COMPETITION BRIEF
LawInternships (The Online Law School) stands as one of the fastest emerging
platforms during these unprecedented times. Since its very inception, Moot Court
activities have been kept on the pinnacle, keeping in mind the aspiration to
nourish minds that are comfortable and skilled in dealing with the differing legal
systems and cultures that make up our global community. We are proud to
announce that we are organizing the 2nd edition of the National Moot Court
Competition, 2022. which is scheduled to be held from April 15, 2022 to April 17,
2022. Having successfully organized various different webinars and competitions
in a row, this edition speaks of our efforts that aim at improving the whole
experience by ensuring that the teams are met with a challenging problem based
on contemporary and developing aspects of Law. This Competition will be
conducted virtually allowing the students to hone their advocacy skills. This
Competition will provide an opportunity to the participants to develop the
requisite skills for a dynamic process of Litigation Advocacy.
COMPETITION PROPOSITION
1. The Federal Republic of Mayeechin came into existence in 1947. Its neighbours are the
same as India. The Preamble of the Federal Republic of Mayeechin declares it to be a
Sovereign Socialist Secular Democratic Republic.

4. In the year 2018, in the elections of the Central Legislative Assembly (Lok Sabha) the
Mayeechin Janta Party (MJP) won the majority of seats and formulated the government at
the Centre. MJP propagates the ideology of Hindus (including Jain and Sikhs) and women
empowerment.
5. In 2020, the State Legislative Assembly Elections (Vidhan Sabha) of the 4 States were
conducted. MJP formed their Government in Tatooine and Kondo. Whereas it was the
single largest opposition party in Mandalore and Naboo.
6. All Mayeechin Muslim Party (AMMP) won majority of seats in Mandalore and formed
their Government. Whereas Mayeechin National Congress (MNC) formed government in
Naboo.
7. AMMP believes in propogates the idealogy of Islam. MNC is a secular party and is the
oldest party of The Federal Republic of Mayeechin. MNC formed the first Central
government in The Federal Republic of Mayeechin and had successfully ruled the
country till 2018, when for the first time MJP was able to form a government at the
Centre.
8. Taking the first step towards the achievement of Uniform Civil Code, MJP abolished
the practice of Triple Talaq in Muslims and criminalised this practice. This move was
welcomed by MNC but opposed by AMMP.
9. The State Government of Tatooine with the aim of empowerment of muslim women
in the society issued a Government Order dated 15.02.2022 banning head scarf/ hijab in
Schools and Higher Educational Institutes. This move of the MJP government was
objected to by the AMMP, but the MJP government stood firm on their decision and
started implementing the Government Order effectively in all educational institutions
(including minority educational institutions).
10. Rebuked by this firm stand of the MJP government, the AMMP Government in
Mandalore also issued a Government order dated 23.02.2022 banning all religious pagdi/
turbans and kirpans in Schools and Higher Educational Institutes. Pursuant to this
Government Order, in the State of Mandalore students belonging to Sikh community
were not allowed to enter the institutes unless they removed their turban. On 25.02.2022
AMMP issued another Government Order declaring Paryushan Parv among school
children as illegal, the order further directed to ensure that students of the Jain
community eat food properly under the midday meal scheme during the Paryushan
Parv.
12. The High Court of Tatooine dismissed both the Writ Petitions. The first writ petition
was dismissed by stating that the State has the power to regulate the affairs of
minority education institutes and the constitution does not give an absolute right to
minority education institutes. The second writ petition was dismissed by stating that
wearing of Hijab is not a fundamental right as it does not constitute essential religious
practice, the customary practice cannot be claimed as a matter of right, the practice of
wearing hijab fails to satisfy the test of Constitutional Morality.
13. Before the High Court of Mandalore, Writ Petition was filed by Ishaan Arora
challenging denial of education and violation of fundamental right of freedom of
religion by forcing Sikhs to remove their turbans. Another Petition was filed by Mr.
Rajendra Jain on the ground that fasting during “Paryushan Parv” is an essential
religious practice for the members of Jain Community.
14. The High Court of Mandalore, allowed the Petition filed by Mr Ishaan Arora and Mr.
Rajendra Jain. The High court found that wearing of turban & kirpans and participating
in Paryushan Parv is also an essential religious practice.
15. Islamia Karimia University and Ms. Fardeen Khan filed a separate Special Leave
Petition before the Supreme Court challenging the order passed by the High Court of
Tatooine on the ground that the High Court erred in not considering the fact that hijab
is an essential religious practice, wearing of hijab does not in any manner creates a law
and order situation and minority educational institutes have an absolute right which
cannot be restricted by the Government in any manner.
16. Similarly, State of Mandalore also filed Special Leave Petitions before the Supreme
Court challenging the order passed by the High Court of Mandalore on the ground that
wearing of Turban and keeping Kirpan is not essential religious practice as all the
members of sikh community do not wear turban or keeps kirpan, participating in
Paryushan Parv is not essential religious practice, Right to health outweighs Right to
freedom of religion and Kirpan is a weapon which cannot be allowed in educational
institutes.
17. The Supreme Court issued notices in all the four Special Leave
Petitions and and transferred the case for hearing to the
Constitutional Bench consisting of 7 Judge Bench.

