On November 25, 1984, a contingent of Philippine marines raided Petitioners’ compound in
Zamboanga City, in search of loose firearms ammunitions, etc. The besieged compound
surrendered the following morning. The Respondents had their fingerprints and photographs
taken. The seized weapons and arms were taken soon after. Petitioners demanded the return of
their arms as there was no search warrant for their arms. Respondents justified their acts by
mentioning that they were under superior orders.
Issue: WON the superior orders of the marines countermands the Constitution.
Ruling: No. Respondents admitted the absence of a required search warrant, to justify their acts,
and were under “superior orders”. Superior orders cannot countermand the constitution.
HEREFORE, the search of the petitioners’ premises on November 25, 1984, is hereby declared
ILLEGAL
