REF: RECTIFICATION OF THE DEED OF CONVEYANCE


DATED 18/09/1972 EXECUTED BY ONE MR. KISHAN
LALCHAND BHATIA (VENDOR & OWNER) IN FAVOUR OF
M/S. CHANDRIKA BHATIA CHS LTD., HAVING ITS
REGISTERED OFFICE AT PARMANAND MEHTA MARG, OPP
HUMSUB BUILDING, SHANKAR LANE , KANDIVALI (WEST),
MUMBAI 400067.

I am concerned for my Client M/S. CHANDRIKA BHATIA


CHS LTD., and in the context of the above subject matter, I take this
opportunity to address you as hereunder:-

1. If you will kindly refer to the above Conveyance Deed dated


18/09/1972, you will at once realize that in the schedule of the property
referred to therein the Old Survey No. of the property has been wrongly
mentioned as “OLD SURVEY NO. 42 (part) and new Survey No.729
(part) of Malad instead of the correct Survey No. of the said plot as
72(A)”. With the result of the said mistake/error, the said Conveyance
Deed has been rendered ineffective.

2. To further highlight the position of the matter, we crave leave to refer to


the notice dated 11/07/2022 addressed by on behalf of my Client.

3. Further, it is clear from said “FORM-B/NAMUNA- B” in favor of


various flat purchasers of the said building, that the correct description of
the said subject plot is bearing Survey No.72(A).

4. In view of the said notice and in the view of the nature of very minor
error as mentioned hereinabove error in the process, I would request your
good-self to kindly make a necessary correction in the schedule of the
property as per “FORM-B/NAMUNA- B” which is Survey No.72(A).

5. In the light of provisions of law, it is well within your discretion to make


corrections and issue necessary letters/documents to that offer to make
my Client to approach the necessary Revenue Authorities to further deal
with the matter without initiating the proceedings before the appropriate
authorities.
