p1D¢23202704 THE STATE OF TEXAS § IN THE AUSTIN CITY MUNICIPAL COURT x. § JESSE ANTHONY RIVERA § CITY OF AUSTIN MUNICIPAL COURT AFFIDAVIT FOR WARRANT OF ARREST AND DETENTION ‘The undersigned Affiant, who after being duly sworn by me, on oath, makes the following statement; have good reason to believe and do believe that: (Suspect) Jesse Anthony Rivera (Race) HISPANIC/LATINO (Sex) MALE (OB) 04/30/1991 On or about 04-13-2023, in the incorporated limits ofthe City of Atstn, ‘County of Travis, Texas, did then and thee commit the offense of: MURDER-(Ist Degree Felony) ‘Your affiant, Detective Christopher Anderson #6421, has been commissioned as a Peace Officer with the Austin Police Department since January 2, 2009, and is currently assigned as a Detective to the Violent Crime Division, Homicide Unit. Your affiant has obtained the following information from various Sources, including personal knowledge, information and facts gathered by other peace officers during the ‘course of the investigation, suspect and witness statements, and information contained in Austin Police Incident Report 23-1031521. On April 13, 2023, at approximately 8:15 P.M., uniformed officers were dispatched to 10913 Mickelson Drive, Austin, Travis County, Texas, for a Shoot/Stab Hotshot call. Multiple 9-1-1 callers were reportiog the death of a family member. One of the 9-1-1 callers, who identified himself as Jesse “Anthony” Rivera UL, a Hispanic male, bom on April 30, 1991, requested an “ambulance and the cops", Anthony informed the 9-1-1 call taker that he had just killed someone that wasn't his dad, When the 9-1-1 caller taker asked how he Killed him, Anthony stated, “I hit him in the head with the bat at first. And then, uh, took him down and then, uh, got a knife and then, uh, was trying-just trying to do a kill thing, to kill him in his neck.” Uniformed officers arrived at the residence a short time later, As officers were setting up containment, Anthony exited the residence while stil on the phone with the 9-1-1 call taker. Officers detained Anthony, and noticed what appeared to be blood on his left elbow as he was being detained. After Anthony was detained, uniformed officers made entry into the residence where they observed blood on the wall and floor. As they began searching for the victim, they located him lying on the floor with obvious trauma to his head that appeared to be consistent with both blunt force and sharp force trauma. While on scene officers observed a bloody knife and two bloody baseball bats within the room the victim was in. Austin Travis County Emergency Medical Services (A/TCEMS) and Austin Fired Department (AFD) began to assess the victim; however, his injuries were incompatible with life. The victim was pronounced deceased by Dr. Escott at 8:34 P.M. The victim was later identified as Jesse Anthony Rivera, Jr., a Hispanic male born August 23, 1971. The decedent was also identified as Anthony's father. Your Affiant conducted an interview with Anthony and read the Miranda Waring to him; advising him of his rights. Price, District Clerk During the conversation with Anthony, he stated the decedent had become a different person in the past couple of weeks, Anthony stated the decedent had become more aggressive with him, Your affiant asked Anthony to clarify what he meant by more aggressive. Anthony stated the decedent woulda’t respond to ‘him when he tried to have conversations him and instead would ignore him. Your affiant asked what happened tonight, Anthony stated the decedent was giving him weird looks and he overheard the decedent and his grandmother having a conversation in the kitchen. Your affiant asked Anthony to elaborate on what he overheard them saying. Anthony wouldn't elaborate, only stating that the decedent and his grandmother would get real quiet and give him weird looks when he walked into the kitchen. Anthony stated the decedent walked by him and gave him a weird look that made him feel like he hhad to do because that wasn't his father, Your Affiant asked Anthony whet he means he says “Do what I have to do.” Anthony restated that he ‘Went into the decedent’s room to do what he had to do. Your Affiant asked Anthony to clarify what he ‘meant. Anthony stated, “I basically went in there with a baseball bat and hit him in the head a few times. He (the decedent) fell out of the bed and then he started snoring, I hit him a couple more times, And then I Went and got a knife out of drawer.” Anthony clarified that he retrieved the knife from the kitchen Grawer. Anthony described the knife as being similar to a Chef's knife. Anthony said it was silver knife with a silver handle that a purple lining around it. ‘Your Afiant asked Anthony what he did with the knife after he retrieved it from the kitchen. Anthony Stated, “That after he (the decedent) was already slumped over... remember...he was trying to get up ‘gain, well he didn’t get up all the way but after [hit him he was getting up and I had to do what I had to do. And the first thing I did was go right here and right here.” Anthony stated, "It was kind of a struggle but it was either me or him, like I said.” ‘Your Affiant asked Anthony if the decedent fought back. Anthony said the decedent only fought back after the initial struggle. Anthony states, “The initial blow to the bead,” Anthony goes on to describe the ttack with the baseball bat. Anthony told your affiant that after he initially struck the decedent with the baseball bat, the decedent got out of the bed and they began to struggle for the baseball. Anthony told your affiant that he pulled the baseball bat away from the decedent and struck him in the head again. Anthony said he put the baseball bat up next to the door that enters the room. Anthony stated, “I was trying to kill him, So went and got the kitchen knife and started, just basically going for the neck. I was just trying to get it done quick because I didn't know what 1 was doing,” Anthony said he stabbed the decedent multiple times because he was just trying “to get him over, get it done.” ‘Your Affiant asked Anthony what happened after he stabbed the decedent. Anthony stated the decedent ‘was still trying to get up and was struggling. Anthony described the decedent lying on his left side, Anthony said he stabbed in the neck again to try and get it over with. Anthony said he walked in and out of the room a few times because he thought the decedent was done, but he kept hearing him gurgling so he got the baseball bat again. Anthony said he was just trying hit him in the a few more times because he as just trying to finish him (the decedent), Anthony said he left the decedent's room and went to the kitchen. Anthony said he paced back and forth in the kitchen for a bit and then retumed to the decedent's room. Anthony said he grabbed the baseball bat again and struck the decedent again because he wes still alive, Anthony stated he could sce that the decedent was still alive so he grabbed the knife again and bbegam to stab him in the neck. Anthony stated, “Like I said, I don’t know how to kill someone efficiently with a knife.” On April 14, 2023, your affiant attended the autopsy of Jesse Rivers. Your affiant received information from the pathologist, Doctor Gonzalez that Jesse Rivera, Jr, sustained sharp force trauma and blunt force trauma to his head and neck, and the manner of death ‘was homicide, Based on the totality ofthe circumstances, affiant believes there i sufficient probable cause to support the charging of Jesse Anthony Rivera II, a Hispanic male, born Apri 30, 1991, with Murder in the sharp force/ blunt force trauma death of Jesse Rivera, Ia Hispanic male, bom August 18, 1971, besed we but Petlmited to, Anthony's statements, evidence gathered atthe scene and the Travis County Medica!
