CLASS Probable cause for the arrest of MILES, JAMES EARL JR I Offenses: |) ASSAULT, FAMILY/HOUSEHOULD MEMBER BY IMPEDE BREATHNING/CIRCULATION FAMILY VIOLENCE FELONY 3 2) VIOLATION OF A BOND/PROTECTIVE ORDER ASSAULT/S FELONY 3 TALKING, 3) POSSESSION OF MARIJUANA, STATE JAIL FELONY On Wednesday March 1*, 2023 at around 1:17 p.m. officers were dispatched to 312 Dobbs Odessa, Ector County, Texas in reference to a disturbance. Dispatch received an emergency call from a complainant advising her husband is choking her. Dispatch advised the address is from rapid SOS. Dispatch advised that call with complainant became disconnected and that there was no answer on multiple call back attempts. 2. Upon my arrival I observed directly in front of the residence in the roadway a silver 2021 Chrysler 300 bearing I The vehicle was facing a NE direction with the Iront right tire up against the East curb line and the back of the vehicle out in the middle of the street. The vehicle was running and | initially could not see anyone in the vehicle. | went up to check the vehicle and observed that there was a female later ide das Becca Dann Miles, EEE who appeared to be unconscious in the driver's seat slumped over the center console with her head in the front passenger seat. | began knocking loudly on the window and announcing police and initially received no response from Becca. The windows were dark and I could not tell if Becca was breathing and requested OFR medics Code 3 to my location. | continued to knock on the window and announce police and Becca began to come around. The vehicle was locked and Becca unlocked the door. Becca had red bloodshot watery eyes. Becca appeared to be struggling to get her breath while 1g, to speak with me and was having great difficulty speaking through her pain. Becca stated that it felt like something in her neck was broken. 4.Becea reported that her ex-husband James Miles EEE was the person who assaulted her and that he was inside the house. fern loXY Becca wry 23~000g5% 5. OFR responded and Becca was transported to ORMC for medical treatment of her injuries. 6. I attempted to make contact with the suspect by knocking and announcing my presence at the front door very loudly multiple times. James refused to answer the door or exit the residence at this time. 7.1 requested additional units to assist at the scene and a unit to respond to the hospital for additional investigation. | ran a computer check on James and Becca. 8.James shows to be ofa very large stature approximately 6’2” 350 Ibs(later weighed to be approximately 400 Ibs at the hospital) Becca shows to be a much small stature approximately 5°03” 170 Ibs. 9. Computer check revealed that James is a registered Sex Offender for Aggravated Sexual Assault with a listed home address of 312 Dobbs, Odessa, TX 10.Computer check revealed that James is the defendant in an agreed final protective order under chapter 7A Texas Code of Criminal Procedure Cause#E-20-01-0137-FM issued in the 446" District Court of Ector County, Texas Filed For Record on 1-30-2020 with no expiration date. The protected person on this protective order is Kolishia Porter, Hi !1.Computer check revealed that James is also the subject of a court order of condition of bonds out of Crane County, Texas that is a TCIC conditions of bond record OCA #2022MAG133 issued 8-1 1-22 and expiring 8-11-24 which states that Becca Miles, Igy HEB s the protected person. This valid active order was confirmed through dispatch. 12. Computer check also revealed another past protective order against James with Becca as the protected person issued 5-9-2019 expired 7-8-19 in Lampasas County OCA#MG40190042-02 13. Computerized Criminal History Check shows that James has 16 prior arrests for neluding: Aggravated Assault Date/Family/House w/Weapon, Aggravated Sexual Assault, Assault causes bodily injury family member, Criminal Mischief >=$500<$1500, Disorderly Conduct, Driving While License Invalid, Driving While License Suspended, Fail to Comply Sex Offender Duty to Register Life/Annual, Interfere with Emergency Request for Assistance, Marijuana possession, poss marijuana, unauthorized use of vehicle, and violate bond/protective order. !4.Computerized Criminal History Check shows that James has 8 convictions for Aggravated Sexual Assault, Assault Causes Bodily Injury Family Member, Assault Family/Household Member with Previous Conviction IAT, Criminal Mischief =$500<$1500, interfere with