ABOUT THE INSTITUTE

Ideal Institute of Management and Technology was set up in 1999 under the aegis of the New
Millennium Education Society, with the sole objective of imparting quality Education and
empowering the young generation of the new millennium to face the growing challenges of
Education. Beginning from a very modest start, the Institute has now acquired a commendable
position as a premier educational institution imparting education in the fields of law, business
administration topped with Computer Aided Management and conducting B.A.LL.B., B.B.A.
(CAM), and B.B.A. programs of Guru Gobind Singh Indraprastha University, Delhi.

ABOUT THE MOOT

School of Law, IIMT is conducting Intra College Moot Court Competition, 2023 on April 12th -
13th (Wednesday & Thursday) at Ideal Institute of Management and Technology, Karkardooma,
New Delhi.

The Competition is a simulation of a fictional dispute regarding a criminal matter. Teams shall
prepare oral and written pleadings arguing the applicant and respondent positions of the case.

Eligibility – Undergraduate law students of IIMT.


Team Composition - The team shall consist of only two Mooters and oneResearcher.
Dress Code - As per the rules of The Bar Council of India (i.e. White shirt, black trousers, blazer
Black colour) or Proper College Uniform.

NOTE: Teams*can participate from all the years of BA.LLB.

(*Cross-year teaming is allowed.)

Provisional Registration

The interested students shall form a team of three consisting of two mooters and one researcher.
Each team shall register using the link provided below and as a team is required to fill only one
form.
*(Corrections will not be entertained).

Final Registration

The final registration shall be deemed to be completed upon submission of the hardcopy of the
registration form alongside the hardcopy of the memorial.

Moot Problem:

Ahana, an eighteen-year-old girl was a student of the 12th class residing in Calicutta. She belonged
to a lower-middle-class family. Her father used to work as a clerk in a private firm. She had
always been an ambitious and very bright student. To support her father she used to give tuition.
Kishore, Accused No.1, Math’s teacher of Ahana in her school secretly developed emotions for
her. Ahana had always admired him as her teacher. On Ahana’s 18th birthday, Kishore organized a
birthday party for her at his house and gifted her an expensive watch. Unaware of Kishore’s
feelings Ahana accepted the same.
On 14th February 2018, Kishore proposed to Ahana for marriage. Ahana, however, told him to
th
speak to her parents regarding the same. On 20 February Kishore a p p r o a c he d her parents
with the proposal. However, they rejected his offer and warned him not to contact her anymore as
they did not want that there should be any kind of distraction to their daughter as her XII boards
were approaching. They strongly admonished Ahana and threatened that they will discontinue
her studies. Thereafter she started avoiding Kishore. On one occasion Ahana also made it clear to
him that she will not go against the wishes of her parents and asked him not to follow her
anymore. Despite the disinterest shown by Ahana, Kishore continued to follow Ahana to her
tuition classes and contacted her personally, on phone, and through the internet, believing that all
her actions were under pressure from her parents.
Ahana reported the same to her parents. The parents rebuked him for his unwarranted acts. He,
however, tried to convince them about his feelings forher and further stated that he wanted to
marry her. The parents beat the tutor and asked him to leave.
Enraged with the feeling of dejection, Kishore went to Tanmay whom he always confided, and
narrated the whole thing. Tanmay, aged 45, has always supported Kishore, who was residing with
him, ever since his parents died in a road accident in 2000. Tanmay, who had always treated
Kishore as his son, could not bear his pain of Kishore. Tanmay suggested to Kishore that he
should find Ahana alone and take her to the temple for marrying her without informing her
parents. In case Ahana would offer any resistance due to parental pressure, Tanmay will threaten
her with a bottle of acid to pressurize her to come with them to the temple.
Kishore, who was initially reluctant, agreed to the plan on the condition that no harm will be
caused to Ahana and bottle of acid will only be used as a tool to threaten her for compliance to
their wishes. On 23rd March, 2018 as per the plan, finding Ahana passing on a lonely road,
Kishore and Tanmay, who were waiting for Ahana, got out of the car. Kishore approached
Ahana and asked her to accompany him to the temple so that they can get married. On
Ahana’s refusal, Tanmay carrying the bottle of acid, threatened Ahana. Kishore started
dragging her into the car. Ahana started shouting loudly.
To teach a lesson to Ahana, Tanmay opened the bottle and threw the acid on her face and then
both Tanmay and Kishore fled away in the car belonging to and driven by Tanmay leaving the
girl in immense pain. The girl was taken to the hospital by some passerby. The doctor
immediately conducted the surgeries and opined that the injuries were grievous. FIR was lodged.
Statement of Ahana was recorded. A case was registered against both the accused under Sec
326A r/w Sec 34 IPC, 1860 and Kishore was also charged under Sec 354D, IPC, 1860. Tanmay
absconded and was declared a proclaimed offender while Kishore was arrested by police from
his home and the bottle of acid and car, used in the crime, were seized from his possession.
After investigation, he was put to trial before the Sessions Court, where he pleaded not guilty and
claimed trial.
Sessions Court convicted Kishore under section 326A r/w section 34 of IPC, 1860 and sentenced
him to 10 yrs of rigorous imprisonment. He was also asked to pay compensation to Ahana
of Rs 2,00,000/- to be paid immediately. He was also awarded rigorous imprisonment for 2 years
under Section 354D, IPC, 1860. Both the sentences were to run concurrently.
The High court of Calicutta adjudicated in favor of the accused by acquitting him from the
charges under Section 326A r/w Section 34 and Sec 354D IPC, 1860 and dismissed the
appeal of the state, being bereft of any substance by holding that under the circumstances of
the case, the trial court had wrongly held the accused liable under Section 326A, IPC 1860, by
invoking Section 34 IPC, 1860 as Accused, aggrieved by the aforesaid judgment, appealed before
the High Court seeking acquittal. Whereas, State filed appeal for demanding life imprisonment
and also the enhancement of the amount of compensation taking into account the following facts:

