1. George executed a will despite the fact that he was certified as insane and detained in a
mental hospital for short periods. Discuss the validity of the will. (5 marks)

2. Tan Ah Ling executed a will in which she left all her estate to her husband and her son in
equal share. She then put her thumbprint at the foot of the will in the presence of the husband
and the son. On the next day, Tan Ah Ling produced the will to Tan Ah Long, her brother
after which Tan Ah Long subscribed her name as a witness. Tan Ah Ling and Tan Ah Long
then went to a neighbour’s house, where Tan Ah Ling, in the presence of Tan Ah Long, asked
the neighbour to witness her will. The neighbour thereupon subscribed her name as a witness
in the presence of Tan Ah Ling only since Tan Ah Long went to the washroom.

Discuss the validity of the above will. (7.5 marks)

3. Andy and Maria were husband and wife. One day, both of them were found dead in their car
apparently due to excessive inhalation of carbon monoxide. Their exact order of death was
not known. Andy died leaving a will in which half of his estate was given to Maria and the
other half was to be distributed according to the law. Maria died intestate. At the time of their
death, the value of Andy’s net estate was RM600,000.00 while the value of Maria’s net estate
was RM200,000.00. They were survived by their respective parents, their 20 years old son
and 18 years old daughter. Advise the surviving family as to the distribution of Andy’s and
Maria’s estates. (7.5