emergency request for assistance, marijuana possession, and possession of marijuana, 15. James was convicted on 12-6-19 in 27" District Court Lampasas TX for Assault Family/Household Member Prev Conv IAT misdemeanor class A. ies was arrested on |-25-22 in Ector County, Texas for Fail to Comply Sex Offender Duty to Register Life/Annual, Felony 3. . James wa: ted on 1-5-2023 by Taylor CO SO Abilene for Fail to Comply Sen Offender Duty to Register Life/Annual, Felony 3 and for Violation of Bond/Protective Order, class A, agftte SE V ere 20H 23-0009 55° 18. Additional officers arrived on scene and began attempting to call James out of the residence utilizing the patrol unit PA system. James eventually came to the front door. James was very angry, verbally argumentative, and refused officers commands to exit the residence and come out to us. James eventually exited the front door but still refused to come out to officers and still remained very belligerent and uncooperative and would not comply with officer’s repeated verbal commands. 19. James was advised he was under arrest for felony family violence and he advised he was not going to jail and not getting arrested. Negotiation attempts by officers were unsuccessful in gaining James voluntary compliance and an OPD K-9 was deployed by Cpl. Joe Galindo. 20. James was taken into custody and transported to MCH ER for treatment of the K-9 bite. 21. detected a slight but distinct odor of marijuana outside the front door of James residence. James had a wallet in his pocket containing $311.00 in US currency. The wallet and money smelled strongly of marijuana. 22. James was very belligerent and making racist type statements towards officers. I read James the Miranda warning and he refused to speak to me at this time in the ambulance James made numerous res gestae statements while screaming and yelling at officers to the effect of, she needs to go she can’t stay here referring to Becca. 23. Cpl. C. Adams followed up with the victim Becca at ORMC. Becca reported that she had been in Odessa with James for a couple days trying to work on the relationship and he wanted her to leave and she asked to stay one more night before driving back home since it was late in the day already and he told her no. Becca reported that James threw her on the bed and began choking her with his hands to the point she could not breathe and almost passed out. She advised that she was having difficulty seeing and losing her ion, She advised James finally let her up and told her she was faking it and she began praying out loud and he told her to stop and then hit her on the left side of the face with the back of his hand. She tried leaving the house and he was pushing her out of the house. She indicated that she was wobbly and sick feeling at this point. She started her vehicle in the driveway and was still dizzy and remembers hitting the curb and then being awakened by police in the vehicle. 24, Becca also reported to officers that James was in possession of marijuana and cocaine that he was selling, 25. Based on the fact that officers could smell odor of marijuana coming from inside the residence and from on James personal property Cpl. T. Prosise obtained a search warrant for the residence. 26.Officers conducted a search of the residence and in James room at the NW portion of the residence officers recovered approximately 7.42 ounces of marijuana. Officers also recovered a gun cleaning kit and 4 Winchester +P .38 special bullets. 27. James was treated and released form MCH and transported to ECLEC. James was asked about the marijuana which he claimed was for him and claimed it was for medicinal purposes for his knees despite having 18 individually packaged approximately 10 gram bags of marijuana packaged for distribution along with an approximately | ounce bag of marijuana not yet repackaged. James acknowledged he knew he was a convicted felon but denied knowledge of the bullets in his room. ite FC ie 2 3-000) 550 28. James intentionally and knowingly possessed a useable quantity of marijuana over 4 07 under 5 Ibs contrary to Section 481.21 Texas Health and Safety Code. 29.James intentionally and knowingly impeded the normal breathing or circulation of the blood of his ex-wife Becca Miles contrary to Section 22.01(b)(2)(B) Texas Penal Code. 30.James violated the conditions of a condition of bond order by assaulting the named protected person Becca Miles contrary to Section 25.07(g). 31.
