If the space provided at any point is insufficient, you may annex additional sheets. Any annexure must contain a heading
which identifies it as such and specifies the parties to the transaction and the date of execution. All additional pages must
be signed by the parties and any attesting witness.
1. This form is to be used for the discharge of a mortgage or charge. It may also be used for the partial discharge of
the mortgage or charge, for example, in the case of the land in the mortgage or charge having been subdivided,
and the mortgage or charge having been carried forward onto the titles for the subdivision parcels of land, and the
mortgage or charge being discharged as regards one or some of the subdivision parcels of land.
2. If there is insufficient space in the panel for listing multiple titles, list the titles and land descriptions on an
annexed sheet. The owner’s copy of the title(s) or leases(s), as appropriate, must be produced to the Titles
Office to permit registration of this dealing. Rule through inappropriate words. The land description(s) should be
the same as shown on the title(s). In the case of a partial discharge, the land to which the discharge applies
should be described clearly.
3. Show the Journal number of the mortgage or charge being discharged. If the discharge affects part only of a
mortgage/charge but the whole of the land in the title(s), the word “PART” should be shown.
4. The name of the mortgagee/chargee should be the same as shown on the title(s).
5. The following encumbrances must be noted and proof provided that they do not impede or prevent the discharge
of mortgage from being registered. Caveat, Registrars Caveat, Court Order / Injunction, Writ of Execution
6. The signature of the mortgagee/chargee should be attested by a witness who is not a party to this dealing. The
witness must print his/her name and postal address clearly. In the case of a dealing being executed by a person
who signs by a mark, the witness shall certify that the person appeared to understand the nature of this dealing.
Where a company as proprietor executes the document the company seal of the company must be affixed and
the names and designations of the persons signing under seal must be shown.
7. This dealing, if for land in a State lease, will not be accepted for registration unless rent is paid up to date.
