election if he or she is nominated for election as
President, General Secretary or Treasure by a document which
(a) Is signed by him/her.
(b) Is signed by not less than 5% of the students’ body and
(c) Is delivered to the Electoral commission on or before the day fixed for the close of
nomination in relation to the election.
(2) The elections of the Executive officers shall be on the terms, of secret ballot vote and shall,
subject to the provisions of this constitution, be conducted in accordance with such
regulations as may be prescribed by a constitutional instrument issued by the Electoral
commission and shall be held as to begin.
(a) Where the Executive officers are in office, six weeks before the commencement of
examination.
(b) In any other case, twenty-one days after the office of the President, General
Secretary or Treasurer becomes vacant and shall be held at any such place and shall
begin on such dates as the Electoral Commission shall, by a constitution instruments
prescribe, not being inconsistent with this constitution.
(c) Notwithstanding 2(a)(b), no election shall be conducted to fill a vacancy in the
second semester; however, where a vacancy is created in the first semester, the
mode of replacement shall be as provided for in article 58(5) of this constitution.

Article sixty-four (64)


QUALIFICATIONS
(1) A student shall qualify for elections to any executive office if he/she;
(a) has been a student of this University for at least one Academic Year and is not in
his/her final year of study.
(b) has not been found guilty of embezzlement and or misappropriation of students or
university funds by any judicial committee or by any quasi-judicial committee set up
by the SRC or the University.
(c) has not been impeached, suspended, or dismissed as an officer of any association,
society, union, or club.

(d) has not been found guilty of violation of this Constitution and contempt of the
Judicial Council or offence of this Constitution.
(e) shall submit himself for public vetting by a vetting panel that shall be set up in a
manner provided in this Constitution.
(g) shall have attained a CGPA of 2.8 without any trails as the time of filing of
nomination
(2) A student shall not be qualified to be an Executive Officer if he/she;
(a) has been adjudged or otherwise declared to have misappropriated funds or conducted
himself in such a manner as to cause depreciation in respect of loss or otherwise in
any cash or property entrusted to him.
(b) has been found by any committee of enquiry to be incompetent to hold office or is a
person in respect of whom a committee of enquiry has found out that while holding
office he has acquired assets unlawfully or defrauded the SRC or misused or abused
his office, or wilfully acted in a manner prejudicial to the interests of students and
the findings have not been set aside on appeal or official; or
(c) has once been removed from any student office in this university.
(3) Final year students shall be defined to include all who receive a degree or diploma or
certificate awards at the end of the academic year in which elections are being held
(4) No student shall be elected as an executive officer unless at such election, the number of
votes cast in his/her favour is more than fifty percent (50+1) of the total number of valid
votes cast at the election in the case of the president and simple majority for the General
Secretary and the Treasurer
(5) Where no candidate scores more than fifty percent of the valid vote cast, in the case of the
President, there shall be a run-off of the election between the first two candidates with the
highest number of votes within seven days until a winner emerges.

Article sixty-five (65)


AN INSTRUMENT
(1) An instrument which
(a) Is executed under the hands of the Chairman of the Electoral Commission and under
the seal of the commission; and
(b) State that the person named in the instrument was declared elected as an Executive
Officer at the election shall be the prima facie evidence that the person was so elected,
(2) The Electoral Commission shall, immediately after an election, declare provisional results
and unless or until such result are challenged, as provided for under article 66 of this
constitution, shall declare the final results within seventy-two hours after the election

Article sixty-six (66)


CHALLENGING OF ELECTION.
(1) The validity of the election of an Executive Officer may be challenged by a student of this
university who may present a petition for the purpose to the Judicial Council within forty-
eight hours after the declaration of the final result of the position in respect of which the
petition was presented
(2) The Judicial Council shall, without prejudice to any provision of this constitution, decide
on the validity of an election within seven days after the petition has been received by the
Chairperson of the board.
(3) The Electoral Commission shall by Constitutional Instrument make regulations for the
purposes of giving effects to articles 63 and 64 of this constitution.