ELIGIBILTY
The Competition is open to every student pursuing either five year or
three year undergraduate course in law from various
Schools/Colleges/Universities in India.
COMPETITION RULES
Dress Code:
The dress code for the Competition shall be business formals. All
the participants are required to adhere to the dress code.
Team Composition:
Each team shall comprise of three students (2 speakers + 1
researcher). Maximum of 2 teams can participate from each
institute. The roles which have been pre-assigned by the team
shall be carried forward throughout the Competition, in every
round. Change of roles after the registration shall not be
entertained.
Competition Structure:
a) The Competition shall take place in three phases: written
submissions, researchers’ test and oral rounds.
b) The Competition shall consist of four rounds and will go on for
three days i.e., from April 15, 2022 to April 17, 2022
COMPETITION ITINERARY
b) The soft copy (in MS Word .doc/.docx & pdf format) of both the
Memorials must be emailed to lawinternships.oc@gmail.com
latest by April 10, 2022, (23:59 hours IST) with subject
“Memorials for Team Code__”.

Researchers’ Test:
a) Researchers’ Test would be conducted online via google form on
April 14, 2022
b) The designated Researcher would be allowed to take the test.
c) Link for the same will be provided by the Organising Committee.
d) Marks obtained by the Researchers will be Final and will be
considered to declare the Best Researcher Award.
Oral Rounds:
a) In the preliminary rounds, each room will have a total of two
teams competing against each other. Similar process will be
carried on in each round.
b) Top 8 teams from preliminary rounds will qualify for quarter-
finals.
c) Four teams from quarter-finals will qualify for the semi-finals on
“Knock-Out” basis.
d) Two teams from semi-finals will further qualify for the finals on
“Knock-Out” basis.
e) Total time limit for each round shall be 60 (sixty) minutes +
Maximum 15 minutes extra to each team in case of any glitches or
questions and feedback from the judges.
f) Each speaker shall be alloted Maximum of 15 min speaking time.
g) The Side allotment will be provided by the Organising Committee
on the spot prior to the rounds and Reasonable buffer time will
be provided to the teams.
h) The teams will be responsible for managing and adhering to their
time limit, failure will result in a penalty.
ANONYMITY
Each participating Team shall be allotted a Team code upon
Registration.
Teams shall not disclose, in any manner whatsoever, for the entire
duration of the Competition, either their own individual identities
or the identity of the institution that they represent, even if asked
by the Judges.
The Teams shall not disclose their identity anywhere in their
Memorials.
Non-compliance with this clause shall result in immediate
disqualification of the Team.
The decision of the Organising Committee with this regard shall be
final.

REGISTRATION PROCEDURE
The participants are required to complete the Provisional
Registration through the link for Google Form annexed below
which shall be done on or before April 5, 2022, The payment
details shall be sent on mail after completion of provisional
registration.
While joining the online meeting room, ensure that the video is
kept on and the microphone is kept unmuted.
It is desired to use headphones during the rounds for better
sound reception and also for avoiding any disturbance during the
session. If headphones are not available then in that case use the
inbuilt mic and speaker of the laptop/device but ensure that no
one else is present in your vicinity with external speaker and mic
on as this will create interference and disturbance in the
meeting. Ideally, you should choose noise-free surroundings.
Do not join the rounds from multiple devices.
Ensure that you do not forward the access link to anyone else.
Do not leave the meeting room unless you are asked to do so.
