the FIR registered on 31.10.2022, petitioner has been charged for the commission of offence
u/s 9-C CNSA, 1997, however, after the promulgation of the Control of Narcotic Substances
(Amendment) Act, 2022 enforced with effect from 06.09.2022, Section 9 sub Section (1) is
attracted to the case of petitioner. As per column No.03 of the Table given in Section 9 Sub
Section (1), the contravention of the provisions of Sections 6, 7 & 8 regarding narcotic drug/
heroin from 500 grams to 1999 grams has been made punishable with imprisonment which
may extend to 14 years but shall not be less than 10 years alongwith fine which may be up to
five hundred thousand rupees but not less than one hundred and twenty-five thousand
rupees. Thus case of the petitioner falls within the prohibitory limb of Section 497 Cr.P.C.
Keeping in view the quantum of recovered heroin, no question of border line case arises.
