Case Study 1 Answer:

A, the male spouse, has left the conjugal home making him a recipient of the Family Code
Article 121 stating that A to be liable to all spousal needs including the needs of their common
children. Moreover, both spouses are to agree on a specific amount of liability against the liable
entity, giving B, the wife, the ability to raise the agreed upon amount of monthly support from
P50,000 to a higher amount proportional to the needs of both B and the child. The Family Code
of the Philippines Child Support Article 195 and 196 states that the amount given to B and the
child will be settled in court depending on the necessities of the child (i.e, assuming the child
has school, A shouldn’t disregard the expenses for the child’s education).
