FRESHERS’ INDUCTION MOOT 2022

MOOT COMPROMIS

1. Bhindiya is a progressive country on the continent of Mars. Its people have enjoyed a democratic
government for the last 70 years and pride themselves on being a progressive society where they also
protect their cultural values. Women in Bhindiya are educated and aware of their rights and the country
has a strong judicial system.

2. Mr. Aditya Johar Bhanusali is a leading film producer and director, based in the Elon district of the
state of Musk. He is a revered personality for his filmmaking skills in the Bhindiyan film industry,
popularly known as Bhelwood. He is now the head of his family’s 50-year-old Film Studio-Bhrama
Productions. They are known to make big-budget films, TV shows, Music videos, etc. They only work
with A-list stars. Aditya himself has been working for over 20 years and has made several blockbusters.
He and his company enjoy significant goodwill in the industry and often get their way when it comes to
actors’ dates or film release clashes. He has the reputation of making soft and sensitive films but being
an equally ruthless and shrewd producer.

3. On the other hand, Ms. Tanushka Verma is the latest newcomer on the silver screen. She is a young
aspiring actor, hailing from the small town of Fursatganj, dreaming of being the next superstar at the
box office. She has been struggling with casting directors and auditions for over 2 years but all in vain.
One day, Mr. Aditya spotted her at an audition queue outside his office and immediately asked to meet
her. After a small conversation with her, he decided to cast her in the lead role for his next big-budget
period drama. Ms. Tanushka was over the moon and ever so grateful to Mr. Aditya and Bhrama
Productions for her first big break.

4. The media and paparazzi were sent into a frenzy after the announcement of the film and the casting
of Ms. Tanushka. She became an overnight star, with her social media followers quadrupling in a matter
of days. Her rise from a small city became an inspiration to the youth. Mr. Aditya was pleased by this as
well. Not only did he feel Ms. Tanushka deserved it, it was also creating the much-needed hype
necessary to make his financially indulgent project a success.

5. As the film’s shooting began in exotic foreign locations such as Jupiter and Saturn, Ms. Tanushka and
Mr. Aditya began to get along very well with each other. Being her first film, Mr. Aditya went out of his
way to make her feel comfortable on set and give her extra attention to help her with her acting
performance. Ms. Tanushka’s most cherished times during the shoot would be when she would be with
Mr. Aditya as well. They both developed a deep bond while shooting abroad.
6. During the Bhindya leg of the shoot, it became clear to the film crew that Mr. Aditya and Ms.
Tanushka are romantically involved. The media outlets too started conjecturing and hounding the two
on the status of their relationship but they both maintained “they’re just good friends.” Even after their
on-the-record denial of being together, they started being popularly referred to as #AdUshka by their
fans. While this was largely on expected lines in the world of Bhelwood, Ms. Tanushka started to get
mildly distressed by the insinuations in some quarters that her relationship with Mr. Aditya is the only
reason she got a lead role in his film.

7. With around 15 months still remaining for the completion of the film, Ms. Tanushka revealed to Mr.
Aditya that she is pregnant with his child. She further told him that her family was furious with her for
having disgraced them and becoming a spoilt Bhelwood star. Aditya was shocked to hear the news and
tried to console Tanushka. He couldn’t help but also worry about the status of his film and the financial
repercussions of it not releasing on time.

8. To make matters worse, the news of her pregnancy got leaked to the media. Ms. Tanushka became
subject to heavy social media trolling and her family completely ostracised her. She was in a state of
serious distress and while Aditya was understanding of the situation, he was preoccupied, trying to deal
with the logistical nightmare that the pregnancy caused to his film.

9. Tanushka told Aditya that the only solution to all her problems was to marry him before the baby is
born. Aditya tried to explain to her that while he felt very close to her and was happy to raise a child
together, he never really believed in the institution of marriage and was not ready for it. This led to a
heated argument between the two, ending with Tanushka threatening to not complete Aditya’s film
post-pregnancy. Aditya too in a fit of rage proclaimed that blackmailing Aditya Bhanusali would mean
the end of her career in the film industry.

10. After the dust from the constant arguing settled, Aditya realised that it is in his interest to get
married and avoid a PR and commercial debacle for his future. On consulting his close aides, he decided
he will propose marriage to Tanushka, along with a contract with certain terms and conditions
(Annexure A).

