right to approach a competent court, alleging that a right in the Bill of Rights has been infringed, or
threatened, and the court may grant appropriate relief, including a declaration of rights.

duty on the state to “combat poverty and promote social welfare”. Including the enforcement of the Bill
of Rights in dealings between citizens themselves (when they conclude contracts with each other).

but to offer him or her some much needed solatium (solace/comfort) for his or her injured feelings.

4.3 In the interest of Justice and in line with the convictions of South African society the court decided to
interpret and apply the rules on negligence in a way that will, in future, hold private security companies
liable for the losses of their clients, if they could have prevented the losses.