• Rs 6.5 lakh have already been spent on the 6 major surgeries done till date;
• 10-15 surgeries still need to be done;
• Despite various surgeries Ahana has permanently lost her left eye vision;
• Permanent scars not only on the skin of her face and hands will remain but also deep
inside her memory which will adversely affect her future prospects;
• Her father who was a clerk in a private firm has been retrenched from his services as he is taking
continuous leaves for her undergoing treatment. Now he is jobless. There are two other sisters of
Ahana who also need to be supported.
The High court of Calicutta adjudicated in favor of the accused by acquitting him from the
charges under Section 326A r/w Section 34 and Sec 354D IPC, 1860 and dismissed the appeal of
the state, being bereft of any substance by holding that under the circumstances of the case, the
trial court had wrongly held the accused liable under Section 326A, IPC 1860, by invoking
Section 34 IPC, 1860 as no common intention to commit offence of Acid Attack under Section
326A could be proved. The High Court held that the offence of stalking under Section
354D was also not made out against the accused. The High Court,
however, recommended the District Legal Services Authority to decide upon the quantum of
compensation to be awarded by the State Government to the victim asper Section 357A, Cr PC
within one month.
Aggrieved by the said judgment of the High Court acquitting the accused, the State filed an
appeal before the Supreme Court on the ground that High Court has failed to take notice of the
fact that common intention was present as Kishore and Tanmay had agreed to the use of a bottle
of acid in their plan of abduction. Acid was thrown in furtherance of that common intention. The
state appealed for considering the offence as heinous and to award life imprisonment under Sec
326A r/w Section34 and Section 354D and also to enhance the compensation awarded by the
Sessions Court to be paid by the accused to the victim under Section 326A, IPC, 1860 in
addition to the compensation to be paid by the State Government under Sec 357A Cr PC. The
State also sought permission for addition of charge under Sec 366 IPC.

Memorial is required to be prepared for both parties.


RULES AND REGULATIONS

1. ORAL ROUNDS

a) PRELIMINARY ROUND

i. The teams will be paired by draw of lots in all the rounds of the competition.

ii. There shall be exchange of memorials for all the rounds.

iii. Each team shall argue for both sides in the preliminary round, once for petitioner side and
once for respondent side.

iv. Each team will get a total of 10 minutes in the Preliminary Round. This time will include
rebuttal time. In all the rounds, any team exceeding the allotted time shall be penalized.

v. The total marks scored by a team in the preliminary round will be a total of the two rounds,
i.e. marks scored as petitioner and marks scored as respondent.

vi. The oral arguments should be confined to the issues presented in the memorial.

vii. The researcher shall be present with the mooter during the oral rounds.

viii. Passing of notes to the mooter by the researcher is strictly prohibited in thisround.
ix. Maximum scores for the oral rounds shall be 100 points per speaker. The oral
rounds shall be judged on the following criteria:

Knowledge of Law : 20 Points

Application of Law to Facts : 20 Points

Ingenuity and Ability to Answer the Questions : 20 Points

Style, Confidence, Courtesy and Demeanor : 20 Points

Time Management : 10 Points

Organization : 10 Points
x. Eight (8) teams with the highest score in the preliminary round shall qualify to the quarter
final round.

b) QUARTER FINAL ROUND (Subject to the number of teams)

i. The quarter final round is a knock out round. The participants shall argue from one side
only.

ii. The quarter final round shall consist of 10 minutes per team.

iii. The other rules shall remain the same as they are in the preliminary round.

iv. Passing notes to the mooter by the researcher is strictly prohibited in this round.

c) SEMI-FINAL ROUND

i. The semifinal round is a knock out round. The participants shall argue from onlyone side.
ii. The semifinal round shall consist of 15 minutes per team.

iii. The other rules shall remain the same as they are in the preliminary round.

d) FINAL ROUND
i. The final round is also a knock out round.

ii. The final round shall consist of 20 minutes per team.

iii. The oral arguments as well as the marking criteria shall be the same as mentioned above in
the preliminary round.