Article sixty-seven (67)


TENURE OF OFFICE OF THE EXECUTIVE OFFICERS.
(1) A student elected as an Executive Officer shall, subject to clause three (3) of this article,
hold office for a term of one academic year.
(2) Notwithstanding clause one (1) of this article, the Executive Officers shall, hand over to
the newly elected Executive Officers within fourteen days after declaration of the final
election results.
(3) The office of an Executive Officer shall become vacant
(a) On the expiration of the period specified in clause (1) of this article.
(b) If the incumbent dies or resigns from office or ceases to hold office under articles
57,58, and 59 of this constitution.

Article sixty-eight (68)


THE ELECTORAL COMMISSION
(1) There shall be an Electoral Commission which shall consist of
(a) A Chairperson who shall be the Electoral Commissioner of the SRC;
(b) 1st Deputy Commissioner

(c) 2nd Deputy Commissioner


(d) Four (4) other members appointed by the commissioner from among levels 100,
200, 300 and 400.
(2) The secretary to the commission shall be elected from among members

(3) Without any doubt the four other members in clause (1)(d) of this article shall represent
the four (4) year groups respectively.
(4) The out-going Electoral Commissioner shall hand over to the Electoral Commissioner
designate within seven (7) days after appointment.

Article sixty-nine (69)


QUALIFICATION OF THE ELECTORAL COMMISSIONER.
(1) A student is qualified to be appointed commissioner if he is qualified to be elected as an
Executive Officer.
(2) The Electoral Commissioner shall be appointed by the Executive Officers, acting in
consultation with the Executive Advisory Committee, subject to the approval of the
Parliamentary Council

Article seven (70)


FUNCTIONS OF THE ELECTORAL COMMISSION
(1) The Electoral Commission shall be responsible for conducting and supervising all SRC
elections including elections of constituency representatives to the Parliamentary Council
and referendum.
(2) The Electoral Commission shall perform such other functions as may be prescribed by a
resolution of the Parliamentary Council not inconsistent with the provisions of this
constitution
(3) Ensure publication of rules and regulations governing the conduct of election when
opening nominations for elections.
(4) Education of students on electoral process.
(5) Compilation of voters register and revising it when necessary.

Article seventy-one (71)


INDEPENDENCE OF THE ELECTORAL COMMISSION
Except as provided in this constitution or in any resolution of the Parliamentary Council not
inconsistent with this constitution, in the performance of its functions, the Electoral
Commission shall not be subjected to the direction of control of any person or authority.

Article seventy-two (72)


RULES AND REGULATIONS FOR ELECTION.
The Electoral Commission shall by constitutional instrument make rules and regulations for the
effective performance of its functions under this constitution or any resolution of the Parliamentary
Council. Such rules and regulations shall be annexed to this constitution as a schedule 4.

Article seventy-three (73)


EXPENSES OF THE COMMISSION.
The organizational expense of the Electoral Commission shall be charged on the students’ fund.

Article seventy-four (74)


VETTING COMMITTEE
(1) There shall be a vetting committee which shall be chaired by the Electoral Commissioner
and the conduct of vetting shall be made public to the whole student body.
(2) The Vetting Committee shall be responsible for ensuring that candidates for any elections
under this constitution satisfy the requirement provided for in this constitution, or a
resolution of the Parliamentary Council or regulation of the electoral commission.

COMPOSITION OF THE VETTING COMMITTEE
(1) The vetting committee shall comprise-

(a) The Electoral Commissioner


(b) One of the Deputy Commissioners
(c) Two members of the Parliamentary Council
(d) Presidents of the various Departmental Associations

JUDICIAL COUNCIL
Article seventy-six (76)
THE SRC JUDICIAL COUNCIL
(1) There shall be Judicial Council, which shall be composed of
(a) The Chief Justice
(b) The Disciplinary Committee Chairperson of the Cadet Corps
(c) Justices of the various Departmental Associations
(2) The Chief Justice of the judicial council shall be appointed by the Executive Officers in
consultation with the Executive Advisory Committee, subject to the approval by the
Parliamentary Council.

