the fown of Horseheads has been aware that for the past year or
more Journey Church, Inc., through various subsidiaries have been operating
outside the approvals granted to Journey Church pursuant to the ‘lawn of
Horseheads Town Code Chapter 204 Article XIV Planned Unit Development
(PUD).
The property located at 116 Breesport Road is zoned Residential A.
Churches and community buildings are permitted uses in the zone, At the
time you made application for a building permit for the addition you
e ed a ‘0 operate the property for certain commercial purposes,
which were expressed. The Town suggested, that since the uses you desired
were not permitted uses within a Residential A zone, an application for a
PUD would be beneficial, allowing the Church to apply to the Town Board to
operate certain commercial activities as may be approved by the town
Board, on a case by case basis. This would allow the Town to have control
over the proposed expansion of uses beyond the those permitted in a
Residence A zone.

the premises. Since the date of the approval, the Church has not made any

Presently, based upon public information, including social media
Postings, the Church and/or its various subsidiaries, has operated and is
operating the premises, which the Church appears to cali the “L', as a
commercial property. The Church has operated and continues to operate on
the premises commercial activities, including but, perhaps, not limited to a
fitness center, barber shop, wedding venue, concert venue and either open
or soon to open, a café restaurant
Therefore, Journey Church, Inc., as Property owner, and it subsidiaries
sho e ail commercial activities on the premises, currently termed the
“L’, until further application is made to the Town Board for amendment to its
PUD for the operation of each of the various commercial activities.