(Passing of chits by the researcher is only allowed in the semi-final and in final rounds. It
should be passed via the court master without creating and nuisance)

RESULTS

a) The results will be announced within thirty minutes of each round.

b) The results of the final round shall be announced at the valedictory ceremony.
2. ORDER OF ORAL PLEADINGS
The order of oral pleadings shall be as follows:

 Appellant Speaker 1;

 Appellant Speaker 2;

 Respondent Speaker 1;

 Respondent Speaker 2;

 Rebuttal by Appellant.

2.1 During the course of the oral pleadings, no speaker shall disclose his/her identity or the
identity of his/her institution by any means whatsoever.

2.2 Submission of compendium, case laws, and authorities to the judges must mandatorily be
done through the Court Master. All such materials must be verified by the Court Master before
the commencement of the round. Disclosure of the name in any manner including abbreviations
in such materials shall notbe allowed for submission to the judges.

3. GUIDELINES FOR MEMORIALS

a) Teams have to prepare memorials for both the sides and mention the team code on the top of
the memorial.

b) The teams shall submit 5 hard copies of the memorial for each side by 5th April, 2023.

c) The contents of the hard copies must be the same as the soft copy on
ideallawmootcourt@gmail.com. Non-compliance with this rule will lead to disqualification of
that team.
d) The memorials have to be submitted on A4 size paper, printed on only one side, and must be
in the following order:

 Cover Page;
 Table of Contents;
 Index of Authorities;
 Statement of Jurisdiction;
 Statement of Facts;
 Statement of Issues;
 Summary of Arguments;
 Arguments Advanced and
 Prayer.

e) The Arguments Advanced should not exceed 20 pages per team.

f) The memorial as a team should not exceed 40 pages including the cover page.

g) The memorials should have a margin measuring one inch on all sides of eachpage.
h) The numbering should be on the bottom-center of each page.

i) The petitioner’s memorial cover page shall be printed on Blue Colour A4 size paper, and
the respondent’s memorial cover page on Red Colour A4 size paper.

j) The memorial Front Page should inscribe specifically P and R representing the petitioner or
respondent.

k) The front cover of each memorial must have the following contents:

 The name of the Court

 The name of the competition

 The name of the case

 The title of the memorial (i.e. “Memorial for Petitioner” or “Memorial forRespondent”)

l) A Uniform Style of Citation should be followed throughout the memorial.


m) Footnotes shall contain only the citation. There shall be no speaking footnotes in the
memorial.
n) The maximum scores for the memorials shall be 100 marks. The memorials shall be evaluated
on the following criteria:
 Knowledge of Law and Fact: 30 Marks

 Proper and articulate analysis: 20 Marks

 Extent and Use of Research: 20 Marks

 Clarity and Organization: 20 Marks

 Grammar and Style: 10 Marks

o) The Memorial shall be only spiral bound.

p) Content Specification:

 The following content specification must be adhered to:

 Language -English

 Headings -Times New Roman, 14 ptsFont

& Size(Body) -Times New Roman, 12 ptsLine

Spacing (Body) -1.5 lines

 Font & size (Footnotes) -Times New Roman, 10 pts

Line Spacing (Footnotes) -Single Line

 Page Margins -1 inch on all sides

4. SCOUTING:
No member of any team will be permitted to hear the arguments in any court room in which that
team is not one of the contesting team’s whilst that team is still in the competition.

5. RESEARCHER:

a) TEST: A Researcher Test shall be conducted for adjudicating the “Best Researcher” on
April, 13th, 2023 at 10:00 a.m. sharp. Mooters shall not be eligible to appear for the test.
(PUNCTUALITY WILL BE APPRECIATED).

b) There will be 30 objective questions of 30 minutes duration of 1 mark each.


6. RULES FOR MOOT:

a) Language: The competition shall be held in English language only.

b) Dress Code: Advocate’s Attire/ College Uniform.

c) Team Code: The team code shall be allotted to all the teams soon through email.

d) General Instructions for the Mooters: The mooters shall not state their names during the
submissions, only the team code is to be preferred. All team members must refrain from
disclosing their identity at any time and in any manner during theentire competition.

e) The decision of the organizing committee shall be final and binding.

7. JUDGEMENT

The decision of the judges shall be final and binding.

8. RESULTS

a) The results will be announced within thirty minutes of each round.

b) The results of the final round shall be announced at the valedictory session.