Article seventy-seven (77)


QUALIFICATION OF THE CHIEF JUSTICE
(1) A student appointed Chief Justice of the SRC

(a) Must be a third-year student


(b) Must have good knowledge of the constitution
(c) Must be qualified to be elected as an Executive Officer.

Article seventy-eight (78)


INDEPENDENCE OF THE JUDICIAL COUNCIL.
(1) In the exercise of it functions, the judicial council shall be subject to this constitution only
and shall not be under control or direction of any person or authority.
(2) All students, department and committees shall accord the judicial council such assistance
as it may reasonably require in protecting its independence, dignity and effectiveness
subject to this constitution.
(3) A member of the judicial council shall not be liable to any action or suit for any act of
commission by him in the exercise of his/her assignment.

Article seventy-nine (79)


OPERATIONAL FIELD
(1) The Judicial Council shall have jurisdiction in
(a) All matters relating to the enforcement or interpretation of this constitution.
(b) All matters arising as to whether a resolution was made or, a person or authority
has acted in excess of the power conferred on it by this constitution or any other
provisions made hereunder;
(c) All matters relating to elections under this Constitution.
(d) settling dispute(s) between two or more students’ associations of this University.
(e) settling disputes between two students
(f) giving a hearing on issues between the SRC and a STUDENT
(g) sitting on all matters referred to it by associations, clubs, societies, unions etc
(2) In the exercise of its functions the Judicial Council shall have power to give advisory
opinion to the Executive Advisory Committee, the Executive Officers, Parliamentary
Council, and Committees of the SRC on any legal issue on request.

Article eighty (80)


MODE OF EXERCISING OFFICIAL POWER.
(1) The judicial council shall be constituted for its works by not less than two-thirds members.
(2) The Chief Justice of the SRC shall preside at the sitting of the Judicial Council and in his
absence; a member nominated by other members of the committee shall preside.
(3) In all matters unless specifically provided to the contrary, the decision of the Judicial
Council shall be by simple majority.
(4) The judicial council shall, in exercise of this functions be bound to give written reasoning
for its decisions.

Article eighty-one (81)


CHARTERS OF R.M.U
Notwithstanding Article 78 (1), (2) of this constitution in the exercise of its functions, the judicial
council shall be guided by the charter establishing Regional Maritime University, other operational
documents and laws of Ghana.

Article eighty-two (82)


TENURE
(1) The Chief Justice and other members of the Judicial Council shall hold office for a period
of one academic year.
(2) Without prejudice to clause one (1) of this article, the terms of office of the members of
the Judicial Council shall expire five days after the first sitting of the Parliamentary
Council and provided the Parliamentary Council approved the student nominated as the
Judicial Council.
(3) The Chief Justice and other Members of the judicial council shall before assuming office,
take and subscribe to the official Oath, as provided for in schedule one of this constitution
before the Parliamentary Council at a special sitting where the Executive Officers,
members of the Executive Advisory Committee are all present for that purpose not later
than forty-eight (48) hours after the expiration of the term of the out-going members.
(4) A member of the Judicial Council shall cease to hold office-
(a) If he is unable to perform the functions of his office whether arising from infirmity
or mind; or
(b) For stated misbehaviour or incompetence, provided that the member against whom
the petition is made is entitled to be heard in defense by himself or by a counsel or
other experts of his choice before the Appeal Board.
(c) If he/she no longer occupies the position of Justice of his departmental association
or Disciplinary Committee Chairperson of the cadet corps

Article eighty-three (83)


THE APPEALS BOARD
(1) Without prejudice to any provision of this Constitution, an appeal shall lie as of right from
a judgment or order of the judicial board/ council to the Appeals Board whose decision
shall be final.
(2) The Appeal Board shall consist of;
(a) The SRC Legal Advisor who shall be the Chairperson
(b) The Chief Justice, in his absence a member nominated by other members of the
Judicial Council.
(c) any other competent student nominated by the executives.
(3) The Appeal Board shall be constituted for its work by three members.
(4) The decision of the Appeals Board shall be by simple majority.

