107.0 Testing.
The Authority Having Jurisdiction shall have authority
to require tests, as proof of equivalency.
107.1 Tests shall be made in accordance with
approved intemational testing standards by an
approved testing agency at the expense of the
‘applicant. In the absence of such standards, the
‘Authority Having Jurisdiction shall have the authority
to specify the test procedure.
107.2 The Authority Having Jurisdiction shall have the
authority to require tests to be made or repeated if, at
any time, there is reason to believe that any material
fr device no longer conforms to the requirements on
which its approval was based.
Part ll Enforcement.
108.0 Powers and Duties of the Authority Having
Jurisdiction.
108.1 General. The Authority Having Jurisdiction
shall be authorized 10 enforce the provisions of the
code. For such purposes, the Authority Having
Jurisdiction shall have the powers granted by the law.
The Authority Having Jurisdiction shall adopt,
interpret and enforce the standards, rules and
regulations of the code in order to clarify the
application of the provisions of the code. All
interpretations of the rules, standards and regulations
Shall be in accordance with the intent and purpose of
this code.

immediately notify the serving uility, owner, and

108.5 Authority to Condemn Equipment. The
‘Authority Having Jurisiction shall order in wring that
the equipment be removed oF restored to a safe or
sanitary condition after it ascertains that any
‘equipment, or portion thereof, regulated by this code
has become hazardous to life, health, or property.
The written notice shall have a fixed time limit for
compliance with such order. After receiving a notice
any person shall not use or maintain the defective
‘equipment. Any equipment or an installation that shall
bbe disconnected, a written notice of the disconnection
with causes shall be given within twenty-four (24)
hours to the serving utility, owner, and occupant of
the building, structure, or premises. Any equipment
that is maintained in violation of this code, and i9
violation of a notice issued pursuant to the provisions
of this section, the Authority Having Jurisdiction shall
Institute an appropriate action to prevent, restrain

lessen the responsibility of any person owning,

herein for damages to persons or property caused by

parent jurisdiction be held as assuming any such
liability by reason of the inspections authorized by this
code or any permits of certificates issued under this
‘code.
108.8 Cooperation of Other Officials and Officers.
‘The Authority Having Jurisdiction shall be permitted to
request, and shall receive, the assistance and
cooperation of other officials of this jurisdiction so far
as required in the discharge of the duties required by
this code or other pertinent law or ordinance.

110.0 Permits.
110.1 Permits Required. No mechanical sysiem
regulated by this code shall be insialied, altered,
repaired, replaced, or remodeled uniess 2 seperate

110.1.1. Applicants for permits shall have been
licensed as contractor by the Philippine
Contractors Accreditation Board (PCAB) of the

Tequirements Republic Act (RA) 4566 or known
as the Contractors License Law
111.0 Exempt Work. A mechanical permit shall not
be required for the following:
111.1 A portable heating appliance, portable
ventilating equipment, a portable cooling unit, or
‘a portable evaporative cooler,
411.2. Any closed mechanical system within
heating oF cooling equipment that is regulated by
this code.
411.3 Any component part or assembly of
mechanical equipment that is replaced and does
rot alter its original approval and complies with

the mechanical equipment for which a permit has
been issued pursuant to the requirements of this
code.
112.0 Application for Permit.

detail that it will conform to the provisions of this code
and relevant laws, ordinances, rules, and regulations.
113.0 Permit Issuance.
113.1 Issuance. The Authority Having Jurisdiction
shall issue a permit to the applicant when the work
described in an application for a permit and the plans,
calculation, specifications, and other data filed are in
‘accordance with the requirements of this code and
other pertinent iaws and ordinances and that the
required fees specified in Section 115.0 have been
paid.
When issuing a permit where plans are required, the
Authority Having Jurisdiction shall endorse in writing
‘or stamp the plans and specifications: “APPROVED.”
‘Such approved plans and specifications shall not be
changed, modified, or altered without approval from
the Authority Having Jurisdiction. All work regulated
by this code shall be done in accordance with the
approved plans.
