People V. Bohol 560 SCRA 232

Facts:
Ricardo Bohol is engaged in unlawful medication exchange Isla Putting
Bato, Tondo, Manila.
Bohol claims that his arrest was illegal because he was peacefully
sleeping when he was arrested without a warrant and neither could
have committed nor was about to commit a crime. Thus, the inquiry led
by the cops was not coincidental to a legal warrantless capture, and the
seized shabu got from the hunt was prohibited as proof against him.

Issues:
Nitullano then assembled a team of police officers to investigate the
informant’s report and, if it was found to be accurate, to immediately
launch a buy-bust entrapment of Bohol; whether the search of Bohol’s
person and the arrest of him were unlawful.

Ruling:
Bohol’s arrest is legal.
Since Bohol had just committed a crime when he sold the shabu to PO2
Estrada, the arresting officers were justified in doing so in this instance.
As a form of entrapment, a buy-bust operation has been repeatedly
recognized as a valid method for arresting people who break the
Dangerous Drugs Law.
The subsequent warrantless search that led to the seizure of the shabu
found on Bohol’s person is also legal in light of the legality of Bohol’s
warrantless arrest.