Any person appearing before the Judicial Council or the Appeals Board shall have the right to

CHAPTER EIGHT
FINANCE
Article eighty-five (85)
THE STUDENTS FUNDS
(1) There shall be paid into a Student Fund, subject to the provisions of this article
(a) All revenues or other monies raised or received for the purposes of, or on behalf of
the SRC
(b) Any other monies raised or received in trust for, or on behalf of, the SRC.
(2) The revenues or monies referred to in clause one (1) of this article shall not include
revenues or other fund or for specific purposes; or
(a) That are payable by or under a resolution of the Parliamentary Council into some
other fund or for specific purposes; or
(b) That maybe by or under resolution of the Parliamentary Council, is retained by a
committee of the SRC for the purposes of defraying the expenses of that committee.
(3) For the avoidance of doubt, it is hereby declared that any committee or commission of the
SRC, shall within seventy-two (72) hours of raising or receiving any revenue or other
monies for the purposes of or on behalf or in trust, unless the Parliamentary Council by a
resolution states otherwise, pay through the Treasurer such revenues or moneys into the
Students Fund.
(4) Notwithstanding clause three (3) of this article, a committee or commission may with prior
approval of the Parliamentary Council, retain a percentage of revenues or monies received
or had in accordance with clause (2) of this article.

Article eighty-six (86)


WITHDRAWAL FROM STUDENTS FUND.
(1) No monies shall be withdrawn from the Student Fund except to meet the expenditure
charged on the fund by this constitution or by a resolution of the Parliamentary Council
(2) The SRC shall operate current accounts with any bank by resolution of the Parliamentary
Council be determined.
(3) Any receipt into or withdrawal from the Students Fund by any document whatsoever shall
be authenticated by the signatures of the President, the Treasurer and Finance Committee
Chairperson of the SRC.

Article eighty-seven (87)


BUDGETS
(1) The Treasurer shall present a prepared budget to the Parliamentary Council four (4) weeks
from the beginning of each semester, estimates of revenues and expenditure of the SRC or
committees of the SRC for that semester.
(2) The proposed estimates of any committee shall be classified under programs or projects of
the SRC and shall be presented to the Parliamentary Council to provide for the issues from
the Students Fund or such other appropriate fund, of the sum of money necessary to meet
that expenditure on the appropriation of those sums for the purposes specified.
(3) Where, in respect of the semester, it is found that the amount of monies appropriated for
any purpose is insufficient or that a need has arisen for expenditure for that purpose for
which no sum of money has been appropriated, supplementary estimate showing the sum
of money required, shall be presented to the Parliamentary Council for approval.
(4) Notwithstanding the provisions of the preceding clauses of this article, the president may
have cause to prepare and present to the Parliamentary Council, estimates of revenue and
expenditure of the SRC for periods of over one semester for development or long-term
purposes.

ARTICLE eighty-eight (88)


EXPENDITURE IN ADVANCE OF APPROPRIATION
Where it appears to the President that the estimate in respect of any semester will not come into
operation by beginning of the semester he may, with prior approval of the Parliamentary Council,
authorize, the withdrawal of monies from the Students Fund for the purpose of meeting
expenditure of the SRC for the purpose of meeting.

Article eighty-nine (89)


LOAN
(1) No loan shall be raised for, or on behalf of the SRC or any committee or commission
otherwise by or under authority of a resolution of the Parliamentary Council.
(2) A resolution of the Parliamentary Council passed in accordance with clause one (1) of
this article shall provide
(a) That the terms and conditions of a loan shall be presented to the Parliamentary
Council and shall not come into operation unless they have been approved by the
Parliamentary Council and
(b) That any monies received in respect of that loan shall be paid into the students’ fund.

Article ninety (90)


SOURCE OF FUNDING
The Executive Officers with approval from the Parliamentary Council
(1) Solicit for funds through donations, organized dinners/gala nights and others as may be
deemed appropriate.
(2) Shall determine the amount of money to be paid by students as a semester dues.

