INT. LALUNA’S RESIDENCE
Antonio’s lawyer goes inside laluna’s house. He takes a seat
next to laluna and laluna offers him coffe.
LAWYER: Regarding your case, it’s
murder, best we can do is plead
homicide to lower your offense.
LALUNA: Is there a way we can do
that?
LWYR: It depends on the evidences
the prosecutor has, however we can
conduct a report, an investigation
report. Best we can do is to make
it look like it was a self defense
act. First we investigate jane’s
back ground, her mental and
psychological tendencies, and next
we’ll meet is on your last hearing.
Antonio nods in agreement and they both shake hands.
CUT TO:

INT. COURTROOM
As the presiding judge is about to enter the session hall,
everyone stands up.
SHERRIF: ALL RISE! The hearing of
the calendared cases will now
begin. The honorable Judge Joaquin
De los Santos, presiding. Silence
is hereby enjoyed!
Everyone rises and a few men fixes their suits. The Judge
bangs his gravel once.
JUDGE: Call the cases

JUDGE: Appearances!
The prosecutor stands up.
PROSECUTOR: Prosecutor Edward
Martios respectfully appearing for

The lawyer of the accused stands up.
ATTY: Atty. Lorna Maricar,
appearing for the accused. Ready

JDGE: All right, is the accused in

plea bargaining in this case? Is
the accused willing to plea to a
lesser offense of Homicide?
ATTY: If the prosecution will
agree, your Honor.
JDGE: Prosecutor Martios, is the
private complainant amenable to the
proposal of the defense for plea to
a lower offense of homicide?
The prosecutor talks with the complainant.
PROSEC: No, your Honor. The
prosecution is not going to accept
the proposal to plea to a lower
offense of homicide.
NARRATION: Antonio Laluna, accused
of murder under Article 248 of the
Revised Penal Code (RPC), as
amended, which provides:
“ART. 248. Murder. Any person who,
not falling within the provisions
of Article 246, shall kill another,
shall be guilty of murder and shall
be punished by reclusion perpetua,
to death if committed with any of
the following attendant
circumstances:
1. With treachery, taking advantage
of superior strength, with the aid
of armed men, or employing means to
weaken the defense, or of means or
persons to insure or afford
impunity;
2. In consideration of a price,
reward, or promise;
3. By means of inundation, fire,
poison, explosion, shipwreck,
stranding of a vessel, derailment
or assault upon a railroad, fall of
an airship, by means of motor
vehicles, or with the use of any
other means involving great waste
and ruin;
4. .On occasion of any calamities
enumerated in the preceding
paragraph, or of an earthquake,
eruption of a volcano, destructive
cyclone, epidemic, or any other
public calamity;

5. With evident premeditation;
6. With cruelty, by deliberately
and inhumanly augmenting the
suffering of the victim, or
outraging or scoffing at his person
or corpse.

NARRATION: Antonio Laluna was found
guilty of Murder, for killing his
long-term girlfriend Jane Nicole
Armenas. At around 5 am, in March

Antonio is imprisoned. He was handcuffed and was put in the


cell. Antonio’s lawyer looking devastated.
FADE IN:

INT. ROOM
Laluna and his girlfriend are arguing. Jane cries and shouts
at Antonio. Antonio grabs a knife and stabs Jane.
NRRTION: Jane and Antonio, has been
living together for 5 years, their
relationship was open to both their
families however it took a
different turn.
Jane's pictures and her picture in a frame (she died).
CUT TO:

INT. PRISON
Antonio in the prison bars.
Probation and appeal are mutually exclusive remedies.
When, upon appeal, the imposable penalty of the crime is
changed from non-probationable to a probationable one by the
appellate court, e.g. from frustrated homicide (6 years and 1
day) to attempted homicide (2 years and 4 months).