11. Among other things, the terms of the agreement stated that Ms. Tanushka must complete her film
with Bhrama Productions and post-marriage will exclusively work with the production house. The
contract also stated that Mr. Aditya will purchase a 5000 sq. ft. bungalow on Lulu Island with a fleet of
servants for Ms. Tanushka and the expected child. Ms. Tanushka, seeing this as the only way to save
her career and reconcile with her family, signed the contract. The couple got married at a quiet
ceremony at the Bhanusali Mansion.

12. Some time passed, Aditya and Tanushka were blessed with a baby girl and their film’s shooting also
concluded. While the film was a massive success, Aditya and Tanushka were husband and wife just in
name. They remained cold towards each other and got busy in their individual lives. Tanushka spent
most of her time basking in her newfound success at her Lulu Island bungalow, while Aditya got busy
planning on building on his recent success.

13. Ms. Tanushka was flooded with film offers from various production houses. She was particularly
attracted to an extremely lucrative 3 film deal offered to her by Bhrama Productions’ rivals, V-Series.
While she refused the offer, the top management of V-Series persisted to try and convince her. On
revealing that she’s bound by contract, they persuaded her to sign the deal with them, saying that such
a contract would not stand legal scrutiny. She got excited hearing this and signed the contract without
hesitation or consultation.

14. Following this, Ms. Tanushka moved the Court to get her contract with Mr. Aditya vitiated. Her legal
counsel claimed that the contract was void as Mr. Aditya was in a position to dominate Ms. Tanushka’s
will and thus applied undue influence over her. Further, they claimed that the contract’s object was
illegal.

15. Mr. Aditya rejected all these claims in his defense. His lawyers argue that the Contract was signed
with free consent and there was no coercion or professional sanction that was leveraged by Mr. Aditya
to arm-twist Ms. Tanushka. It was Ms. Tanushka who threatened to quit Mr. Aditya’s film and cause him
grave financial losses if she didn’t have her way. Further, Mr. Aditya sued Ms. Tanushka for breach of
contract as she signed a contract with another production house while being contractually bound to
Bhrama Productions.

Note:

● The case is due to be heard next on 12th February 2022.


● The laws of Bhindiya are pari materia to that of India.
● The laws of the State of Musk are in pari materia to the laws of Delhi.
ANNEXURE A (Relevant clauses)

Clause VIII - Ms. Tanushka shall honor her commitment to Bharma Productions to complete the ongoing
project named “Rani Hirani ki Bemani Kahani - Chapter 1” within the time frame as decided by the
production house.

Clause IX - Post marriage with Mr. Aditya, Ms. Tanushka shall work exclusively on multimedia projects with
Bharma productions.

Clause XI - Mr. Aditya will purchase a bungalow on Lulu Island and register it in Ms. Tanushka’s name. He
shall also hire on his account 30 staff members to assist Ms. Tanushka and the expected child. In case of
default, Mr. Aditya shall pay Ms. Tanushka an amount of Rs. 50,00,00,000.

Clause XII - In case of breach of clauses VIII and IX, the breaching party (Miss Tanushka) shall pay liquidated
damages amounting to Rs. 5,00,00,000 to Mr. Aditya.
RULES AND PROCEDURE

1. REGISTRATION:

The last date to register for FIM 2022 is 12:00PM, January 28th, 2022 - Friday. Interested participants
can register through the following link:

No extension for registration shall be granted. Moreover, no delay in registration will be


entertained/condoned under any circumstances. In case of multiple registrations by a participant, only
the latest registration entry shall be considered.

2. REGULATIONS:

A. Language: The language of the competition shall be ENGLISH only.

B. Eligibility: The competition is open for all bona fide first year students of Campus Law Centre pursuing
the 3 year LL.B. course.

C. Team Composition: There shall be no teams. All participants shall participate individually.

D. Memorial: The following requirements of a memorial must be followed. Any deviation/non-adherence


of the same will be strictly penalized:

The Memorial should either be on behalf of the Plaintiff or on behalf of the Defendant, but not both.
The memorial shall be on behalf of the side that has been indicated in the registration form. The PDF
(.pdf) copy of the final Memorial should be uploaded through the following link:

The uploaded memorial documents should be named as follows:

FIM 2022 Memorial - <Plaintiff/Defendant> - <Last 3 digits of your College Roll Number>

Adherence to the above mentioned pattern while naming the file/document is compulsory, as the same
will be used to facilitate all future correspondences. Any deviation/non-adherence of the same will be
strictly penalized. The size of the file should not be more than 10 MB.