CHAPTER NINE
Article ninety-one (91)
FORA AND PRESS CONFERENCES
(1) The SRC Executive Committee/Council shall, at any time the need arises, convene a formal
general meeting of the student body at designated places for the sole purpose of discussing
or announcing matters that affect the general welfare of the student body provided the
business to be discussed shall be made known at least forty-eight (48) hours to the meeting.
(2) One-third (1/3) of the student body shall form a quorum.
(3) The President, acting on the advice of the P.R.O and in consultation with the Executive
Council, shall have the prerogative to hold press conferences as and when the need arises.
(4) The theme for the press conference shall be notified to the Parliamentary Council before
the date fixed for the press conference.
(5) Students, any affiliated body of the SRC shall write to notify the speaker through the clerk
to convene for such conferences provided the reasons are attached.

Article ninety-two (92)


INVITATION TO PROGRAMMES
(1) The Executive Committee in consultation with the Speaker of the Parliamentary Council
shall have the power to nominate delegates, representatives or participants to any
conferences, congresses, seminar etc. to which the SRC have been invited.
(2) The delegates, representatives or participants shall present a written report to the
Parliamentary Council through the Speaker after such conference, seminar, etc. before the
next sitting of the Parliamentary Council
(3) The report may be published by the Public Relations Officer on all notice boards as may
be directed by the Parliamentary Council.
(4) All invitations to SRC programs shall be subject to the approval of the Parliamentary
Council and the Executive Council.

Article ninety-three (93)


SPECIAL FORUM
(1) A special forum of the student body shall be called by the Executive Committee on the
request of not less than 20% of students on a campus who shall append their names and
signatures to the written request stating the business to be considered.
(2) No other business shall be transacted at such a special forum, which shall be convened
within seventy-two (72) hours upon receipt of the request.
(3) Matters of impeachment shall not form the basis for such a forum, such matters being the
proper domain of the Judicial Board.

Article ninety-four (94)


MISCONDUCT
(1) A person appointed/elected to any Committee, Commission or Board of the SRC who:
(a) Misappropriates funds; or
(b) Conducts himself in such a manner as to cause depreciation whether in respect of
loss or otherwise in any cash or property entrusted to his care; shall be liable to make
good the loss or be liable to any punishment to be prescribed by the Executive
Officers in consultation with the executive council on a resolution from the
Parliamentary Council.
(2) Where such a default is found by the Judicial Council to be due to the willful neglect or
refusal to comply with any part of this Constitution, the Judicial Council shall recommend
sanctions against such a person.
(3) Where the default is found to have been caused either wholly or partly by any Executive
Officer, such a member shall suffer any penalty as may be determined by the Judicial
Council.

CHAPTER TEN
CERTIFICATE OR AWARDS
Article ninety-five (95)
CERTIFICATE OR AWARDS.
(1) Certificates of honour or awards shall be presented to the Executive Officers, members of
the Executive Advisory Committee, the Parliamentary Council, Legal Advisor, and
Judicial Council upon the successful completion of their tenure of office at a ceremony to
be held public. All committee members and individuals who have contributed to the cause
of students shall be entitled to Certificates and Awards.
(2) Any person who has been an Executive Officer and has successfully completed his tenure
of office shall be an elder statesman.
(3) Notwithstanding clause two (2) of this article, any person, student or otherwise who has
been a member of the Parliamentary Council or any committee or has contributed
significantly to the welfare of students shall apply for Statesman status.
(4) The Executive Officers shall refer the matter to the welfare Committee which shall hold
preliminary enquiry into this application.
(5) A Certificate of Honour of an Elder Statesman with a citation enumerating his contributions
to the interest of students may be awarded to any five (5) persons in a particular year.
(6) Without prejudice to any provision of this constitution, no special privileges shall go with
status of an Elder Statesman except that recognition, audience and honour shall be accorded
to such person at a function of the SRC.
(7) A book of Honour of the Elder Statesman shall be kept in the offices of the SRC in which
the names and other particulars together with citation of Elder Statesmen shall be recorded
and preserved.
(8) Within four weeks of coming into force of this constitution, there shall be a Boards of
Honour erected in the SRC office on which shall be embossed the names of successive
Presidents, Vice Presidents, Secretaries and Treasures who successfully completed their
tenure of office.
(9) The Board of Honour shall be updated every academic year beginning from 2011.

CHAPTER ELEVEN
AMENDMENTS AND REVISION
Article ninety-six (96)
AMENDMENT PROCESS
(1) Any student shall petition the Chief Justice for the amendment of any provision of this
Constitution.
(2) Such petition shall be accompanied by a Schedule containing the names, academic year,
course and signatures of one hundred (100) students with at least twenty (20) from each
year group.
(3) The Chief Justice shall constitute a committee of three (3) members from the judicial
committee which shall sit within fourteen (14) days on the receipt of such a notice.
(4) The Judicial Council shall report its decision for amendment or otherwise to the Executive
Committee which shall within three (3) days of receipt of such a report submit it to the
Parliamentary Council for debate. Sitting of Parliamentary Council for the purposes of the
debate shall be decided by two thirds (2/3) of the members present and voting under the
supervision of the electoral commission.
(5) Notice of Articles and clauses so amended shall be published on all notice boards for 72
hours for all follow ups before the president finally assents to it.
(6) The decision of Parliamentary Council for the amendment shall be served on the President
in the form of a resolution bill for him to assent.

Article ninety-seven (97)

REVISION
(1) Any Student shall petition the Chief Justice for a total revision of this Constitution.
(2) Such petition shall be accompanied by a Schedule containing the names, academic year,
course and signatures of one hundred (100) students with at least twenty (20) from each
year group.
(3) The Judicial Council shall sit within seventy-two (72) hours on the receipt of such a petition
to consider its merits or otherwise.
(4) In the event where merit is found in such a petition, a Constitution Review Committee shall
be set up by the Chief Justice to solicit and collate views of students to review the
Constitution.
(5) The Constitution Review Committee shall prepare a draft constitution and a report and
forward same to the Executive Committee which shall within seven (7) days of receipt of
such draft constitution and report, submit it to the Parliamentary Council for debate.

(6) A Parliamentary Council sitting for the purposes of the debate shall be decided by two
thirds (2/3) of the members present and voting.
(7) No revision shall be deemed to have been made unless after the vote of the Parliamentary
Council of which two thirds of members are present, majority of the students in this
university vote in a referendum for the revision and the amendment is signed by the
President.
(8) Any revision process of this constitution by a resolution of the Parliamentary Council shall
be assented by the President only if it is
(a) Accompanied by an official document from the Speaker that two thirds of the
Assembly voted in support of the revision.
and
(b) It is accompanied by a credential from the Electoral Commissioner and bearing the
seal of the commission that the revision was approved at a referendum in accordance
to this chapter.

CHAPTER TWELVE
MISCELLANEOUS

Article ninety-eight (98)


COPIES OF THIS CONSTITUTION
(1) Copies of this constitution shall be made available to the Vice Chancellor, Coordinator of
Student’s affairs, Executive Officers, Legal Advisor, members of the Parliamentary
Council at the beginning of their tenure of office. The Judicial Council shall also be given
copies of the constitution and statute of the University at the same period as Parliamentary
Council members are given copies of this Constitution.
(2) Without prejudice to clause one (1) of this article, the General Secretary shall be cause to
keep in the Library and shall make available, copies of this constitution for reference by
any student.

Article ninety-nine (99)


REPORTS AND ARCHIVES
There shall be kept in the SRC cabinet an archival folder for each committee where reports of
succeeding committees of the SRC or any other committee established under a resolution of the
Parliamentary Council shall be kept.

Article hundred (100)


PROHIBITION ON ALTERATION OF THE SRC CONSTITUTION
(1) Unless where constitutional amendments have been made to some provisions of this
Constitution no part thereof shall be altered or excluded or any additions made to its
contents.
(2) Any person who alters or excludes or makes additions, or attempts to alter or exclude or
make additions to any part thereof of this Constitution without being sanctioned by law
shall be held to have committed an offence under this Constitution and in the case of an
SRC officer shall be a valid ground for removal from office and in the case of any other
student shall be a valid ground for ineligibility to contest for any SRC position.