The deadline for the submission of the memorials is 11:59PM, February 6th, 2022 - Sunday. No memorial
shall be accepted beyond the aforementioned date and time under any circumstances. To ensure that
technical issues/glitches do not create issues or delays with memorial submission, participants are
advised and requested to ensure that they initiate the submission process well before the
aforementioned deadline.

Once the memorial has been submitted, no subsequent amendments shall be allowed. If two or more
participants are found to have the same/similar memorials, all such participants shall be disqualified and
barred from any future attempts of gaining membership to the Moot Court Society.

The format of the memorial should be as follows:


a. Main Body Text: Times New Roman, Font Size 12, Line Spacing 1.5
b. Footnotes Text: Times New Roman, Font Size 10, Line Spacing 1.0
c. A margin measuring 1-inch should be left on all sides of each page.
d. Each page should be numbered at the bottom centre of the page.
e. The Memorial must not mention any personal details such as your Name, Year, Roll Number, Contact
Details, etc. which reveal your identity in any manner. If any such detail is found on the Memorial, then
the memorial and the participant shall be immediately disqualified from FIM 2022.

The Memorial must necessarily contain (but may not be restricted to) the following, in the order
mentioned below:
a. Front Page
b. Table of Contents (1 Page)
c. Index of Authorities (upto 2 Pages)
d. Statement of Jurisdiction (1 Page)
e. Statement of Facts (1 Page)
f. Statement of Issues (1 Page)
g. Summary of Arguments (upto 2 Pages)
h. Arguments Advanced (upto 15 pages)
i. Prayer (1 Page)

No additional facts must be incorporated or relied upon other than those mentioned in the Moot
Problem.

The style of footnoting must be consistent. Footnotes must be restricted for providing bare citations
only and must not be accompanied by any form of description or explanation of authorities/provisions
of law/sections/statutes relied upon.

The front page of the Memorial must be BLUE for Plaintiff and RED for Defendant.

The cover page of the Memorial must mention the following:


a. FRESHERS’ INDUCTION MOOT 2022, CAMPUS LAW CENTRE
b. Name and Place of the Court
c. The Cause Title
d. Memorial on behalf of <Plaintiff/Defendant>
e. Counsel appearing on behalf of <Plaintiff/Defendant>

1. Memorial Scoring:

The scoring for Memorials will be out of maximum of 30 Marks, which shall be divided as follows:
a. Application and Appreciation of Facts (5 marks)
b. Identification and Presentation of Issues (5 marks)
c. Application of Legal Principles/Provisions, Use of Precedents and Authorities (10 marks)
d. Logical Structure, Grammar and Style (5 marks)
e. Consistent Footnoting and Formatting (5 marks)

2. Oral Rounds:

a. Oral Rounds shall be conducted ONLINE via GOOGLE MEET. Participants are responsible for ensuring
that they have the requisite technological infrastructure required to ensure a smooth participation on
their part.

b. Each participant shall get a total of 15 minutes to present their case/pleadings/arguments. The oral
arguments must be confined to the issues presented in the Memorial.

c. The scoring for Oral Arguments will be out of maximum of 70 Marks, which shall be divided as follows:
• Application and Appreciation of Facts (15 marks)
• Understanding of Law and Procedure (15 marks)
• Use of Authorities and Precedents (10 marks)
• Response to Questions and Articulation (15 marks)
• Advocacy Skills, Court Craft and Demeanor (15 marks)

DRESS CODE:

For Female Counsel: White Shirt with Black/White Pants OR White/Black Kurta, White/Black Salwar,
Black Blazer (Blazer is preferable, but not mandatory).
For Male Counsel: White shirt, Black/White Pants, Tie and Black Blazer (Blazer is preferable, but not
mandatory).

SELECTION CRITERIA:
a. There is no win/loss in the competition for any participant. There is no pre-fixed number of students
that will be admitted into the Society through FIM 2022.
b. The cut-off marks for the Memorial Round is 15 marks.
c. The cut-off marks for the Oral Round is 45 marks.
d. All those candidates who are able to secure the above mentioned cut-off marks for BOTH the Memorial
and the Oral Round, and have not attracted any penalty or any other disqualification as per the Society
rules, will be admitted into the Moot Court Society as its members.

NOTE:
• The decision of the Judges and the organizers shall be final in all respects.
• Any misconduct on the part of a Participant may attract disqualification from the induction process, or
any other penalty as the Moot Court Society may deem fit.
• Any clarifications, any queries for problems related to memorial submission, or any queries with respect
